It is a marketing tool that helps increase\nthe business&#8217;s finances. Sometimes people get confused with the logo and brand\nname of the product. The brand name is usually the symbol or logo, the\nTrademark is the distinguishing sign, and it has broader implications than the\nbrand name. The Trademark law was later with the\nTrademark and Merchandise Act, 1958. The replaced law protects Trademark and\nprevents misuse or fraudulent use of marks on merchandise. The Act provides\nregistration of the Trademark so that the owner of the Trademark may get a\nlegal right for its exclusive use.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Brief_on_Trademark_for_Medical_Devices_in_India\"><\/span>A Brief on Trademark for\nMedical Devices in India&nbsp; <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In India, both statutory and common law\ngovern Trademark. The Trade and Merchandise Marks Act, 1940, was India&#8217;s first\nlegislation concerning trademarks, and then it was replaced by the Trade and\nMerchandise Marks Act, 1958 (TM Act, 1958).<\/p>\n\n\n\n<p>The TM Act got updated in 1999 to comply with TRIPS, and since then, it has been known as The <strong>Trade Marks Act 1999<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/1993\/1\/A1999-47.pdf\"><strong>[1]<\/strong><\/a><\/sup> (&#8220;TM Act 1999&#8221;). The TM Act 1999 allows for the registration of service marks and three-dimensional marks. <\/p>\n\n\n\n<p>In India, there is a proper classification of\ngoods and services. The classification is incorporated in the rule&#8217;s schedule\nunder the Trademark Act 1999. There are different classes under which medical\ndevices are covered. <\/p>\n\n\n\n<ol><li><strong>Class 10<\/strong> &#8211; covers Medical devices. <\/li><li><strong>Class 44<\/strong> &#8211; covers the services for Medical services, veterinary\nservices and cosmetics.<\/li><li><strong>Class 42<\/strong> &#8211; covers Scientific and technological services and\nresearch and design.<\/li><li><strong>Class 44<\/strong> &#8211; veterinary services; Medical services; beauty care and\nhygienic and for human beings or animals and also agriculture, forestry\nservices and horticulture&nbsp; <\/li><li><strong>Class 42<\/strong> &#8211; technological and scientific services and research and\ndesign relating to it; it also includes industrial analysis and research\nservices; design and development of computer hardware and software. <\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Trademark_Class_10_Surgical_and_Medical_Instruments\"><\/span>Trademark Class 10: Surgical\nand Medical Instruments<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Trademarks\nmust be applied under classes only, and each class represents a distinct class\nof goods or services. This blog comprehensively covers the goods under Class 10\nof trademark classification. There is a complete list of\nregistered Trademarks in the Trademark registry.&nbsp; <\/p>\n\n\n\n<p><strong>Step 2: Filing an Application<\/strong><\/p>\n\n\n\n<p>After completing a search, there comes the process of\napplying for registration. The application can be filed physically at the\njurisdiction&#8217;s TM registry office or online at IP India\u2019s official website in <strong>Form TM-A<\/strong>. The application must be\nfiled for registration of a single ark only in a single class of goods and\nservices or in a multi-class, and the fees will be calculated for each class\nincluded in the application. The application must be backed up with the\nrequired documents and complete details of the Trademark.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p><strong>Step 3: Examination Process<\/strong><\/p>\n\n\n\n<p>After the filing of the application, it is adequately\nexamined by the registrar. Then they prepare an examination report in writing\nand send a copy of it to the applicant within 30 days to inform the client\nwhether the registry accepts the application or refuses it, or accepts it conditionally.\nThe applicant must file a reply within 30 days of receiving the examination\nreport from the registry. In the reply, the applicant is expected to put\nforward all the defences along with the evidence regarding the objection that\nis being raised by the trademark department. The applicant must also state the\nreason why his \/her application must not be rejected. <\/p>\n\n\n\n<p><strong>Step 4: Post-Examination Procedures<\/strong><\/p>\n\n\n\n<p>Once the reply is filed by the applicant, the examinee,\nif wants, can arrange a hearing for the reason if he\/ she is not satisfied with\nthe reason being stated by the applicant for the objection that is being raised.\nAfter the hearing process, if the examiner is fully satisfied, they can accept\nthe mark and forward it for publication in the Trademark Journal or can refuse\nthe application if any objection is still there.<\/p>\n\n\n\n<p><strong>Step 5: Publication of the Trademark\nApplication<\/strong><\/p>\n\n\n\n<p>Once the examiner accepts the application, it will get\npublished in the Trademark Journal, which remains there for four months. The\nidea of the advertisement is to make it available for the third party to see\nand raise objections, if any. Every Monday, the journal gets updated with a\nnewly accepted Trademark.&nbsp; <\/p>\n\n\n\n<p><strong>Step 6: Notice of Opposition<\/strong><\/p>\n\n\n\n<p>Within the time period of 4 months from the publication\ndate of the application, any party who is aggrieved can file a notice of\nopposition in Form TM-O. If a third party feels that their already in existence\ntrademark is being used and infringed or the application has been made in bad\nfaith, it will spoil the image of the applicant if it gets registered. Then\nthere will be a notice to halt the registration process as per the Trademark\nAct, 1999, and applicant wish to continue with the same Trademark, then he \/she\nhas to go through a certain legal process. <\/p>\n\n\n\n<p><strong>Step 7: Registration<\/strong><\/p>\n\n\n\n<p>The last step in the process of registration is to get the\ncertificate of the same. If the mark passes all the legal processes, the\napplicant will receive the certificate of Trademark for Medical Devices.<\/p>\n\n\n\n<p>If no opposition is found or in case there is false opposition,\nthen after four months of the Publication period, within 7 days, an\nauto-generated Registration certificate will be issued to the applicant by the\ntrademark registry office. The Timeline of registration is 10 years in order to\nkeep the Trademark alive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Identifying the Trademark Class is vital before filing the application for the Registration of a Trademark for Medical Devices in India.
