Developing countries like India need to globalize their\nmarket and decrease internal and external barriers for the inflow and outflow\nof goods and services to improve the standard of living and to maintain\ncompetition even among the local brands. India have had a history of economic\ncrisis during the 1990\u2019s, but since it has opened its gate to the global\ncompanies it has helped to lift a lot of economic barriers and decreasing the\npermits and licensing requirements. India has grown its economy tremendously\nsince globalization. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rights_Under_Global_Trademark\"><\/span>Rights Under Global Trademark<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are\nsome important rights under Global Trademark:<\/p>\n\n\n\n<ul><li>Global Trademark not just benefits the\ncountry but definitely the companies as well, as they get the rights to sell\ntheir products and services in the international market and expand their\ncustomers base, their reputation and get global recognition. <\/li><li>The companies get all those rights which a\nlocal trademark user gets in the country where his Trademark is registered. In\norder to sell his goods and services, he will have to make and distribute the\nproduct. So, just like that, he can even manufacture the products and services\nlocally and sell them globally, which would benefit the company at a mass scale,\nor he can exercise his rights of production, manufacturing, selling and\ndistribution rights even globally. The companies not just get the selling and\nmanufacturing rights but also all the rights related to the protection of the Trademark.\nNo person globally will be able to copy, deceit, or defraud the Trademark. If\nany person tries to sell the product under the brand name, logo, shape, design,\nor any other thing which resembles or is deceptively similar in order to create\nconfusion in the minds of the people will be held for infringement of the rights\nglobally.<\/li><li>So the trademark user gets all the legal\nprotection against the infringement of his Trademark at a global level and\nwould provide the company with a perpetual existence.<\/li><li>The global trademark holder would take\nyears to reach a level where he can establish his own production and\ndistribution centres globally so he can also make use of imports. The holder\nalso has access to the right to provide import licenses to other parties which\nwould enable them to popularize their products and the license would also not\nget misused as the owner holds exclusive right to global Trademark.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Overview_of_Madrid_System\"><\/span>An Overview of Madrid System<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nMadrid system was not easy to commence with, its debates went on from 1891 and\nwas finally formulated in the year 1996. It allows a trademark user to practice\nall those rights which he practices locally at an international level that too\nby undergoing just one application at the international trademark office under\nthe Madrid system. It accumulates and provides all rights to a trademark user\nat the global level.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Essential_for_Acquiring_International_global_Trademark\"><\/span>Essential for Acquiring\nInternational global Trademark:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>There are three criteria&#8217;s set which\nensures the eligibility for acquiring global Trademark:<\/li><li>The global trademark applicant must be an\nIndian by birth or has Indian domicile.<\/li><li>The trademark applicant must hold a prior\ntrademark registration locally before he applies at the WIPO. It is essential\nthat he must hold Trademark locally before going global.<\/li><li>Only those goods and services will be\ngiven global trademark recognition which hold local trademark registration. If\nany new range of products and services is introduced, then it shall be\nregistered with the origin country\u2019s registrar as well.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Registration_of_Global_Trademark\"><\/span>Registration of Global\nTrademark:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Global Trademark helps the companies to\nexercise their trademark protection right in various jurisdictions. This does\nnot require that the applicant will have to file several separate applications\nin each country to enable the global protection for Trademark. <\/li><li>The applicant will only need to file an\napplication at the World Intellectual Property Rights commonly known as <strong>WIPO<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/en.wikipedia.org\/wiki\/World_Intellectual_Property_Organization\"><strong>[1]<\/strong><\/a><\/sup>.\nWIPO works at the international level for the protection of not just Trademark\nbut all other intellectual properties. <\/li><li>A trademark owner will have to follow the\nMadrid System principles. If a trademark user wants to register globally then\nhe will have to pass a test at the local trademark registration authority. For\ne.g. USPTO is the trademark authority for the US, So if a trademark user at the\nUS wants to apply at the WIPO for the trademark registration globally then he\nwill have to&nbsp; undergo a process where the\nUSPTO will decide that whether or not the applicant is eligible for further\nprocesses. If they agree to pass the application, then USPTO will contact the\nGeneva offices of IPO.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/international-trademark-registration\">Global trademark registration<\/a><\/strong> is a step towards protecting your and your company\u2019s name in the international market because it is very vast and one cannot be present every where to stop those who does an infringement, so a little cost spent for trademark&nbsp; registration offers much wider&nbsp; and longer range of protection. One can invoke the legal protection as soon as he finds an infringement of his rights anywhere across the world.
