<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Presently, the following institutions are involved in the\nformulation and regulation of skincare products in India, be it a matter of\nproduction or importation. <\/p>\n\n\n\n<ul><li>Drugs Controller General (India)<\/li><li>Central Drugs Standard Control\nOrganization <\/li><li>Directorate General of Health\nServices<\/li><li>Ministry of Health and Family\nWelfare<\/li><\/ul>\n\n\n\n<p><strong><em>The cosmetic division of the Central Drugs Standard Control\nOrganization deals with the licensing of skincare products. <\/em><\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Overview_of_the_Types_of_Forms\"><\/span><strong>An Overview of the Types\nof Forms <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>The Cosmetic Rules, 2020 advises the filing of the given forms\ndepending on the purpose of business<\/em><\/strong>. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>Form Cos-1<\/em><\/strong><\/h3>\n\n\n\n<p>Application concerning the issuance of import certification to\nimport cosmetics into India. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>Form Cos-2<\/em><\/strong><\/h3>\n\n\n\n<p>Form Cos 2 refers to an import certification of cosmetic products. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>Form Cos-4<\/em><\/strong><\/h3>\n\n\n\n<p>Application concerning the grant of import registration for the\nimportation of registered skincare products<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>Form Cos-4A<\/em><\/strong><\/h3>\n\n\n\n<p>Import Registration number to be accorded for the importation of the\napproved cosmetics into India <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>Form Cos-12<\/em><\/strong><\/h3>\n\n\n\n<p>Application concerning the accord of approval relating to new\ncosmetics for securing import registration certification or production license <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legalities_around_the_Establishment_of_a_Skincare_Import_Business\"><\/span><strong>Legalities around the\nEstablishment of a Skincare Import Business <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Drugs and Cosmetics Act\nof 1948 governs the skincare import business and\nmanufacturing of cosmetics in India. But, in the year 2020, the GOI rolled out\nthe updated version of the legislation in the form of the Cosmetic Rules, 2020,\nwhich encloses the following conditions.<\/p>\n\n\n\n<ol><li>No cosmetic can find its way to the Indian market if it lacks\n     the approval of the Central Licensing Authority<\/li><li>Form COS-1 is a prescribed application form for the importation\n     of skincare products in India.&nbsp; <\/li><li>Agent appointment shall only come into effect after the\n     approval granted either by the first-class Magistrate in India or the\n     competent authority of the importing nation.<\/li><li>While filing Form COS-1, the applicant must attest documents as\n     per Part I of the Second Schedule. <\/li><li>The registration application as per sub-rule (2) must go with a\n     copy of the receipt of the fee. <\/li><li>The applicant can refer to the fourth schedule for knowing the\n     fee structure&nbsp; <\/li><li>There is also an arrangement for offline application in Form\n     COS-1. The eligibility criteria to apply via offline application are\n     similar to that of online application<\/li><li>The imported cosmetic may undergo inspection or testing\n     conducted by labs referred to in rule 11. The applicant would be\n     accountable for addressing all the expenses concerning such tests. <\/li><li>The applicant must bear the expenses mentioned in the third\n     schedule relating to the on-site inspection of the production unit of the\n     importing nation. The officials from the Central Licensing Authority will\n     take charge to inspect the facility. <\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documentations_for_the_Grant_of_a_Registration_Certificate\"><\/span><strong>Documentations for the\nGrant of a Registration Certificate<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are the documents required for\nthe grant of a Registration Certificate<\/p>\n\n\n\n<ul><li>Treasury Challan <\/li><li>Import Export Code accorded by\nDGFT<\/li><li>Power of Attorney <\/li><li>Copy of the label used on\nCosmetics<\/li><li>Free sale\nregistration\/Manufacturing license\/Marketing Authorization, if available <\/li><li>Product specs and testing\nprotocol. <\/li><li>List of countries where Market\nAuthorization was granted.<\/li><li>Soft copies of details\nconcerning brands, products, and manufacturer<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Provisions_around_the_Import_Registration_Certificate_for_Skincare_Import\"><\/span><strong>Provisions around the\nImport Registration Certificate for Skincare Import<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>The detailed vetting procedure will come into effect after the\n     submission of the application relating to the grant of import registration\n     certificate. <\/li><li>Central Licensing Authority vets the documents and application\n     for any error. In case of any loophole, the authority may revoke the\n     application and then accordingly inform the applicant via writ notice. The\n     notice shall enclose the reasons for cancellation. <\/li><li>The applicant can plead to the Central Government to reconsider\n     the rejected application within 45 days. The government will look into the\n     matter and accordingly pass the order within 90 days from the date on\n     which the appeal comes to light. <\/li><li>Form COS-3 mentioned in Chapter V serves as legal approval for\n     the new cosmetics awaiting their arrival in India. Without it,\n     registration for importing new cosmetics shall not come into effect. <\/li><li>An individual application via Form COS 2 shall be enough to\n     legalize one or more cosmetics produced by the same manufacturer. It\n     doesn\u2019t matter whether cosmetics are being manufactured at a single\n     premise or another facility as long as they belong to a single\n     manufacturer. In such a case, no separate filing of the application is\n     required.<\/li><li>Licensees looking for a duplicate certificate copy can apply\n     via the prescribed application that goes along with standard fees. <\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Labeling_Norms_to_Be_Followed_By_Skincare_Import_Business\"><\/span><strong>Labeling Norms to Be Followed\nBy Skincare Import Business <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The label affixed on the\nimported cosmetics shall reflect the <strong><em>brand registration number <\/em><\/strong>and the\ndetails of the registration holder.<\/li><\/ul>\n\n\n\n<ul><li>Affixing of labels enclosing\nbrand registration number may be allowed post import at an apt source approved\nby the authority concerned. Applicant must file a prescribed application with\nthe licensing authority for this purpose. <\/li><li>The label must enclose the\nmanufacturer\u2019s name and address and information about the nation where the\ncosmetics have been manufactured. <\/li><\/ul>\n\n\n\n<ul><li>If the production of cosmetics\ntook place in a third-party facility, the name, and address of the owner or the\ninfo about the nation, where it has been produced should be legible on the\nlabel. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Facts_to_Ponder_Relating_To_Skincare_Import_Business\"><\/span><strong>Key Facts to Ponder Relating\nTo Skincare Import Business<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>No other language except English\nis acceptable for filing an application to legalize the skincare import\nbusiness.<\/li><\/ul>\n\n\n\n<ul><li>The applicant must intimate the\nauthority about the nation (source of import) where no legislation exist for\nregulating the production of cosmetics. The applicant can furnish a declaration\non an affidavit to serve this purpose.<\/li><\/ul>\n\n\n\n<ul><li>Import certification is not\napplicable to cosmetic products that are imported for repackaging, export, or\nR&amp;D purposes.&nbsp; In such cases, CDSCO\ngrants specific approval against the prescribed application. Besides, the\nimporter must furnish an undertaking confirming that such products are not\nmeant for domestic sale.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong> <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Given the current growth rate and market conditions, the skincare import business seems to be a remarkably profitable venture.
