It has been established under the Food Safety and Standards Act, 2006 to regulate and monitor the food business in the country. <\/p>\n\n\n\n<p>Any food manufacturer, retailer, distributor, and other entities in the business of food operations in India are required to obtain the requisite FSSAI registration to operate in the Indian market. This also includes, inter alia, hawkers selling packaged or freshly prepared food products, restaurants, hotels, catering businesses, canteens and clubs, importers and exporters, cloud kitchens, online food products providers, wholesalers and marketers of food products, cold food storage facilities, relabeling units, repackers. <\/p>\n\n\n\n<p>The <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/fssai-license\" title=\"FSSAI License Apply\">FSSAI registration<\/a><\/strong> and license is provided to the Food Business Operators or FBO based on the size of the company, its annual turnover, the nature of the business and the production capacity of the company. If a food business operator manufactures, stores, processes, and sells food products without obtaining the requisite FSSAI registration, such an operator shall incur penalties. There are three types of FSSAI\nregistration that a food business operator can go for:<\/p>\n\n\n\n<ul>\n<li><strong>FSSAI\nRegistration for Petty Food Businesses<\/strong><\/li>\n<\/ul>\n\n\n\n<p>This registration applies to food business\noperators with a turnover of less than 12 Lakh per annum. The application for obtaining\nsuch FSSAI Registration is to be filled by duly filling out <strong>Form-A.<\/strong><\/p>\n\n\n\n<ul>\n<li><strong>FSSAI\nCentral License<\/strong><\/li>\n<\/ul>\n\n\n\n<p>This<strong><a href=\"https:\/\/corpbiz.io\/central-fssai-license\" title=\"FSSAI Central License in India\"> FSSAI Central license registration<\/a><\/strong> is applicable on food business owners with an annual turnover of more than Rs. 20 crores per annum. The application for obtaining such FSSAI registration is to be filled by duly filling <strong>Form-B<\/strong>.<\/p>\n\n\n\n<ul>\n<li><strong>FSSAI\nState License<\/strong><\/li>\n<\/ul>\n\n\n\n<p>This <strong><a href=\"https:\/\/corpbiz.io\/fssai-state-license\" title=\"FSSAI State License Online\">FSSAI State license registration<\/a><\/strong> is applicable on food business owners with an annual turnover of less than 20 Lakh per annum but more than 12 Lakh per annum. The application for obtaining such FSSAI registration is to be filled by duly filling Form B.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_brief_on_FSSAI_Registration_for_Sweet_Manufacturers\"><\/span>A brief on FSSAI Registration for Sweet Manufacturers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Sweet manufacturers are expected to comply with\nFSSAI standards to avoid the deployment of substandard and adulterated food\nproducts in the market. Since food products can directly affect the health of a\nconsumer, food manufacturers are required to adhere with optimum standards of\nfood safety and quality. Sweet manufacturers are required to use high-quality\nproducts and ensure that the sweets made and sent into the market are pure and\nunadulterated. &nbsp;<\/p>\n\n\n\n<p>On 19 July 2021, FSSAI issued an order for the\nregistration and licensing of food business operators for Indian sweets, snacks,\nand savouries. This was done in order to make the licensing and registration\neasier for medium and small businesses manufacturing Indian sweets, savouries\nand snacks, which will facilitate obtaining state and central licenses by such\nmanufacturers. FSSAI assigned food category 18 of the Food Safety Compliance\nSystem or FoSCoS to general manufacturing kind of business. Prior to such an\norder, manufacturers of sweets had to adhere to heavy compliances to get their\nfood products registered under the Proprietary Food category and obtain a central\nlicense which often proved a costly affair to medium and small-scale sweet\nmanufacturers. Indian sweets which are regulated under this order are provided\nunder category 18 as follows:<\/p>\n\n\n\n<ul>\n<li>Sweets\nmade with milk or its derivatives like \u201c<em>chhana based sweets, khoa based\nsweets, fermented