So, on November 01, 2022, <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/fssai-license\">FSSAI<\/a>\n<\/strong>\nissued a notification regarding fee refund policy for applications under FSS\n(Approval for Non-specified Food &amp; Food Ingredients) Regulations, 2017. The\napplicants seeking approval of non-specified food &amp; food ingredients must\nsubmit an application in Form-1 of these regulations along with crucial\ndocuments and a fee of <strong><em>Rs. 50,000\/- plus 18% GST<\/em><\/strong>.<\/p>\n\n\n\n<p>Further,\nthe Food Safety &amp; Standards Authority of India issued a notice on August 31\n2022, stating that applications &amp; requisite fees under NSF Regulations\nshall be submitted via <strong><em>ePAAS (electronic Product &amp; Claim\nApproval Application System) <\/em><\/strong>only and applications submitted through\nemail or post shall be instantly rejected with effect from October 01, 2022.\nThe Authority decided that since it takes a lot of time &amp; effort for the scrutiny\nofficers to perform initial scrutiny of applications, the fee, once paid under\nNSF Regulations, shall not be refunded to the applicant in any instance.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Overview_of_FSS_Approval_for_Non-specified_Food_Food_Ingredients_Regulations_2017\"><\/span>An Overview of\nFSS (Approval for Non-specified Food &amp; Food\nIngredients) Regulations, 2017<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>On\nSeptember 11 2017, the FSSAI notified the FSS (Approval for Non-specified Food &amp; Food Ingredients)\nRegulations, 2017. These regulations have been finalised after consideration of\nthe comments getting from stakeholders. After the order of the Hon&#8217;ble Supreme Court\n(SC) dated August 19 2015, it became important for the FSSAI to discontinue the\nexisting advisory-based Product Approval System. This regulation lays down the\nrules &amp; procedure for the grant of prior approval of non-specified food\n&amp; food ingredients which will replace the earlier Product Approval\nIngredients, which was prevalent for food items &amp; items containing\ningredients for which there were no standards.<\/p>\n\n\n\n<p><strong><em>Some vital steps that the FSSAI took to address\nthe situation or condition in the absence of a Product Approval System (PAS)\nare as follows:<\/em><\/strong><\/p>\n\n\n\n<ul><li>Notified the FSS (Food or Health\nSupplements, Nutraceuticals, Foods for Medical purposes, Foods for special\ndietary uses, Functional Foods &amp; Novel Foods) Regulations, 2016.<\/li><li>Revised the definition of\nProprietary Foods in FSS (Food Product Standards &amp; Food Additives) 9<sup>th<\/sup>\nAmendment Regulations, 2016.<\/li><li>Amended the FSS (Food Product\nStandards &amp; Food Additives) 7<sup>th<\/sup> Amendment Regulations, 2016,\nconcerning the harmonisation of food additives.<\/li><\/ul>\n\n\n\n<p>All\nthe above-mentioned regulations have covered a number of products or items that\nwould have otherwise required specific approvals. However, there are still many\nproducts\/ingredients that haven&#8217;t been covered under these regulations. To\nregulate such products comprising novel foods &amp; to provide an opportunity\nfor Food Business Operators to innovate food items, the FSSAI has made the <strong><em>FSS\n(Approval for Non-Specified Food &amp; Food Ingredients) Regulations, 2017<\/em><\/strong>.\nThis regulation covers the following food\/food ingredients:<\/p>\n\n\n\n<ol><li>New additives;<\/li><li>Novel food or novel food\ningredients\/processed with the use of novel technology;<\/li><li>New processing aid including\nenzymes;<\/li><li>Articles of food &amp; food\ningredients consisting of\/isolated from bacteria, yeast, microorganisms, fungi,\nor algae.<\/li><\/ol>\n\n\n\n<p>In\nthe regulation, the FSSAI has defined non-specified food as any food other than\nproprietary food\/food ingredients, including additives, processing aids &amp;\nenzymes for which standards haven\u2019t been specified in any regulation made under\nthe Act.<\/p>\n\n\n\n<p>Food\nBusiness Operators will need to take prior approval for storage, sale,\nmanufacture, import, distribution, etc., of any non-specified food or food\ningredient as per the guidelines in the FSS (Approval for Non-Specified Food\n&amp; Food Ingredients) Regulations, 2017. These regulations are in addition to\n&amp; not in derogation of any other Rules &amp; Regulations made under the\nAct.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Grant_of_Prior_Approval\"><\/span>Procedure for\nGrant of Prior Approval<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following\nis the step-by-step procedure for grant of Prior Approval:<\/p>\n\n\n\n<ol><li>The manufacturer\/importer of\nnon-specified food has to 1<sup>st<\/sup> submit the application form (Form-1);<\/li><li>Along with the application form,\nall vital documents &amp; fees have to be submitted to the FSSAI;<\/li><li>After examination of the\napplication form and other documents, it is possible that the concerned\nAuthority could ask for additional documents, data\/clarifications if required;<\/li><li>The Food Authority may grant\napproval\/reject the application on Form-II &amp; which will be based on the\nSafety Assessment of the food product;<\/li><li>If approval or consent is\ngranted, the next step for the Food Business Operator is to submit to the Food\nAuthority a Certificate of Analysis concerning physical, chemical, nutritional,\nand microbiological parameters of the food manufactured or imported;<\/li><li>After a grant of approval, Food\nBusiness must apply for a License in accordance with the process specified in\nthe FSS (Licensing &amp; Registration of Food Businesses) Regulations, 2011.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>FSSAI notified the Food Safety &amp; Standards (Approval for Non-specified Food &amp; Food Ingredients) Regulations, 2017 (hereafter referred to as <strong><em>NSF Regulations<\/em><\/strong>) on September 15, 2017, for approval of <strong>non-specified food<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/fssai.gov.in\/cms\/non-specified-food.php\"><strong>[1]<\/strong><\/a><\/sup> &amp; food ingredients comprising novel food.
