It possesses a\nspecific personality, reputation, and unique characteristics. It inspires\nconfidence and honesty. The World Intellectual Property Organization <strong>(WIPO)<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/en.wikipedia.org\/wiki\/World_Intellectual_Property_Organization\"><strong>[1]<\/strong><\/a><\/sup> defines a geographical\nindication as a distinguishing sign that has a particular provenance, and that\nhighlights the characteristics or traits that the good possesses. The Geographical\nIndication tag makes sure that only those who have registered as authorised\nusers are permitted to use the well-known brand name. The first GI tag product\nin India was Darjeeling tea, which given in the year 2004.<\/p>\n\n\n\n<p>The term Geographical\nIndications are defined under <em>Article 22\n(1)<\/em> of the World Trade Organization Agreement on Trade-Related Aspects of <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/learning\/basics-of-intellectual-property-rights\/\">Intellectual Property Rights<\/a><\/strong> (TRIPS) as: &#8220;Indications which identify a good as originating in\nthe territory of a member, or a region or a locality in that territory, where a\ngiven quality, reputation or characteristic of the good is essentially\nattributable to its geographic origin.&#8221; The Paris Convention for the\nprotection of Industrial Property, 1883, under <em>Article 1(2)<\/em> and <em>Article 10<\/em>,\nprovides the framework for the protection and safeguarding rules for\nGeographical Indication. It covers commercial names, service marks, industrial\ndesigns, geographical identifiers, and so forth. The Madrid Agreement for\nRepression of False or Deceptive Indications of Source of Goods, 1891, also\ntalks about Geographical Indication. The concept of GI is also covered under\nThe Agreement on Trade-Related Aspects of Intellectual Property Rights under <em>Article 22 to Article 24<\/em>. The structure mandated\nby the Geographical Indications Goods (Registration and Protection) Rules,\n2002, is operationalized by the Geographical Indications of Goods (Registration\nand Protection) Act, 1999. <em>Section 2(e<\/em>)\nof the Rules defines the term \u2018Geographical Indication\u2019.<\/p>\n\n\n\n<p>Any producer, whether an\nindividual, a group of people, an organisation, or a legal entity, may apply\nfor a GI tag. The application must be submitted to the relevant authorities in\nthe correct format and with the appropriate charge. A Geographical Indication tag\nis only valid for ten years, but it can be periodically renewed for an\nadditional ten years each through subsequent renewals. The Indian Government\nestimates that approximately 432 Geographical Indications tags have been\nassigned to various goods.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Grant_of_Geographical_Indication_Tags\"><\/span>Grant of Geographical Indication Tags<strong>&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Geographical\nIndications of Goods (Registration and Protection) Act of 1999 governs the\ngranting of the Geographical Indication tag. Any company or producer of\ncommodities is eligible to apply for GI tag. The application must specify the\nkind of goods to which it will apply as well as a geographical map of the\nterritory or region in the nation where the goods are manufactured. It must be\npresented with a certain fee and in the appropriate format, along with a signature.<\/p>\n\n\n\n<p>Authorities will evaluate\nand examine the application.&nbsp; A product\nwith a GI tag prohibits unauthorised usage of the goods and increases financial\ngain for the producers by exporting the product. The price of a GI product\nrises on the international market as exports rise. The geographical indication supplied to the good confers the exclusive right on the authorised user. Geographical designation properly acknowledges the value of the commodity. It stops any form of exploitation or deceptive representation. The Geographical Indications of Goods Act specifies the appropriate remedy in cases of infringement. Geographical Indication establishes a clear connection between the product and its place of origin.