milk products base Indian sweets, other composite milk\nproducts based Indian sweets\u201d<\/em><\/li>\n\n\n\n<li>Sweets\nmade with cereals<\/li>\n\n\n\n<li>Sweets\nmade with pulses<\/li>\n\n\n\n<li>Sweets\nmade with starch<\/li>\n\n\n\n<li>Sweets\nmade with nuts and dry fruits<\/li>\n\n\n\n<li>Sweets\nmade with vegetables and fruits<\/li>\n\n\n\n<li>Indian\nconfectioneries <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Points_to_Note_While_Obtaining_FSSAI_Registration_for_Sweet_Manufacturers\"><\/span>Important Points to Note While Obtaining FSSAI\nRegistration for Sweet Manufacturers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Before obtaining FSSAI registration for sweet manufacturers,\nfood business operators must keep in mind that:<\/p>\n\n\n\n<ul>\n<li>Food\nbusiness operators manufacturing sweets which are already licensed under the\nProprietary Food category are not required to modify their licenses on the\nbasis of the new categories mentioned under Category 18 of FoSCoS. <\/li>\n\n\n\n<li>Food\nbusiness operators who are sweet manufacturers and whose products do not fall\nin Category 18 shall be registered under the Proprietary Food Category.<\/li>\n\n\n\n<li>Food\nbusiness operators who sell packaged sweet products are required to obtain the\nGeneral Manufacturing business license as per the eligibility criteria provided\nunder Category 18.<\/li>\n\n\n\n<li>Food\nbusiness operators like restaurants, caterers and similar businesses selling\nfresh but unpacked sweet products are required to obtain licenses under the extant\nfood categories.<\/li>\n\n\n\n<li>The\nmicrobiological requirements specified of the base products used in sweet\nmanufacture according to Appendix B of Food Safety &amp; Standards (Food\nProducts Standards &amp; Food Additives) Regulations, 2011, aflatoxin usage\nguidelines for base products used in sweet manufacture as per Food Safety and\nStandards (Contaminants, Toxins and Residues) Regulations, 2011 shall be\napplicable on the sweet products under Category 18.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_While_Obtaining_FSSAI_Registration_for_Sweet_Manufacturers\"><\/span>Documents Required While Obtaining FSSAI\nRegistration for Sweet Manufacturers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following documents are required while\nObtaining FSSAI Registration for Sweet Manufacturers:<\/p>\n\n\n\n<ul>\n<li>Certificate\nshowing registration of business like a certificate of incorporation or a\npartnership deed or a shops and establishment license or any other similar\nregistration certificates.<\/li>\n\n\n\n<li>Identity\nproof with photos of the food business operators; list of directors or partners\nwith address proof, photo ID and contact details<\/li>\n\n\n\n<li>Proof\nas to possession of the business premises like a sale deed or a lease\nagreement, utility bills, NOC from the landlord<\/li>\n\n\n\n<li>Information\npertaining to food business operators&#8217; official bank account<\/li>\n\n\n\n<li>Food\nsafety management system plan<\/li>\n\n\n\n<li>List\nof sweet products which are manufactured<\/li>\n\n\n\n<li>Other\nsupporting documents, like, inter alia, NOC from a panchayat or municipality,\nlicense copy from manufacturer.<\/li>\n\n\n\n<li>Documents\nshowing the manufacturing and processing unit&#8217;s plan with dimensions and areas\nallocated to different operations<\/li>\n\n\n\n<li>List\nof machinery and other equipment with number and capacity<\/li>\n\n\n\n<li>Authority\nletter from manufacturer nominating an authorized person <\/li>\n\n\n\n<li>Analysis\nreport as to the water being used in the process<\/li>\n\n\n\n<li>Certificate\ncopy obtained under the Coop Act or Multi-State Coop Act for Cooperatives<\/li>\n\n\n\n<li>Details\npertaining to the source of raw materials used. This is specific to the central\nlicense.<\/li>\n\n\n\n<li>Certificate\nfrom the Ministry of Tourism. This is specific to the central license.<\/li>\n\n\n\n<li>Supporting\ndocuments showing proof of transportation and turnover. This is specific to the\ncentral license.<\/li>\n\n\n\n<li>NOC\nissued by FSSAI. This is specific to the central license.