<strong>Bureau of Energy Efficiency<\/strong><sup><a href=\"https:\/\/beeindia.gov.in\/\"><strong>[1]<\/strong><\/a><\/sup> publishes the notification regarding the draft regulation in the exercise of the powers conferred by Section 58 (2) (i) read with Section 13 (2) (n) of the Energy Conservation Act, 2001.&nbsp;<\/p>\n\n\n\n<p>As per Section 58 (1) of\nthe Energy Conservation Act, 2001, the proposed draft amendments regulations\nare published in the Gazette of India, for the information of all persons\nlikely to be affected and for inviting their suggestions and objections on or\nbefore the expiry of thirty days period from publication&#8217;s date of the\nRegulations in the Gazette of India.&nbsp;<\/p>\n\n\n\n<p>These regulations are\ncalled Bureau of Energy Efficiency (Particulars and Manner of their Display on\nLabels of Distribution Transformer) Amendment Regulations, 2022, hereinafter\nreferred to as BEE Regulations 2022. They will come into effect on the date of\ntheir publication in our Official Gazette.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Different_Definitions_under_BEE_Regulations_2022\"><\/span>Different Definitions under\nBEE Regulations 2022<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Regulation 2 of the BEE Regulations\n2022 has given definitions of different related terms, some of which are as\nfollows:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Label<\/h3>\n\n\n\n<p>A label means any written,\nprinted, marked, stamped or graphic matter affixed to or appearing upon\ndistribution transformer, where distribution transformer means an appliance as\nspecified in the notification given by the Central Government in consultation\nwith the BEE under the Energy Consumption Act, 2001. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Label Period&nbsp;<\/h3>\n\n\n\n<p>The validity period of the relative energy efficiencies or loss standards is called the label period. It is total losses at 50% as well as 100% loading of distribution transformer as notified by the Central Government of India under Section 14 (a) of the Energy Consumption Act, 2001, meaning the norms for processes and energy consumption standards for any equipment, an appliance that consumes, generates, transmits or supplies energy, and in case end of such validity period of relative energy efficiencies or loss standards is not notified then it is deemed to be valid till the new values for the same are notified by the Central Government.<\/p>\n\n\n\n<p><strong>Also Read:<\/strong> <strong><a href=\"https:\/\/corpbiz.io\/learning\/bee-registration-for-frost-free-refrigerator-know-legalities\/\" target=\"_blank\" rel=\"noreferrer noopener\">BEE Registration for Frost-free Refrigerator: Know the Legalities<\/a><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Permittee&nbsp;<\/h3>\n\n\n\n<p>The person or agency is\npermitted to affix a label by the Bureau of Energy Efficiency are called\npermittee under BEE Regulations 2022.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Star rating or Star Level<\/h3>\n\n\n\n<p>The grade of energy\nefficiency displayed on the Label of the distribution transformer based on the\nlosses at 50% and 100% loading of the distribution transformer notified by the\nCentral Government in Section 14 (a) of the Energy Consumption Act, 2001, as\nnorms for processes and energy consumption standards for any equipment, an\nappliance which consumes, generates, transmits or supplies energy, to denote\nthe relative energy efficiencies or loss standards that is total losses at 50\nand 100% loading of the distribution transformer.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Trader or seller&nbsp;<\/h3>\n\n\n\n<p>Concerning any distribution\ntransformer, the trader or seller is a person who sells or distributes any such\ndistribution transformer and also includes a shopkeeper, trader, manufacturer\nand Permittee who is permitted to affix Label on such distribution\ntransformer.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Forms_mentioned_under_BEE_Regulations_2022\"><\/span>Forms mentioned under BEE\nRegulations 2022<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following forms are\nspecified under the Bureau of Energy Efficiency (Particulars and Manner of\ntheir display on Label of Distribution Transformer) Regulations, 2022:<\/p>\n\n\n\n<table class=\"table table-bordered\"><tbody><tr><td>\n  FORM I-(A)\n  <\/td><td>\n  Application for\n  registration of a brand of distribution transformer \n  <\/td><\/tr><tr><td>\n  FORM I-(B)\n  <\/td><td>\n  Application for permission\n  to affix Label on Distribution Transformer\n  <\/td><\/tr><tr><td>\n  FORM II-(A)\n  <\/td><td>\n  Permission for\n  registration of a brand of distribution transformer\n  <\/td><\/tr><tr><td>\n  FORM II-(B)\n  <\/td><td>\n  Permission or Renewal of\n  Permission to affix Label on Distribution Transformer\n  <\/td><\/tr><tr><td>\n  FORM III\n  <\/td><td>\n  Register of Permittees to\n  be maintained by Bureau of Energy Efficiency\n  <\/td><\/tr><tr><td>\n  FORM IV\n  <\/td><td>\n  Declaration by Permittee\n  seeking continuation of the permission