This action is intended to bring effective compliance throughout all processes in India&#8217;s cosmetic industry. The notification was issued to define and amend the older Drugs and <strong>Cosmetics Rules, 1945<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Drugs_and_Cosmetics_Rules,_1945\"><strong>[1]<\/strong><\/a><\/sup> regulations governing the import, production, labelling, sale, and distribution of cosmetics in India. Section 12 and<strong> <\/strong>33 under the Drugs and Cosmetics Act, 1940 govern the notice (23 of 1940). These guidelines will apply to cosmetics as specified in Section 3 of the Drugs &amp; Cosmetics Act of 1940, clause (aaa) (23 of 1940). The Ministry had earlier released the proposed norms and requested feedback and ideas from the interested parties. Last, the Central Government announced the Cosmetic Rules, 2020. Products including skin creams, lotions, lipsticks,\nnail polishes, eye and face makeup preparations, shampoos, permanent waves,\nhair colours, toothpaste, deodorants, and any substance intended for use as a\ncosmetic product component are all covered by this description. Products like\nsoap that predominantly contain an alkali salt of fatty acid and have no\nadditional label claim to clean the human body are not legally considered\ncosmetics. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mandatory_Requirements_of_Labelling_Standards_for_Cosmetics\"><\/span>Mandatory Requirements of\nLabelling Standards for Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Regulatory\ndeclarations usually don&#8217;t receive the same importance as cosmetic item claims\n&amp; design. Still, they are essential nonetheless and may invite liability in\ncase they are found to be missing from a cosmetic product package. This\nstatement may apply to cosmetics sold all around the sentence but is especially\ntrue for cosmetics items sold in India because the Indian cosmetics regulator\n(State Licensing Authority for domestically manufactured cosmetics and the\nCentral Drugs Standards Control Organisation for imported cosmetics) does not\napprove labels at the time of granting marketing authorization. It is set up\nfor the manufacturers &amp; importers of cosmetics items to ensure that\ncompulsory declarations laid down under the Cosmetics Rules, 2020 and other\nlaws appear on the products&#8217; labels. Omitting mandatory declarations would\nrender the item &#8216;misbranded&#8217; under the Drugs &amp; Cosmetics Act, 1940. It may\nhave consequences for the manufacturer or importer, ranging from cancellation\nor suspension of a manufacturing license or import registration certificate to\ncriminal prosecution. It may even have repercussions for the whole seller &amp;\nretailer, as misbranded cosmetic items are bound to be confiscated without\ncompensation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Essential_Points_of_Labelling_Standards_for_Cosmetics\"><\/span>Essential Points of Labelling\nStandards for Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Following are\nsome essential points of Labelling Standards for Cosmetics under Cosmetics\nRules 2020:<\/p>\n\n\n\n<ul><li>Before applying for label compliance, ensure\nthat the label follows the guidelines according to the labelling requirements\nmentioned in the New Cosmetics Rules 2020.<\/li><li>The regulatory body can provide a significant\nupdate or rejection of the label in case the label on the product doesn\u2019t\ncomply with the New Cosmetics Rules 2020.<\/li><li>Information on the label, like the\nmanufacturer&#8217;s name, net weight of the product, and components, should be\nverified with the official documents of the cosmetic product.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Understanding_Outer_Inner_Labelling_Standards_for_Cosmetics\"><\/span>Understanding Outer &amp; Inner\nLabelling Standards for Cosmetics<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Typically,\ncosmetic items would have labels on the inner label (container), an outer label\n(outer wrapper or box), and sometimes a leaflet containing instructions or\nadditional details. The Cosmetics Rules not only mention the declarations but\nalso stipulate the label on that those declarations should appear. The\nCosmetics Rules not only prescribe the declaration but also stipulate the label\non that those declarations should appear. Following are the mandatory\ndeclarations for cosmetics manufactured in India under Cosmetics Rules, 2020:<\/p>\n\n\n\n<ul><li><strong>Inner &amp; Outer Labels:<\/strong> The following details must appear on the label on the container and any external packaging.