<\/li>\n\n\n\n<li>Import\nand Export Code document. This is specific to the central license.<\/li>\n\n\n\n<li>Certificate\nby Ministry of Commerce for 1005 Export-Oriented Units<\/li>\n\n\n\n<li>FSSAI\ndeclaration form.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_Follow_While_Obtaining_FSSAI_Registration_for_Sweet_Manufacturers\"><\/span>Procedure to Follow While Obtaining FSSAI\nRegistration for Sweet Manufacturers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following\nis the procedure for obtaining FSSAI Registration for Sweet Manufacturers in\nIndia:<\/p>\n\n\n\n<ul>\n<li><strong>Filling\nout the Application Form<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Food business operators who are sweet\nmanufacturers looking to obtain FSSAI registration for sweet manufacturers can\napply for the license both online and offline. Sweet manufacturers can register\nonline on the Food Safety Compliance System portal and fill up either Form A\n(registration for petty manufacturers) or Form B (registration to obtain state\nor central license), as applicable. The offline forms are required to be\nsubmitted to the Food and Safety Department.<\/p>\n\n\n\n<ul>\n<li><strong>Submission\nof Necessary Documents<\/strong><\/li>\n<\/ul>\n\n\n\n<p>While submitting applications for FSSAI\nregistrations under Form A and Form B, the applicant must upload certain\nrequisite documents either on the Food Safety Compliance System portal or submit\nsuch documents physically to the Food and Safety Department.<\/p>\n\n\n\n<ul>\n<li><strong>Assessment\nand Inspection by the Food and Safety Department<\/strong><\/li>\n<\/ul>\n\n\n\n<p>The Food and Safety Department shall scrutinize\nthe application and the documents and conduct necessary investigations of the\nsweet manufacturing premises.<\/p>\n\n\n\n<ul>\n<li><strong>Grant\nof Certificate<\/strong><\/li>\n<\/ul>\n\n\n\n<p>If the Food and Safety Department is satisfied with\nthe application, documents submitted and inspection, it shall grant the\nrequisite FSSAI license to the sweet manufacturer. The registration certificate\nshall contain the fourteen-digit registration number. This registration number\nmust be affixed on the packaging of the sweet products and the registration\ncertificate must be displayed prominently on the place of business of the sweet\nmanufacturer.<\/p>\n\n\n\n<p>A sweet manufacturer that does not have an\nexisting license under the Proprietary Food Category, and wishing to modify any\nexisting license as per the requirement under food category 18 can do so on the\nFood Safety Compliance System portal. <\/p>\n\n\n\n<p>The status of the application for FSSAI\nregistration can be tracked on the Food Safety Compliance System portal by\nputting in the application number.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_of_FSSAI_Registration_for_Sweet_Manufacturers\"><\/span>Validity of FSSAI Registration for Sweet\nManufacturers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The license is granted by <strong>FSSAI<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/www.fssai.gov.in\/\"><strong>[1]<\/strong><\/a><\/sup> for a period of either one year\/five years. The\napplication to renew the license must be made before thirty days from the date\nof expiry of the existing license.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Sweet manufacturers, retailers, distributors, caterers and other similar persons or entities involved in the manufacture, sale, storage, or trade of sweet products in the Indian market must mandatorily obtain the requisite FSSAI registration for sweet manufacturers. <\/p>\n\n\n\n<p>After registration, the manufacturer must ensure compliance with the Food and Safety Standards Act, 2002 as non-compliance can lead to the incurrence of penalties up to Rupees Ten Lakh. <\/p>\n\n\n\n<p>Moreover, obtaining an FSSAI license has a plethora of benefits as well. FSSAI registration helps sweet manufacturers to build goodwill in their business, instil and expand customer trust and loyalty in the brand as FSSAI registration ensures high standards of food safety and quality. <\/p>\n\n\n\n<p>It also becomes easier to get investors to provide the necessary funding to the business with FSSAI registration.
