id=\"Applicability_of_the_Rule\"><\/span>Applicability\nof the Rule<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Electrical\nand Electronic Equipment (EEE) producers have been given options in the E-Waste\n(M) Rules, 2016, to manage the producer responsibility (EPR) either\nindividually\/collectively through a producer responsibility organization (PRO)\nrecognized by the producers in their EPR &#8211; Authorisation. A PRO shall apply to\nthe Central Pollution Control Board for registration to execute the activities\nrequired for Producer Responsibility Organizations under these Rules, according\nto Rule 13 (1) (xvii) of the E-Waste (Management) Amendment Rules, 2018. In the\ndefinition of the PRO, the said rules regulated the actions to be carried out\nby the PRO.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"PRO_Definition\"><\/span>PRO Definition <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According\nto rule 3(dd), a &#8216;Producer Responsibility Organization&#8217; (PRO) is a professional\norganization authorized or financed collectively or individually by producers\nto collect and channel e-waste generated from the &#8216;end-of-life&#8217; or disposal of\ntheir products to ensure environmentally sound management of such waste.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Role_of_PRO\"><\/span>Role of PRO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A PRO can\nonly assist a producer or producers in satisfying their legal obligations if\nthe producer (s) engage that PRO.<\/p>\n\n\n\n<ol><li>E-waste collection and channelization on behalf of authorized manufacturers for environmentally appropriate waste management. Producers can hire PROs for single or many tasks related to EPR administration.<\/li><li>PRO&#8217;s actions may comprise one or more of the duties listed below.<ul><li>Establishment of a collecting mechanism (door-to-door collection\/collection campaign\/e-waste exchange platform\/individual procurement)<\/li><li>Buyback\/take back\/DRS\/e-waste exchange implementation<\/li><li>Establishment of collection points\/centres this may entail establishing collection or operating through warehouses following CPCB norms.<\/li><li>Take back implementation<\/li><li>Logistics planning<\/li><li>Ensuring the traceability of collected and channelled e-waste<\/li><li>Ensuring environmentally sound e-waste disposal and recycling<\/li><li>Organize an awareness campaign among consumers\/large consumers\/producers on collecting and re-using e-waste.<\/li><li>Assisting producers in filing quarterly\/annual returns in accordance with the guidelines<\/li><\/ul><\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Role_of_Producer_in_E-Waste_management\"><\/span>Role\nof Producer in E-Waste management<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nproblem of minimizing E-waste is urgently needed in India by introducing\neffective E-Waste Management. Everyone must be aware and take responsibility to\neliminate the pollution caused by e-waste. In addition, the government has\nbegun to reduce e-waste output in India. As a result, they founded the\nProducers Responsibility Organization. The Producers Responsibility\nOrganization&#8217;s role is to assist producers and meet their legal obligations in\nattaining the collection E-waste objective, introducing E-waste collection facilities,\nand conducting E-Waste Management awareness programmes.<\/p>\n\n\n\n<p>PRO\npermission agreements must be executed between producers or with a producer\nassociation. The agreements must clarify the Producer Responsibility\nOrganization&#8217;s role and responsibilities.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Role_of_Recycler_in_E-Waste_Management\"><\/span>Role\nof Recycler in E-Waste Management<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Every individual proposing to recycle plastic\nwaste must apply for registration with the State Pollution Control Board or the\nPollution Control Committee to ensure environmentally friendly waste management\nand to facilitate adequate pollution control equipment to prevent environmental\npollution.<\/li><\/ul>\n\n\n\n<ul><li>Every individual involved in recycling plastic\nwaste shall arrange and submit an annual report to the local authority\nconcerned by the 30th of April of each year, with notification to the concerned\nState Pollution Control Board or Pollution Control Committee. <\/li><li>The Central Pollution Control Board has the\nauthority to audit, substantiate, and scrutinize the application and decide\naccordingly.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Regulation_of_Producer_Responsibility_Organisation\"><\/span>Regulation\nof Producer Responsibility Organisation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The PRO\u2019s\nresponsibility is explained in two sectors as follows-<\/p>\n\n\n\n<ol><li>Plastic Waste Management<\/li><li>E-Waste Management<\/li><\/ol>\n\n\n\n<p>The\nE-Waste Management Rules, 2016, and the Plastic Waste Management Rules, 2016\nhold producers liable for collecting plastic electronic product waste. Such\nproducers must set up a strategy to manage the waste generated by their\nproducts.<\/p>\n\n\n\n<p>In\nDecember 2020, the Prime Minister spoke about the benefits of fully utilizing\nelectronics and carefully discarding outdated stuff. He also discussed the\nimportance of effectively managing electronic trash. In August 2021, he\nintroduced the &#8216;Garbage to Wealth&#8217; programme, which focuses on repurposing\nwaste.