Other factors that have contributed to the\nenactment of this legislation include changing lifestyle of people, the\never-increasing dominance of packaged foods, the influx of new technologies,\nand the escalation in adulteration practices. FSS Act 2006 was introduced as a\ncomprehensive legal fencing for food producers who rarely follow any quality\nstandards. Here\u2019s what FSS Act 2006 states: <\/p>\n\n\n\n<p><strong><em>An\nAct to comprise the laws concerning food articles and to set up the Food Safety\nand Standards Authority of India to enact science-based norms for food items,\nand to govern their production process, storage, distribution, and import to\nensure the availability of safe food articles for human consumption and matters\nconcerning the same. <\/em><\/strong><\/p>\n\n\n\n<p>FSS Act ensures comprehensive legal fencing for food\nproduction by enacting science-based norms via an apex regulator- FSSAI. The\narrival of the FSS act supersedes the following legislations that don\u2019t exist\nanymore.<\/p>\n\n\n\n<ul><li><strong><em>Vegetable Oil Products (Control) Order, 1947<\/em><\/strong><\/li><li><strong><em>Fruit Products Order, 1955<\/em><\/strong><\/li><li><strong><em>Prevention of Food Adulteration Act, 1954<\/em><\/strong><\/li><li><strong><em>Meat Food Products Order, 1973<\/em><\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Functions_of_FSSAI_under_the_FSS_Act_2006\"><\/span><strong>Functions\nof FSSAI under the FSS Act 2006 <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/fssai-license\">FSSAI<\/a><\/strong>&#8211; Food Safety\nStandards Authority of India came into effect by virtue of powers conferred\nunder the FSS Act 2006. As an apex regulator, FSSAI performs the following\nundertakings: <\/p>\n\n\n\n<ul><li>Drafting norms to ensure\nstandardization of different food articles meant for mass consumption. <\/li><li>Underpinning guidelines for\ncertification agencies that authenticate the food safety management systems\n(FSMS) for FBOs. <\/li><li>Formulating processes and norms\nfor the authorization of the food-testing labs. <\/li><li>To assist Central and State\nGovernments in devising viable policies concerning food safety and nutrition.<\/li><li>Collect insight and data\nconcerning food consumption, biological risk, malpractices, emerging threats,\nand launch of the rapid notification system<\/li><li>Setting up a robust data network\nnationwide so that end-users receive fast and accurate information concerning\nfood safety and issues connected thereof. <\/li><li>Training programs are\nfacilitated to individuals intending to commence a food business. <\/li><li>Aligning with global standards\nfor food safety and quality and devising improved norms. <\/li><li>Advocating food safety and food\nstandards nationwide through different communication mediums. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Licensing_of_Food_Business_Operators_under_the_FSS_Act_2006\"><\/span><strong>Licensing of Food Business\nOperators under the FSS Act 2006 <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>FSS Act 2006 mandates FSSAI to monitor and handle the licensing\nrequirements of FBOs across India. The apex regulator is entrusted with the\nresponsibility of granting Food registration\/license based on the following;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>FSSAI Registration<\/em><\/strong><\/h3>\n\n\n\n<p>It is a basic registration covering small businesses, including\npetty food vendors. It is mandatory for businesses with a yearly income of less\nthan Rs 12 lacs. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>FSSAI State License<\/em><\/strong><\/h3>\n\n\n\n<p>FSSAI State license is compulsory for FBOs with a yearly turnover\nranging from Rs 12lacs-20crores. This license primarily covers moderate-sized\nfood businesses.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>FSSAI Central License<\/em><\/strong><\/h3>\n\n\n\n<p>FSSAI central license covers FBOs having a sizable business\nfootprint or production. It is a mandate for businesses with annual turnover\nworth more than Rs 20 crores. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Norms_listed_under_the_FSS_Act_2006\"><\/span><strong>Key Norms listed under the\nFSS Act 2006 <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>FSS Act 2006 has penned down a long list of compliances for food\nbusiness operators nationwide. Here are some frontline provisions that must be\nfollowed by FBOs without fail. <\/p>\n\n\n\n<ul><li>Grant of the food license is\nnot possible if the applicant is found guilty of breaching hygiene norms.<\/li><\/ul>\n\n\n\n<ul><li>The license holders of the food\nproduction units need to maintain proper ventilation and cleanliness in the\nfood storage area to avert bacterial confrontation. <\/li><\/ul>\n\n\n\n<ul><li>Periodic fumigation of the\nworkplace and storage is mandatory, particularly for those dealing with\nperishable food items. <\/li><\/ul>\n\n\n\n<ul><li>Apt labelling of food items is\ncompulsory. Every food package must reflect the manufacturer&#8217;s name, license\nnumber, batch number, shelf life, and so on. Improper or non-labelling can\nincur severe penalties, including the seizure of finished products. <\/li><\/ul>\n\n\n\n<ul><li>The nutraceutical products must\nreflect the list of ingredients in correspondence to the exact measures as\nprescribed. <\/li><\/ul>\n\n\n\n<ul><li>FSSAI registration\/license is\ngranted for the validity tenure, ranging from 1-5 years. The license fee shall\nvary as per the validity tenure chosen by the applicant. The higher the\nvalidity, the higher the licensing fee. <\/li><\/ul>\n\n\n\n<ul><li>Some of the key documents\nserving as an annexure to the FSSAI license application include the FSMS plan,\nWater testing report, Form IX, a list of equipment and test apparatus, the\napplicant\u2019s identity proof, and so on.<\/li><\/ul>\n\n\n\n<ul><li>There is a limit on how much\namount of preservative FBOs can use to elevate the taste of the given food\narticle. The preservation amount should not exceed what is advisable under the\nAct. <\/li><\/ul>\n\n\n\n<ul><li>Adulteration of the food\nproduct is an offence and hence apt penalties would be levied by the authority\non the defaulter. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong> <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>FSS Act 2006<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/fssai.gov.in\/cms\/food-safety-and-standards-act-2006.php\"><strong>[1]<\/strong><\/a><\/sup> is all about underpinning comprehensive norms for the protection of customers\u2019 health interests.