to affix Label on the existing model\n  <\/td><\/tr><tr><td>\n  FORM V\n  <\/td><td>\n  Direction to Permittee on\n  failure of 2nd check testing\n  <\/td><\/tr><tr><td>\n  FORM VI\n  <\/td><td>\n  Action Taken Report\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Particulars_displayed_on_Label_as_per_BEE_Regulations_2022\"><\/span>Particulars displayed on\nLabel as per BEE Regulations 2022<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following particulars\nmust be displayed on every distribution transformer&#8217;s Label:<\/p>\n\n\n\n<ul>\n<li>Logo of Bureau of Energy\n     Efficiency&nbsp;<\/li>\n\n\n\n<li>Equipment&nbsp;<\/li>\n\n\n\n<li>Type&nbsp;<\/li>\n\n\n\n<li>Make, Manufacture, importer<\/li>\n\n\n\n<li>Model or manufacturing year&nbsp;<\/li>\n\n\n\n<li>Transformer capacity in kVA<\/li>\n\n\n\n<li>Voltage in kV<\/li>\n\n\n\n<li>Total losses at 50% loading in watts<\/li>\n\n\n\n<li>Total losses at 100% loading in watts<\/li>\n\n\n\n<li>Unique label series code<\/li>\n\n\n\n<li>Star Level&nbsp;<\/li>\n\n\n\n<li>Label period&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Display_of_labels_as_discussed_under_BEE_Regulations_2022\"><\/span>Display of labels as\ndiscussed under BEE Regulations 2022<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The display of labels on\nthe distribution transformer is thoroughly discussed under the Regulations. The\nfollowing are the aspects which are focused related to the display of labels:<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Time Limit for a display of\nlabels<\/h3>\n\n\n\n<p>Under Regulation 4, it is\nstated that a label containing all the particulars is displayed on every\ndistribution transformer within six months from the date of coming into force\nof these Regulations.<\/p>\n\n\n\n<p>Every Permittee, trader or\nseller, on and from the commencement of revised energy consumption standards as\nnotified by the Central Government:<\/p>\n\n\n\n<ul>\n<li>Shall not produce the distribution\n     transformer with the previous energy consumption standards<\/li>\n\n\n\n<li>The distribution transformer shall\n     display the revised label period and star level with the revised energy\n     consumption standard ad manufacturing year of the distribution transformer\n     in synchronisation with the revised energy consumption standards.<\/li>\n\n\n\n<li>All preparatory steps, including\n     awareness of dealers, retailers and requisite publicity for their\n     education of consumers, are planned and action taken in advance.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Manner of display of Label<\/h3>\n\n\n\n<p>As per Regulation 5, on\nevery distribution transformer, the Label shall be stamped as follows:<\/p>\n\n\n\n<ul>\n<li>The Label is to be affixed at the front\n     of a display unit and should be easily visible, and the Permittee ensures\n     that the Label appears on every registered unit or model on display for\n     identification purposes at the point of sale or hire and label is also\n     printed or posted to exterior to the casing containing the unit or model.<\/li>\n\n\n\n<li>For the units not on display, the Label\n     is printed or pasted to the exterior of the casing, and this Label is\n     attached to the unit or model when the unit or model is removed from its\n     packaging, or the Label is included as part of the documents given to\n     consumer or user.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Permission for display of\nLabel&nbsp;<\/h3>\n\n\n\n<p>According to Regulation 6\nof BEE Regulations 2022, no star label is affixed on a distribution transformer\nwithout obtaining prior permission from the Bureau of Energy Efficiency.<\/p>\n\n\n\n<p>For obtaining company\nregistration permission from the Bureau of Energy Efficiency, every brand is\nregistered separately, accompanied by a label security fee of Rs. 1,00,000\/-\npayable by electronic mode of payment. However, in the case of small-scale\nindustry, the label security fee is Rs. 25,000\/-.<\/p>\n\n\n\n<p>For obtaining permission\nfor model registration, every application of the Permittee is accompanied\nby&nbsp;<\/p>\n\n\n\n<ul>\n<li>An application fee of Rs. 2,000\/- per\n     model payable by electronic mode of payment&nbsp;<\/li>\n\n\n\n<li>Documents<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Grant of permission to\naffix Label<\/h3>\n\n\n\n<p>Regulation 7 of BEE\nRegulations 2022 talks about the grant of permission to affix Labels. On\nreceipt of an application under previous Regulation and after being satisfied\nthat all requirements comply with the Bureau of Energy Efficiency within a\nperiod as specified in the manual of standards and labelling. However, the\nfollowing are a few terms and conditions required to be followed:<\/p>\n\n\n\n<ul>\n<li>Register the brand in the specified Form\n     in an electronic form<\/li>\n\n\n\n<li>Grant permission for affixing the Label\n     on the distribution transformer in the same specified Form in the\n     electronic Form<\/li>\n<\/ul>\n\n\n\n<p>The Bureau of Energy\nEfficiency maintains a register in a prescribed Form (Form III) and enters the\nname of the Permittee therein.