After that within 3-4 months the applications\nstatus will be decided, i.e., if it is approved or not. If the registrar is not\nsatisfied with the trademark due to reasons like deception, fraud or otherwise,\nthen action will be taken. The applicant will be given six months to represent\nhimself.<\/li><li>After the hearing is completed, if the registrar is satisfied\nthen the trademark application will be issued and published in the official\ngazette. If any person has some kind of discrepancies, then he has to file for\nsuch within one month from the date of the publication of the trademark. The\nprocess usually takes 9-12 months to successfully complete the registration\nprocess if no objections have been raised against the application.<\/li><li>After expiry of 1 month, if no opposition has been raised\nthen, the certificate will be issued, in case of intent to use application, the\napplicant will have to submit the proof of use within 36 months from the date\nof issuance of the certificate only after that the registration will be\nsuccessfully completed.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"SM_Dyechem_Ltd_vs_Cadbury_ltd\"><\/span>SM Dyechem Ltd. vs Cadbury ltd<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The plaintiff had a trademark of the word\n&#8220;piknik&#8221; for his company which dealt in edible products like chips,\nwafers, popcorn etc. the respondent used the mark as &#8220;Cadbury&#8217;s\npicnic&#8221; for his brand in producing chocolates. So, the suit was filed for\ninjunction against the respondent against stoppage for using the mark picnic\nwhich was alleged to be similar and creating confusion.<\/li><li>The respondent claimed that its brand mark\nis registered in 110 countries and is well known across the globe since 1999.\nAnd picnic is a dictionary word which cannot be claimed over monopoly.<\/li><li>The court held that the words are not\ndeceptively similar as both are visually different and the composition of words\nare also different.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bigtree_Entertainment_vs_Brain_Seed_Sportainment\"><\/span>Bigtree Entertainment vs. Brain Seed Sportainment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The plaintiff used the mark called\n\u201cbookmyshow\u201d since a considerable period of time whereas the defendant used a\ndomain name called bookmysports.com. both the plaintiff and the defendant had\nthe domain names with the prefix bookmy which was alleged by the plaintiff to\nbe deceptively similar with his domain name.<\/li><li>The court held that book my is a common\nprefix and that the plaintiff failed to show that his domain name has attained\nthat much amount of fame and that it has not attained distinctiveness enough to\ngrant injunction to the defendant.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/trademark-registration\">Trademark registration<\/a><\/strong> has been exceedingly popular throughout the world and is\nexpanding each day.