<\/li><\/ul>\n\n\n\n<ol><li>Name of Cosmetic;<\/li><li>Name of the legal manufacturer;<\/li><li>Expiry date or use before date;<\/li><li>Address of cosmetic manufacturing premises;<\/li><li>List of components present in a concentration of more than 1% shall be listed in the descending order of volume or weight at the time they are added, followed by those in a concentration of less than\/equal to 1 %, in any order, and preceded by the words \u201cINGREDIENTS\u201d.<\/li><\/ol>\n\n\n\n<ul><li><strong>Inner or Outer Labels:<\/strong> The following details must appear on either the outer or inner label.<\/li><\/ul>\n\n\n\n<ol><li>Distinctive lot\/batch code (mentioned as Lot No. \/Lot, Batch No. \/B. No.)<\/li><li>Manufacturing License Number (<em>M.L.No. or Mfg. Lic. No.)<\/em><\/li><\/ol>\n\n\n\n<ul><li><strong>Only on Inner Label:<\/strong> If any hazards are linked to a cosmetic product, the following should appear.<\/li><\/ul>\n\n\n\n<ol><li>Any warning, caution or special directions;<\/li><li>Adequate directions for use;<\/li><li>Names &amp; quantities of ingredients which are poisonous or hazardous;<\/li><\/ol>\n\n\n\n<ul><li><strong>Only on Outer Label:<\/strong> The following details must appear on the only outer label.<\/li><\/ul>\n\n\n\n<ol><li>Number of products, in case of more the one;<\/li><li>Net contents (fluid measure for liquids, weight for solids, and either one semi-solids)<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mandatory_Labelling_Standards_for_Cosmetics_Imported_into_India_under_Cosmetics_Rules_2020\"><\/span>Mandatory Labelling Standards\nfor Cosmetics Imported into India under Cosmetics Rules, 2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Cosmetics\nRules stipulate the labelling standards for all cosmetics products sold in the\nIndian market, including imported cosmetics. All the details that need to\nappear on domestically produced cosmetics need to appear on imported cosmetics.\nIn addition, information about the importer needs to be mentioned so that users\nand regulators can access a domestic entity concerning the imported cosmetic\nproducts. The following are additional Labelling Standards for Cosmetics that need\nto appear:<\/p>\n\n\n\n<ul><li>Name of Importer;<\/li><li>Complete Address of Importer;<\/li><li>Import Registration Certificate Number (\u201cRC\u201d,\n\u201cRC No.\u201d, and \u201cReg. Cert. No.\u201d);<\/li><li>In case the cosmetics are imported from a\ncountry that doesn&#8217;t need the manufacturing license number to be mentioned, the\nmanufacturing license number is not required.<\/li><li>In case of the importer doesn&#8217;t wish to declare\nthe manufacturing premises, then a declaration of country of manufacture would\nsuffice (Made in Country).<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Exemption_for_Small-size_Cosmetic_Packages_under_Cosmetics_Rules_2020\"><\/span>Exemption for Small-size\nCosmetic Packages under Cosmetics Rules, 2020<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Small Containers of Cosmetics are subject\nto specific relaxation:<\/strong><\/p>\n\n\n\n<ul><li>Manufacturer address may be shortened to the\nonly principal place of manufacture and the pin code where the cosmetics\ncontainer is less than\/ equal to 60 ml of liquid and 30g of solids &amp;\nsemi-solids.<\/li><li>The declaration of net contents does not require\nto appear in case of the package of toilet water, perfume or the like, the net\ncontent of that doesn&#8217;t more than 60 ml or ant package of semi-solid or solid\ncosmetic the net content of that doesn&#8217;t more than 30 grams.<\/li><li>Batch code is not required to be mentioned on\ncosmetics that are up to 1o grams in case of the semi-solid or solid state or\n25 ml in case of the liquid state.<\/li><li>The ingredients list is not required for\ncosmetics that are less than or equal to 60 ml of liquid or 20 grams of\nsemi-solid or solid.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>With the growth in the cosmetic market, it is important to make cosmetic products stand out from competitors. A cosmetics product is also assessed by its users based on its labelling standards for cosmetics.