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Authorization_and_Recognition_of_PRO\"><\/span>Authorization and Recognition of PRO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The form\nto be submitted to the Central Pollution Control Board for registration of PRO\nis included with the directives for both plastic and electronic waste\nmanagement for recognition and authorization of the Producer Responsibility\nOrganization. The specifications for e-waste management do not specify any\nminimum requirements for <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/pro-authorization\">PRO registration<\/a><\/strong>, whereas waste management\nguidelines provide the conditions listed below.<\/p>\n\n\n\n<ul><li>Any Statutory Body registration,<\/li><li>At least five years of waste management experience\nis required.<\/li><li>Disclosure of successful municipal solid waste and\nplastic waste disposal,<\/li><li>TAN, GST, and PAN information.<\/li><\/ul>\n\n\n\n<p>The <strong>CPCB<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/cpcb.nic.in\/\"><strong>[1]<\/strong><\/a><\/sup> has\nthe authority to scrutinize, verify, and examine the application before issuing\nthe registration. Furthermore, the registration of the E-waste management\nguidelines will be valid for three years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Capacity_of_PRO\"><\/span>Capacity of PRO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A PRO\nshould be able to channel e-waste to satisfy its producers&#8217; collection targets.\nA PRO should explain its organizational structure regarding human resources,\ncollecting facilities, and infrastructure for e-waste collection, storage, and\ntransportation. A PRO should also state its capacity for processing e-waste,\nwhich includes collecting, storage, and transportation capacity, as well as the\ncapacity of its dismantler and recycler with whom it has an agreement for e-waste\ndismantling and recycling. PRO should offer information about its collection\nsystem and should be able to conduct an awareness campaign to educate consumers\nabout its channelization schemes and collecting mechanisms via\nprint\/visual\/display media.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Step_involved_in_PRO_Registration\"><\/span>Step involved in PRO Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Step 1:<\/strong> A PRO\nUsing the form supplied under the act is to apply for registration with the\nCentral Pollution Control Board.<\/p>\n\n\n\n<p><strong>Step 2: <\/strong>CPCB will\nthen evaluate the capability and capacity to undertake e-waste collection,\nstorage, transportation, dismantling, recycling, and carrying out awareness\nprogrammes for e-waste channelization upon receipt of a comprehensive\napplication. <\/p>\n\n\n\n<p><strong>Step 3:<\/strong> The CPCB\nverifies the applications and responds with a checklist within 25 days of\nreceipt. The concerned authority at CPCB will issue a letter along with a list\nof deficiencies.<\/p>\n\n\n\n<p><strong>Step 4:<\/strong> The\nMember Secretary of the CPCB shall be the appropriate authority to approve the\nPRO&#8217;s registration. <\/p>\n\n\n\n<p><strong>Step 5:<\/strong> CPCB\nshall award registration to the PRO within 60 days of receipt of the completed\napplication if it is satisfied with its capability and capacity.<\/p>\n\n\n\n<p><strong>Note:<\/strong> A\nrenewal application must be submitted within 60 days of the registration&#8217;s\nexpiration date.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cancellationsuspension_of_registration\"><\/span>Cancellation\/suspension of registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>If a PRO\nfails to comply with any of the registration conditions or any sections of the\nE(P) Act, 1986 or E-waste (Management) Rules, 2016 or amendments thereof during\nthe registration period, CPCB may cancel or suspend the registration. If a PRO\nis found to be in violation of a registration clause during random CPCB\/SPCB\nchecking, the CPCB\/SPCBs may issue a notice within 25 days of such\nverification\/checking.<\/p>\n\n\n\n<p>Before a\nPRO&#8217;s registration is cancelled or suspended, the PRO will be given the option\nto appear before the Member Secretary of the CPCB, who will approve the\ncancellation or suspension of the PRO&#8217;s registration. The registration\ncancellation or suspension decision will be communicated within 10 days\nfollowing the hearing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Appeal\"><\/span>Appeal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any PRO\naggrieved with an order of cancellation or suspension of registration issued by\nthe Member Secretary, CPCB, may appeal to the Chairman CPCB within thirty days\nafter receiving the order, whose decision is final.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Reducing E-waste in India is crucial, and everyone should be aware of the issue and commit to eradicating pollution caused by e-waste. The Indian government has attempted to limit the amount of e-waste produced by E-Waste Management. As a result, PRO was created (Producers Responsibility Organization). The role of PRO is to assist producers in meeting their legal obligations by aiding them in meeting E-waste collection targets, constructing E-waste collection facilities, and implementing E-waste collection awareness programmes. The government&#8217;s Producer Responsibility Organization project is a practical step in the waste management process. PRO&#8217;s success, however, is dependent on upper management.
