The Act applies to the entire state of Karnataka\nand to all units in Karnataka, with the exception of the Central Government. The contractor is also responsible for\nensuring the disbursement of wages in the presence of the primary employer\u2019s\nrepresentative for the same.<\/li><li>Contractors\nare responsible for ensuring sufficient access to certain provisions provided\nfor the contract labour under the Act. For example, restrooms, lavatories, urinals,\netc.<\/li><li>A\ncontractor must provide an easily accessible and sufficiently equipped\nfirst-aid kit at all times during working hours, at every location where\ncontract labour is employed by them.&nbsp;<\/li><li>Every\ncontractor who falls under the purview of this Act must maintain sufficient\nrecords of all contract labour employed by the, the nature of the work that is\nperformed by the contract labour, rates of wages paid as well as any other such\nrelevant details.<\/li><li>Every\ncontractor must sufficiently have on display notices containing the details of\nwork such as hours of work, nature of work and other such relevant details in\nevery establishment in which contract labour under their employ is working.<\/li><li>While\nthe primary employer is liable to ensure full payment of wages in case a\ncontractor fails to fulfil the same, the primary employer can recover this\namount through either a deduction from a contract with the contractor or\nthrough debt.<\/li><li>Contravention\nof any of the provisions under the Act or of any conditions of the License\ngranted under the same can be punishable with imprisonment for a period of up\nto three months, or with a fine of up to a thousand rupees or both.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Criteria_for_Obtaining_a_CLRA_License_in_Karnataka\"><\/span><strong>Criteria for Obtaining a CLRA License in Karnataka<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any and all contractors who employ or\nhave employed, at any one time, twenty or more contract labourers for work in\nthe state of Karnataka must register to obtain a CLRA License. No contractor\nwho falls under this criteria can take up or execute any work through contract\nlabour without the issuance of and in accordance with a CLRA License. Such a license\nmay contain certain conditions pertaining to factors such as fixation of wages,\nhours of work and other essential amenities.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"List_of_Documents_Required_for_CLRA_License_in_Karnataka\"><\/span><strong>List of Documents&nbsp;Required for CLRA License in Karnataka<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following crucial documents are\nrequired to be submitted with the application to obtain a CLRA License in\nKarnataka-&nbsp;<\/p>\n\n\n\n<p>Authentic identity card (ID) of the\nApplicant like EPIC, Driving License,<\/p>\n\n\n\n<ul><li>PAN card, Aadhar Card, Ration Card, Passport, Bank &amp; Post\n     Office Pass Books, Railway ID Card, Disabled-ID Card.<\/li><li>Certified copy of the Agreement \/Contract between the Principal\n     Employer and the Contractor, if any. <\/li><li>Copy of the Registration or Challan of ESI or PF or ST or\n     Registration Certificate either under Factories Act\/Shop Act, VAT, TIN.<\/li><li>List with full address &amp; identity card of Partners or Directors\n     or Owners or Occupiers or Proprietors of the Organisation.<\/li><li>Applicants or Authorised Signatories full name, address,\n     designation with Seal.<\/li><li>Authorisation \/Power of Attorney Letter ( if applicable)<\/li><li>Declaration regarding non-employment of child labour<\/li><li>Copy of Memorandum of Association (MOA) or ROC in case of<\/li><li>Private \/ Public Companies.<\/li><li>Duly filled in &amp; signed Form V (preferably\n     on the letter-head of the Principal Employer).<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Online_Process_of_Securing_CLRA_License_in_Karnataka\"><\/span><strong>Online Process of Securing CLRA License in Karnataka<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The procedure below is the online process for securing CLRA\nLicense in Karnataka:<\/p>\n\n\n\n<ul><li>First, the applicant must visit the\nstate\u2019s labour department portal &amp; sign up.<\/li><li>Head to the service list &amp; select\nthe apt option concerning contractor labour license<\/li><li>The Portal will open an <strong>e-form<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/labouronline.kar.nic.in\/InterStateMigrantWorkmen\/InterstateMigrant_Licence.aspx\"><strong>[1]<\/strong><\/a><\/sup> (application). <\/li><li>Fill up the e-form and upload the\nmandatory documents in the format mentioned on the application.<\/li><li>Once done, navigate the payment\nwindow for the submission of application fee by simply clicking the &#8220;Pay\nOnline&#8221; option.<\/li><li>Upon successful payment, submit the application\nform online.<\/li><li>Post submission, the e-form &amp;\nvital documents will undergo inspection. Any errors or mistakes noted during\nvetting will be shared with the applicant via the registered email id and\nmobile number.
