annual leave &amp; enact a special provision in respect of\nwomen, children &amp; young persons who works in the factories.<\/p>\n\n\n\n<p>The\nFactories Act is applicable to any factory where 10\/more workers are\nworking\/were working on any day of the preceding 12 months &amp; in any part of\nwhich a manufacturing process is being carried on with the help of power or is\nordinarily so carried on, or whereon 20 or more workers are working or working\non any day of the preceding 12 months and in any part of which the process of\nmanufacturing is being carried out without the aid of power, but this doesn\u2019t\ninclude a mine or a mobile unit belonging to the armed forces of the Union, a\nhotel or restaurant or any eating place.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Safety_Welfare_Measures_under_the_Factories_Act_1948\"><\/span>Safety &amp;\nWelfare Measures under the Factories Act, 1948<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowing safety &amp; Welfare Measures under the <strong>Factories Act, 1948<\/strong><sup><a class=\"text-primary\" href=\"https:\/\/labour.gov.in\/sites\/default\/files\/Factories_Act_1948.pdf\"><strong>[1]<\/strong><\/a><\/sup> will be observed only when the owner of the Factory\nobtains a Factory License:<\/p>\n\n\n\n<ul>\n<li><strong>Safety\nMeasures Under the Act:<\/strong><\/li>\n\n\n\n<li>Prohibition of women &amp; young\npeople near hazardous machinery;<\/li>\n\n\n\n<li>Protection of ears, eyes or any\nother sensitive body parts during working hours;<\/li>\n\n\n\n<li>Working near machinery that is in\nmotion;<\/li>\n\n\n\n<li>Machinery Fencing.<\/li>\n\n\n\n<li><strong>Welfare\nMeasures Under the Act:<\/strong><\/li>\n\n\n\n<li>Washing\n&amp; drying facilities;<\/li>\n\n\n\n<li>Rest\nareas for sitting facilities;<\/li>\n\n\n\n<li>Canteens\n&amp; lunchrooms for all the employees;<\/li>\n\n\n\n<li>First\naid services during emergencies. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirements_for_Obtaining_the_Factory_License_in_India\"><\/span>Requirements\nfor Obtaining the Factory License in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nowner of the Factory will be required to take consent in advance from the State\nGovernment where the owner\u2019s Factory will be located. To be able to occupy the\nFactory Premises, the Factory owner will also require to send a legal notice to\nthe Chief Inspector (CI) under Section 7 of the Factory Act.