<\/p>\n\n\n\n<p>The permission granted here\nis valid till the star level as specified by the energy consumption standard\nnotified by Central Government.<\/p>\n\n\n\n<p>In case of revision of the\nstar rating plan, the Permittee makes the application for renewal of permission\none month before its expiry. Such application is also accompanied by the fee of\nRs. 1,000\/- payable in electronic mode in favour of the Bureau of Energy\nEfficiency. And in the case of an extension of the star rating plan, the\nrenewal fee is exempted.&nbsp;<\/p>\n\n\n\n<p>No application is renewed\nafter the expiry of the validity period, and so the Permittee has to make a new\napplication as per this BEE Regulations 2022.<\/p>\n\n\n\n<p>After being satisfied with\nthe received application for renewal that all requirements are complied with by\nthe Bureau of Energy Efficiency within the period of one month from the date of\nreceipt of such application, renew the permission in the prescribed Form.&nbsp;<\/p>\n\n\n\n<p>From the date on which the\nrevised star level is enforced, the Permittee submits only a Declaration in\nprescribed Form IV.&nbsp;<\/p>\n\n\n\n<p>The Permittee also seeks permission to affix a fresh Label if a new model of a distribution transformer is planned to be launched to synchronise with such revised star level, and application for the same is made in advance of six months of enforcement of such revised star level.\u00a0<\/p>\n\n\n\n<p><strong>Related Blog:<\/strong> <strong><a href=\"https:\/\/corpbiz.io\/learning\/bee-registration-for-color-television-process-and-paperwork\/\" target=\"_blank\" rel=\"noreferrer noopener\">BEE Registration for Color Television: Process and Paperwork<\/a><\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Terms &amp; Conditions for\ndisplay of particulars on Label<\/h3>\n\n\n\n<p>Following are terms and\nconditions which every trader, Permittee and seller comply with in displaying\nthe particulars on Label as stated under 8 of BEE Regulations 2022:<\/p>\n\n\n\n<ul>\n<li>The Star level displayed on the\n     distribution transformer&#8217;s Label must conform to energy consumption\n     standards for the distribution transformer as notified by Central\n     Government.<\/li>\n\n\n\n<li>The Label must be affixed on such model\n     of distribution transformer only, for which permission is granted.<\/li>\n\n\n\n<li>The Label must be printed and affixed on\n     the distribution transformer at the cost of the Permittee.<\/li>\n\n\n\n<li>The Permittee, trader, and seller must\n     ensure that the star level displayed on the distribution transformer label\n     is maintained all the time.&nbsp;<\/li>\n\n\n\n<li>The Permittee must pay the label fee.<\/li>\n\n\n\n<li>The Permittee must furnish to the Bureau\n     of Energy Efficiency a statement that contains details of the production\n     of labelled equipment and accrued labelling fee due for each quarter\n     within the following month of the close of each quarter of the financial\n     year.<\/li>\n\n\n\n<li>The Permittee must furnish to Bureau\n     with an updated list of authorised distributors, dealers, retailers &amp;\n     sellers appointed to sell their labelled products or goods by 30th April\n     of each year.<\/li>\n\n\n\n<li>The Permittee, trader and seller must\n     comply with other terms and conditions which the manual on standards and\n     labelling of the Bureau.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Labelling_Fee_as_per_BEE_Regulations_2022\"><\/span>Labelling Fee as per BEE\nRegulations 2022<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per Regulation 9, every Permittee has to pay to the Bureau of Energy Efficiency for a label affixed on the distribution transformer. This label fee is paid annually within one month from the date of closure of each financial year.&nbsp;<\/p>\n\n\n\n<p>However, on failure to pay\nsuch label fee with the specified fee, the Bureau recovers the amount due with\ninterest at 10% per annum from the label security fee. If complete labelling\nfees are not collected or recovered within one year of the last date of\nsubmission, the Bureau cancels all labels granted to the Permittee and\npublishes the name of the Permittee in the newspaper as a defaulter.&nbsp;<\/p>\n\n\n\n<p>Regulation 10 talks about\nthe refund of label security fee that a permittee is entitled to refund of a\nlabel security fee on cease of the manufacture distribution transformer.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Verification_of_particulars_of_Label_under_BEE_Regulations_2022\"><\/span>Verification of particulars\nof Label under BEE Regulations 2022<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Regulation 11 discusses the\nverification by Bureau or its designated agency. The Bureau or its agency,\neither on its own or on a complaint received, conducts verification to ensure\nthat the distribution transformer conforms to the star level and other\nspecified particulars on its Label, and it also ensures that it complies with\nother terms and conditions of permissions granted by the Bureau.