It also covers manufacturing entities      (non-power driven) having 20 or more workers on board. <\/li>\n\n\n\n<li>Every factory owner is liable to register under this legislation      by securing the <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/factory-license\">Factory license<\/a><\/strong> granted by the State Labour      Department. <\/li>\n\n\n\n<li>Factories Act 1948 is a labour-supportive legislation that      regulates various aspects such as workplace hygiene, safety, etc, for the      well-being of labourers. <\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Norms_for_Workers_Well-being_and_Betterment_under_Factories_Act_1948\"><\/span>Norms for Workers\u2019 Well-being and Betterment under Factories Act 1948<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are the key provisions of the Factories Act 1948 that\nendorse worker welfare within the workplace: <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>1.&nbsp;&nbsp; <\/em><\/strong><em>Working Hours<\/em><\/h3>\n\n\n\n<p>48 hours\/per week is the permissible shift time for adults working\nin the factories. Workers are qualified to avail of weekly off on Sunday. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>2.&nbsp;&nbsp; <\/em><\/strong><em>Health<\/em><\/h3>\n\n\n\n<p>Factory owners should consider workers\u2019 well-being as of paramount\nimportance. They are liable to ensure the utmost cleanliness at the workplace.\nThe workplace should have a capable drainage system, proper lighting, and\nventilation.&nbsp; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>3.&nbsp;&nbsp; <\/em><\/strong><em>Safety<\/em><\/h3>\n\n\n\n<p>Workers\u2019 safety is another prime concern requiring undue attention\nfrom the factory owners. The person in charge should cover the machinery\n(accidental-prone) with apt fencing. Also, they must prevent inexperienced or underage\nindividuals from operating such machines. The committee shall underpin measures for the safe\nhandling of hazardous processes and substances and review the same at a set\ninterval. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>3.&nbsp;&nbsp; <\/em><\/strong><em>Intimating workers about imminent dangers (Section 41-H) <\/em><\/h3>\n\n\n\n<p>Every occupier is liable to mitigate imminent dangers (posing a risk\nto workers) as soon as possible via prompt remedial measures. After\nextinguishing the risk, the occupier must intimate the inspection about the\naction being taken for risk mitigation.&nbsp; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>4.&nbsp;&nbsp; <\/em><\/strong><em>Setting up restrooms and canteens for workers (Sections 42 to 49)<\/em><\/h3>\n\n\n\n<p>Every occupier must ensure that their production unit comprises\namenities like a canteen, lunch room, creche, washing units, and so on for all\nworkers and a welfare officer. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>5.&nbsp;&nbsp; <\/em><\/strong><em>Arrangement of Annual leave with wage (Section 79)<\/em><\/h3>\n\n\n\n<p>The occupier of the factory, in agreement with the committee,\nunderpinned u\/s 3 of the Industrial Disputes Act, 1947 (14 of 1947) or any\nother legislation or in agreement with the workers\u2019 representative, if\nany,&nbsp; may release a scheme, enclosing the\nChief inspector\u2019s approval, reflecting the grant of leave permitted under this\nsection may be regulated.&nbsp; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>6.&nbsp;&nbsp; <\/em><\/strong><em>Conducting a survey about safety and occupational health (Section 91-A)<\/em><\/h3>\n\n\n\n<p>The occupier of the factory or person in charge must perform a\nsurvey concerning safety and occupational health. The survey may include\nrisk-prone premises within the facilities or sample\/data collection from\ndifferent departments. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Duties_assigned_to_Operation_Manager_under_the_Factories_Act_1948\"><\/span>Duties assigned to Operation Manager under the Factories Act 1948<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are the roles and responsibilities assigned to the manager\nunder Factories Act 1948: <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>1.&nbsp;<\/em><\/strong><em>Informing workers about imminent danger (Section 41-H)<\/em><\/h3>\n\n\n\n<p>The manager or person in charge should extinguish imminent dangers\nwithin the workplace via quick remedial measures. The intimation for the same\nmust be shared with the concerned inspection via a detailed report. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>&nbsp;2. Displaying the notice regarding work for adults (Section 61)<\/em><\/h3>\n\n\n\n<p>Section 61 talks about the intimation of information to be provided\nby the manager regarding the working period of the adult via a display medium.\nApart from that, such notice shall reflect the following information\nexplicitly: <\/p>\n\n\n\n<ul>\n<li>Daily working timeline <\/li>\n\n\n\n<li>Work timing for each relay of\nthe group<\/li>\n\n\n\n<li>Group classification based on\nthe nature of the work <\/li>\n\n\n\n<li>Number of workers serving each\ngroup<\/li>\n\n\n\n<li>Rotational shift timing for\neach group, if any. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><em>3. Register of adult workers (Section 62)<\/em><\/h3>\n\n\n\n<p>The factory manager should mandatorily upkeep a register relating to\nthe adult workers. Such a document shall remain accessible to the inspecting\nofficial during working hours.