However, importers or producers must have the necessary\npermits to operate in India. Importers and manufacturers may suffer debarment,\nfines, or both.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What Impact Does EPR Certificate For Import Has On The Environment:<\/h3>\n\n\n\n<ul><li>Encourage Product Reuse: The EPR strategy increases promptitude and makes it easier to disassemble products or objects for reuse and recycling. As a result, you can reuse the product or item without buying new raw materials.<\/li><\/ul>\n\n\n\n<ul><li>Ensure Sustainable Development: EPR promotes or\nencourages the conservation of natural resources, reduces the quality of waste,\neliminates pollution, and so on. This summarises sustainable development, which\nis critical for customers and manufacturers.<\/li><\/ul>\n\n\n\n<ul><li>Environmental Impact: EPR Certificate decreases\nreliance on other waste disposal methods, such as burning (which produces\nhazardous gases such as formaldehyde, furans, dioxins, and so on) that are\nunsafe or damaging to humans when inhaled. Despite having an impact on humans,\nit also impacts the land structure. Furthermore, EPR decreases the efforts of\nlocal communities in physically and financially keeping garbage because EPR\nconfirms appropriate recycling and refurbished products or their parts.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_to_Get_EPR_Certificate_for_Import_in_India\"><\/span>Process to Get EPR Certificate for Import in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Application Submission \u2013 The application must be submitted to CPCB in Form-1 within three months of these rules becoming effective.<\/li><\/ul>\n\n\n\n<ul><li>According to the new guidelines, Applications for\nEPR Registration for importing E-Waste in India (EWM Rules, 2016) can be\nsubmitted online.<\/li><\/ul>\n\n\n\n<ul><li>User instructions for applying to this site will\nbe available after successful login.<\/li><\/ul>\n\n\n\n<ul><li>The Board will review the EPR Plan after receiving\nthe complete application. When all requirements are met, the CPCB issues an EPR\ncertificate for Import in Form 1 to import e-waste into India. The Board grants\nthe authorisation within four months, and is valid for five years.<\/li><\/ul>\n\n\n\n<ul><li>The authority to refuse or terminate the issuance\nof an EPR certificate for the import of e-waste into India.<\/li><\/ul>\n\n\n\n<ul><li>Under the guidelines, the Central Pollution\nControl Board has the authority to refuse to issue an EPR certificate for the\nimport of e-waste, but it also mandates the applicant be provided with an\nadequate opportunity to be heard.<\/li><\/ul>\n\n\n\n<ul><li>In the event of a rejection, the producer can\nmarket any EEE once authorisation is granted.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mandatory_Guidelines_To_Be_Followed_To_Get_EPR_Certificate_%E2%80%93\"><\/span>Mandatory Guidelines To Be Followed To Get EPR Certificate: &#8211;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>The producer, manufacturer, importer, refurbished, transporter, dismantler, and recycler are all accountable for any environmental or third-party damages caused by improper e-waste management and disposal.<\/li><li>Producers importing or selling EEE must submit Form &#8211; 1 to the CPCB to obtain the EPR certificate for importing e-waste. If this is not done, appropriate legal action will be taken.<\/li><li>For any infringement of the terms of these regulations, the importer and all other people indicated above shall be obliged to pay financial penalties as specified in <strong>the Environment (Protection) Act, 1986<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/4316\/1\/ep_act_1986.pdf\"><strong>[1]<\/strong><\/a><\/sup>.<\/li><li>Only producers with EPR authorisation will be permitted to import EEE. Therefore obtaining an EPR certificate for the import of e-waste is necessary.<\/li><li>The CPCB oversees performing random checks to\nensure compliance with the e-waste rules. Furthermore, the Board must identify\nproducers or importers who have yet to apply for EPR authorisation or must\nfollow RoHS regulations.
