The same rule is also applicable to the\ncontractor. <\/li><\/ul>\n\n\n\n<ul><li>The establishment\nemploying labour from other states must register with the licensing officer\nappointed by the State\/ the Central Government, as the case may be. On the same\nnote, the contractors intending to employ the said labour class must register\nwith the governing authority in the host state &amp; home state of the workers.\n<\/li><\/ul>\n\n\n\n<ul><li>The contractors are\nobligated to share the workers&#8217; details with the concerned authority of both\nthe host and home state in the prescribed format. Besides, every recruited\nworkman should be provided with a passbook enclosing the employment details.<\/li><\/ul>\n\n\n\n<ul><li>The wages payable to the\nmigrant workers must come into effect from the date of their recruitment. In\naddition to such wages, the contractor must also pay the displacement and\njourney allowance, as and when required. <\/li><\/ul>\n\n\n\n<ul><li>The contractor and\nprincipal employee shall be responsible for workplace hygiene and workers\u2019\nwell-being. They are accountable for providing workers with residential\naccommodation, apt medical facilities, safety gear, and apparel to combat the\ndiverse climatic conditions. <\/li><\/ul>\n\n\n\n<ul><li>The inspecting officials\nappointed by the governing authority can vet the premises served by the migrant\nworkmen to make some compliance checks. <\/li><\/ul>\n\n\n\n<ul><li>Any migrant workman\n(serving the industrial sphere) has the right to file a case with a respective\nauthority against those accountable for misconduct or prejudice he experienced\nduring his employment. He can also choose to transfer proceedings to his home\nstate after the completion of this employment tenure. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_to_apply_for_ISMW_Licence\"><\/span><strong>Documents\nrequired to apply for ISMW Licence <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowing are the documents required for ISMW License:<\/p>\n\n\n\n<p><strong><em>For contractor<\/em><\/strong><\/p>\n\n\n\n<ul><li>PAN of the Contractor <\/li><li>Agreement with the establishment where the migrant workers are working <\/li><li><strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/gst-registration\">GST certificate<\/a><\/strong><\/li><li>Trade license (applicable in some states) <\/li><li>Aadhaar card <\/li><\/ul>\n\n\n\n<p><strong><em>For principal employer <\/em><\/strong><\/p>\n\n\n\n<ul><li>PAN of the principal\nemployer<\/li><li>Incorporation certificate\nof the firm or partnership deed, depending on the legal structure.<\/li><li>Agreement with the\ncontractor who is entitled to supply the migrant workmen<\/li><li>Tenancy document <\/li><li>GST certificate <\/li><li>Aadhaar card <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_apply_for_ISMW_Licence_online\"><\/span><strong>How to apply for ISMW Licence online?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Head to the <strong>Shram Shuvida portal<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/shramsuvidha.gov.in\/home\"><strong>[1]<\/strong><\/a><\/sup> and log in to the same. <\/li><li>Once the dashboard prompts on the screen, tap on the option- Apply for New License.<\/li><li>On the next window, check the box near the option \u201cInter-State Migrant Worker Act.\u201d <\/li><li>Once the e-form prompts on your screen, start entering the contractor details such as name, address, email address, contact number,&nbsp; PAN number,&nbsp; etc. Hit the Next tab located at the bottom left of the e-form. <\/li><li>In the next section, enter the establishment details, such as <ul><li>Registration certificate\nnumber<\/li><li>Establishment name <\/li><li>Name and address of the\nprincipal employer <\/li><li>Date of registration <\/li><li>Email and contact number\nof the principal employer <\/li><\/ul><\/li><\/ul>\n\n\n\n<p>Click on the Next tab once\nyou are done with this requirement.<\/p>\n\n\n\n<ul><li>Enter the following information in the next section, i.e., Contract with Details.<ul><li>Nature of the work\nperformed in the concerned premises <\/li><li>The date on which contract\nwork is proposed to be commenced.<\/li><li>Name of the contractor\u2019s\nmanager <\/li><li>Location of work<\/li><li>Activities as per National\nIndustrial classification <\/li><li>Details of Selected NIC\ncode<\/li><li>Maximum no. of contract\nworkers to be employed in the establishment on any day<\/li><\/ul><\/li><li>Upload the mandatory\ndocuments as mentioned below in the acceptable format<\/li><li>E-sign the application via\na digital signature and head to the payment gateway<\/li><li>Use the payment portal for\nthe fee submission.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_for_breaching_norms_of_ISMW_licence_and_its_governing_legislation\"><\/span><strong>Penalties for breaching\nnorms of ISMW licence and its governing legislation<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Whomsoever breaches any\nnorms concerning the employment of migrant workers or commits any default in\nrelation to the ISMW&nbsp; licence shall be\npunishable with a jail term of one year or with a monetary fine of Rs 2000 or\nwith both. <\/p>\n\n\n\n<p>Furthermore, a penalty of\nRs 1000\/day shall be imposed on those who continue to be in default even after\nbeing convicted by the authority. <\/p>\n\n\n\n<p>If any individual breaches\nany norm for which a penal provision does not exist in the Act, the defaulter\nshall be subjected to the following penalties;<\/p>\n\n\n\n<ul><li>Jail terms of two years;<\/li><li>Monetary penalty of Rs 2000;<\/li><li>Or both<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>ISMW Licence is a must-have legal permit for contractors and principal employers dealing with the migrant workforce in India.