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>4. Annual leave with wage (Section 79)<\/em><\/h3>\n\n\n\n<p>The manager of the factory, in agreement with the committee,\nunderpinned u\/s 3 of the Industrial Disputes Act, 1947 (14 of 1947) or any\nother legislation or in agreement with the workers\u2019 representative, if\nany,&nbsp; may release a scheme, enclosing the\nChief inspector\u2019s approval, reflecting the grant of leave permitted under this\nsection may be regulated.&nbsp; <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>5. Notice of certain diseases (Section 89)<\/em><\/h3>\n\n\n\n<p>Whenever any worker gets infected by a notified disease, the manager\nof the factory must share this subject matter with the concerned authority via\na prescribed form within a deadline as mentioned under the legislation. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>6. Safety and occupational health survey (Section 91-A)<\/em><\/h3>\n\n\n\n<p>The manager of the factory (serving as a person in charge) must\nconduct a survey relating to safety and occupational health. Such a survey may\ninclude data\/sample gathering to drive meaningful insights. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Penalties_for_non-compliance_under_the_Factories_Act_1948\"><\/span>Penalties for non-compliance under the Factories Act 1948<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Given are the penalties to be imposed on defaulters for the\nfollowing non-compliances: <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Section 92: General penalty for non-compliance <\/em><\/h3>\n\n\n\n<p>Section 92 talks about non-compliance with the underlying norms and\ntheir consequences. The said section holds a manager or person in charge\naccountable for any non-conformity. Any non-compliance could incur the\nfollowing penalties for the occupier or manager; <\/p>\n\n\n\n<ul>\n<li>Jail term of up to two years\nand monetary penalties amounting to Rs 2 lacs. <\/li>\n\n\n\n<li>In case of continual\ncontravention of the law, a penalty amounting to Rs 10 lacs\/day shall come into\neffect. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Section 94: Extended penalty post a preceding conviction<\/em><\/h3>\n\n\n\n<p>If any person breaches any norms and continues to adhere to\nnon-compliance, such an individual may face a jail term of up to 3 years and a\nmonetary penalty amounting to Rs 10,000, which can go up to Rs 2 lakhs. In some\ncases, both penalties can come into effect.<\/p>\n\n\n\n<p>To determine this section&#8217;s applicability, the manager should only\nconsider the offences within the preceding two years of the newly-committed\noffence. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Section 95: Penalty for obstructing an inspector<\/em><\/h3>\n\n\n\n<p>If anyone attempts to hinder the rights of inspection accorded by\nthe Act or fails to cooperate, as and when required, such an individual shall\nface jail terms of up to 6 months or a fine amounting to Rs 10000 or both. The\nsame penalties would apply in cases where workers are being deterred by the\nmanager from appearing before an inspector. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Section 96: Wrongful disclosure of the analysis report u\/s 91 <\/em><\/h3>\n\n\n\n<p>Section 96\nunderpins the penalty of Rs 10000 and imprisonment of six months for defaulters\nwho are found guilty of disclosing analysis reports (enclosing the testing\noutcome of selected samples) to non-authorized persons. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Section 97: Penalties for workers flagged as defaulters <\/em><\/h3>\n\n\n\n<p>Section 97 casts a fine of Rs 500 for workers being flagged as\ndefaulters for creating nuisances for co-workers and breaching certain laws. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Section 98: False Certificate of Fitness<\/em><\/h3>\n\n\n\n<p>A fitness Certificate refers to a legal document that affirms the\nlevel of fitness of a worker for a particular job. If anyone found guilty of\nfalsifying such documents shall incur the following penalties:<\/p>\n\n\n\n<ul>\n<li>Imprisonment of 2 months or; <\/li>\n\n\n\n<li>A fine of at least Rs. 10,000\nor; <\/li>\n\n\n\n<li>Both <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Section 99: Dual employment of child <\/em><\/h3>\n\n\n\n<p>Section 99 ensures legal fencing for an offence like the dual\nemployment of a child. It prohibits such acts and hence imposes a penalty of Rs\n1000 for the caretaker of the child in question. The same penalty shall come\ninto effect for those leveraging child\u2019s wages for benefits.&nbsp; <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Casting_light_on_the_Factories_Amendment_Bill_2016\"><\/span>Casting light on the Factories (Amendment) Bill, 2016<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Factories (Amendment) Bill, 2016, came into effect on August 10,\n2016. The Minister for Labour and Employment, Mr. Bandaru Dattatreya introduced\nthe said legislation to the higher house of the parliament. The Bill brought\nmany amendments, as shown below: <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>&nbsp;Section 64: Extension of Overtime hours of work in a quarter<\/em><\/h3>\n\n\n\n<p>The Act empowers the state government to devise rules concerning\nregulations of overtime of work. But, the total hours must not surpass 50 hours\nfor a quarter. The bill extended this timeline to 100 hours. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>Section 65: Overtime hours if the production unit witnesses increased workload <\/em><\/h3>\n\n\n\n<p>The Act empowers the state government to accord permits to adult workers to work extended hours if case the factory witnesses an increased workload.