&nbsp;<\/p>\n\n\n\n<p>For the purpose of\nverification, samples are picked up at random by the Bureau or its Agency from\na manufacturing facility, warehouse or retail outlet as it deems fit and it\nsubjected to the followings:<\/p>\n\n\n\n<ul>\n<li>Measurement of winding resistance test<\/li>\n\n\n\n<li>Measurement of impedance voltage or\n     short circuit impedance and load loss<\/li>\n\n\n\n<li>Measurement of no-load loss and current\n     test<\/li>\n\n\n\n<li>Temperature rise test<\/li>\n\n\n\n<li>Short circuit test<\/li>\n<\/ul>\n\n\n\n<p>Where a complaint is received under this BEE Regulations 2022, the Bureau carries out verification by challenge testing the distribution transformer in an independent laboratory duly accredited by the National Accreditation Board for Testing and Calibration Laboratories, a notice is issued to Permittee in prescribed Form V for carrying out such testing, and the complainant is called to deposit, such expenses relating to sample cost, testing, transportation &amp; other incidental expenses with Bureau within such time as determined by Bureau. <\/p>\n\n\n\n<p>If the sample drawn under the challenge testing fails, then all expenses towards the cost of sample, transportation, and testing charges are reimbursed by Permittee to Bureau. Bureau refunds the expenses to the complainant, and where the equipment passes the challenge test, then the expenses deposited by the complainant stand forfeited. <\/p>\n\n\n\n<p>If samples of distribution\ntransformer used for testing fails, then the Permittee offers another\nopportunity, and the Bureau conducts a second test with twice the quantity of\ndistribution transformer in an independent test laboratory which is different\nfrom the first one and is duly accredited by the National Accreditation Board\nfor Testing &amp; Calibration Laboratories at the cost of Permittee. <\/p>\n\n\n\n<p>In case the second test\nalso fails, then the Bureau:<\/p>\n\n\n\n<ul>\n<li>Directs the Permittee that within a\n     period of two months:<\/li>\n<\/ul>\n\n\n\n<ol>\n<li>Correct the star level displayed on the\n     Label of the distribution transformer\/remove defects and deficiencies\n     found during testing.<\/li>\n\n\n\n<li>Withdraw all stocks from the market to\n     comply with directions of the Bureau<\/li>\n\n\n\n<li>Change particulars displayed on\n     advertising material<\/li>\n<\/ol>\n\n\n\n<ul>\n<li>For the benefit of consumers, publish\n     any permittee&#8217;s name, brand name, model name or model number, logo and\n     other specifications in any regional or national newspaper, and also in\n     any electronic means or any other manner, within two months intimate to\n     State Designated Agency to start adjudication proceeding against Permittee\n     and trader under Section 27 of the Energy Conservation Act, 2001.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>The BEE Regulations 2022,\nunder the same Regulation, also states that the Permittee within ten days of\nthe conclusion of the said period of two months:<\/p>\n\n\n\n<ul>\n<li>Sends the compliance report in\n     prescribed Form VII to the Bureau for the action taken in compliance with the\n     direction, and&nbsp;<\/li>\n\n\n\n<li>If such compliance report is not\n     received or received without complying with any direction within the\n     specified time period, then it is deemed as non-compliance with the\n     direction issued, and orders to that effect are passed by the Bureau of\n     Energy Efficiency (BEE).&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Bureau sent a copy of such\ncompliance report and said orders passed along with the necessary documents to\nthe State Designated Agency to take action and enforce orders passed.<\/p>\n\n\n\n<p>If the Permittee fails to\ncomply with directions issued by the Bureau, then Bureau:<\/p>\n\n\n\n<ul>\n<li>Withdraws permission granted to\n     Permittee&nbsp;<\/li>\n\n\n\n<li>Sends a report to Central Government\n     accompanied by the test report in support of failure by the Permittee to\n     conform to energy consumption standards as notified by the Central Government,\n     directions of the Bureau for consideration and taking action by the\n     Central Government.<\/li>\n\n\n\n<li>For the benefit of consumers, publish\n     any permittee&#8217;s name, brand name, model name or model number, logo and\n     other specifications in any regional or national newspaper, and also in\n     any electronic means or any other manner, within two months<\/li>\n\n\n\n<li>Intimate to State Designated Agency to\n     start adjudication proceeding against Permittee and trader under Section\n     27 of the Energy Conservation Act, 2001.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cancellation_of_permission_under_BEE_Regulations_2022\"><\/span>Cancellation of permission\nunder BEE Regulations 2022<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Bureau of Energy\nEfficiency may cancel the permission granted (under Regulation 7) to Permittee\nas per Regulation 12 if the Permittee:<\/p>\n\n\n\n<ul>\n<li>Fails to comply with any of the terms\n     &amp;
