Thus, a music license is secured when you are streaming or performing the\nmusic for commercial purposes in public\u201d. <\/em><\/p>\n\n\n\n<p><em>Note: Music performance\nlicense for live performance aims at protecting the rights of the original song\ncreator or composers. <\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Different_Types_of_Music_Licenses\"><\/span>Different Types of\nMusic Licenses <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Indian Performing Rights Society (IPRS) grants the music\nlicense under six different heads, as shown below:<\/p>\n\n\n\n<ul><li>Annual background license:  It is mandatory for&nbsp;eateries, hotels, public entertainment venues, resorts, marriage homes, auditoriums, and so on seeking to organize a live performance.  <\/li><li>Radio Broadcast License: For streaming copyrighted music on air, i.e. Radio and Television<\/li><li>Event License: An event license is mandatory for streaming soundtracks at an event like award ceremonies, fashion shows, product launches, corporate events, and so on. <\/li><li>Music licenses for soundtracks used as the right tone by cellular companies. <\/li><li>Music license for using copyrighted soundtrack in promotional videos or ads. <\/li><li>Music license for playing or OTT, i.e. &#8220;Over The Top&#8221; platforms such as karaoke service on the web, music utilized for sound recording on a digital medium, interactive and non-interactive music streaming on the web, etc. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Which_authority_has_the_right_to_accord_the_Music_License\"><\/span>Which authority has the\nright to accord the Music License? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Copyright<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/copyright.gov.in\/\"><strong>[1]<\/strong><\/a><\/sup> Society is\nentrusted with a responsibility to accord the music license. The institution\ngrants this legal permit under Section 33 of the Copyright Act. Copyright\nSociety protects the composer&#8217;s right by curbing activities that lead to the\nexploitation of their creation (musical work). In case of copyright breach, the\nsociety compels the defaulter to pay the royalties as a penalty for misusing\nthe registered work. <\/p>\n\n\n\n<p><strong><em>Following are the institutions serving the role\nof the Copyright Society in the status quo: <\/em><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>1.\u00a0\u00a0 Phonographic Performance Limited (PPL)<\/em><\/h3>\n\n\n\n<p>Phonographic Performance Limited grants a music license for\nthe pre-recorded soundtrack in the form of music cassettes, Compact Discs,\nRadio, Gramophone records and so on, which is streamed at the eating house. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>2.\u00a0\u00a0 Indian Performing Rights Society <\/em><\/h3>\n\n\n\n<p>The legal permits granted by the Indian Performing Rights\nSociety (IPRS) are mandatory for a live performance organized at a restaurant,\nconcert, or store. In short, the society grants the music performance license\nfor live performances only. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>3.\u00a0\u00a0 Indian Singer Rights Association<\/em><\/h3>\n\n\n\n<p>Indian Singer Rights Association (ISRA) serves a different\nrole altogether. Use it to complete the verification\nformalities.&nbsp;<\/li><li>After completing the\nregistration detail, head to the payment gateway for fee submission. The online\nreceipt for the same will be shared by the authority via email or SMS.<\/li><li>Finally, a music license for\nlive performance shall be granted by the authority in the prescribed format. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fees_charged_by_the_Societies_for_granting_the_music_license\"><\/span>Fees charged by the Societies for granting the music\nlicense<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Music License pens down the norms around use, license\nvalidity, and royalty to be rendered to the creator\/composer. Fees collected\nagainst the grant of a music license are aptly dispended among the creators or\nthe copyright owners. <\/p>\n\n\n\n<p><strong><em>The Copyright society takes the following\nfactors into account for estimating the license fee: <\/em><\/strong><\/p>\n\n\n\n<ul><li>The type of place where the license-seeker\nwants to stream the music.&nbsp; <\/li><li>The timeframe for streaming the music within\nthe proposed venue <\/li><li>The number of soundtracks streamed at the\npremises<\/li><li>The occupancy limit of premises where the\nlicense-seeker wishes to stream the music<\/li><li>The type of business license-seeker engaged in.\n<\/li><\/ul>\n\n\n\n<p>However, where a music performance license for a live\nperformance at the restaurant is secured from IPRS, the annual license fee has\nbeen capped at Rs 10,000 for metro cities and Rs 5000 for non-metra regions. <\/p>\n\n\n\n<p>Various tariff schemes are accessible based on the type of\nevents organized at the commercial premises; the minimum royalty fee for\nstreaming music among audiences at stores is Rs 2500\/5000 sq. ft. Meanwhile,\nfor the music license secured from ISRA, the license fees or royalty would be\ncomputed at the cost of the least-priced alcoholic beverage on the menu card.\nHowever, the minimum annual fee has been capped at Rs 3,650. <\/p>\n\n\n\n<p>Those who fail to furnish the license fees will be\nsubjected to an interest of 18 percent per annum with a monetary penalty\namounting to Rs 2 lakhs.
