It is an\nextension of the \u201cPolluters pay principle\u201d that encourages a \u201ccradle to cradle\u201d\napproach. <\/p>\n\n\n\n<p>The Extended Producers\u2019 Responsibility was introduced by Sweden\u2019s Thomas Lindqvist, who is in 1990 for one of the Sweden University, which was later introduced to the Swedish Ministry of Environment. This report defining the concept of EPR was introduced at the time when many European countries were implementing policies to improve their waste management system. Ultimately seeing the innovative idea behind EPR, all of the signatories of the <strong>Organization for Economic Co-operation and Development (OECD)<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/OECD\"><strong>[1]<\/strong><\/a><\/sup> adopted this policy as an international standard for the prevention of pollution and waste management. <\/p>\n\n\n\n<p>Germany was among the first country to adopt the policy of EPR\nin Europe in 1991, making manufacturers and producers responsible for waste\nmanagement of the products they sell, including recycling and disposing of\nthem. In India, Extended Producers\u2019 Responsibility was first introduced in\nE-Waste Management Rules and Plastic Waste Management Rules through the\namendment of 2016. Under these rules, EPR is defined as the responsibility of\nany producer of plastic or EEE (Electrical or electronic equipment) for the management\nof those waste in order to make sure that it is disposed of in an environmentally\nsustainable way. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Import_of_E-Waste\"><\/span>Import of E-Waste <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>India is one of the biggest producers\u2019 of E-Waste and has\npartially banned the import of E-Waste from regulating the influx of WEEE\n(Waste Electrical or electronic equipment) in India. In a recent report, the\nUnion Government reported Lok sabha of 29 illegal cases of E-Waste import since\n2019. Therefore to curb this and make importers and producers responsible for\nwaste, the import of E-Waste in India is only limited to importers who are\nimporting WEEE (Waste Electrical or electronic equipment) to sell to the\nauthorised producer. <\/p>\n\n\n\n<p>E-Waste Management rules,\n2016 dictate regulations regarding Import which include:-<\/p>\n\n\n\n<ul><li>Electric and Electronic\nEquipment (EEE) is only required to be imported to the importers or producers\nhaving Extended Producers\u2019 Responsibility authorisation that is permitted given\nby CPCB (Central Pollution Control Board) as specified under Section 5(3) of\nthe E-Waste (Management) Rules, 2016.<\/li><li>The importers also have to\n     submit the Extended Producers\u2019 Responsibility action plan once they have\n     submitted the authorisation certificate.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"EPR_certificate_for_the_import_of_E-Waste\"><\/span>EPR certificate for the import of E-Waste <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The authorisation for Extended Producers\u2019 Responsibility has\nbeen made compulsory for all the producers, including importers. <\/p>\n\n\n\n<p>Except for in the case where the import is happening for\nselling it to EPR Authorised producers. For which importers only need documents\nto deposit it to Custom\/port authorities the following documents:-<\/p>\n\n\n\n<ul><li>Copy of agreement with EPR registered producers\u2019\n<\/li><li>Copy of Extended Producers\u2019 Responsibility\nauthorisation of the Producers\u2019 <\/li><li>Letter from EPR-Authorised Producers on behalf\nof which importer is importing <\/li><\/ul>\n\n\n\n<p>The second exception is when actual users are importing\nspares of EEE from OEM (Original Equipment Manufacturers) for a reason relating\nto a warranty replacement, with the condition that an equal number of\nmalfunctioning or default parts are exported back within a year according to\nthe document verification by custom authorities specified under Schedule VIII\nof Hazardous Waste Rules, 2016. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Documents required for an EPR\ncertificate for the import of E-Waste <\/strong><\/h3>\n\n\n\n<p>The documents that are required for acquiring an EPR\ncertificate for the import of E-Waste of E-Waste are: &#8211;<\/p>\n\n\n\n<ul><li>IEC <\/li><li>Authorized Signatory KYC <\/li><li>the rent or lease proof <\/li><li>EPR Plan, <\/li><li>Awareness Plan<\/li><li>Details on Waste handled <\/li><li>Conformity with the RoHS.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_EPR_certificate_for_the_import_of_E-Waste\"><\/span>Procedure for EPR certificate for the import of E-Waste <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Importers under E-Waste management rules are clubbed\ntogether with producers\u2019 in case of acquiring an <strong>EPR certificate for the import of E-Waste<\/strong>. The application\nprocess is similar to that followed by producers\u2019 which includes: &#8211;<\/p>\n\n\n\n<ol><li>The application under Form 1\n     is to be filled by the importer<\/li><li>Details on E-Waste production\n     of EEE (Electric or Electronic equipment) item-wise are to be specified along\n     with projected target collection for the impending year by the State\n     Pollution Control Board.<\/li><li>Extended Producers&#8217;\n     Responsibility action plan info needs to be provided.<\/li><li>The application form for the\n     EPR certificate for the import of E-Waste submitted should accompany the\n     required document.<\/li><li>Once the submission, the\n     application will be examined by Central Pollution Control Board.<\/li><li>After inspecting the\n     application, CPCB will provide the EPR Certificate.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Self-Declaration_form_for_EPR_certificate_for_the_import_of_E-Waste\"><\/span>Self-Declaration form for EPR certificate for the import of E-Waste<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The self-declaration form that is to be filled by\nimporters as per the E-Waste management Rules contains the basic information of\nthe producers, including: &#8211;<\/p>\n\n\n\n<ul><li>Company Name with Complete Address from where\nbusiness\/sale in the entire country is being managed<\/li><li>Name of Authorised Person <ul><li>Email: <\/li><\/ul><ul><li>Telephone: <\/li><\/ul><ul><li>Fax: <\/li><\/ul><ul><li>Mobile Number: <\/li><\/ul><ul><li>Complete Postal Address: <\/li><\/ul><\/li><li>Brand name (if any)<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Post_Compliance_Relating_to_EPR_certificate_for_the_import_of_E-Waste\"><\/span>Post Compliance Relating to EPR certificate for the import of E-Waste <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Importers, according to the guidelines provided by MoEF and\nCC (Ministry of Environment, Forest and Climate Change), have to comply with\nsome of the requirements as part of their Extended\nProducers\u2019 Responsibility. These are: &#8211;<\/p>\n\n\n\n<ul><li>They have to submit an annual return as per form\n3 <\/li><li>They also have to submit an annual report in\nregards to the implementation of Extended\nProducers\u2019 Responsibility which will be compiled by the State Pollution Control\nBoard\/Pollution Control Committee and submitted to the Central Pollution\nControl Board. <\/li><li>The report by\nSPCB\/PCC will be further compiled by Central Pollution Control Board in order\nto make a final submission to the Ministry of Environment, Forest and Climate\nChange. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Cancellation_of_EPR_Certificate_for_the_Import_of_E-Waste\"><\/span>Cancellation of EPR Certificate for the Import of E-Waste<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Central Pollution Control Board verifies the\ndocumentation submitted by the Importers during the filing of an application.\nIf this documentation is faulty or false, the authorisation can be cancelled.\nAlong with this, if at any point time the importers are discovered to have\nviolated any regulation stipulated under the rules or the guidelines provided\nby Central Pollution Control Board, the notice is issued by the authorities\nimmediately.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Import of E-Waste has proven to be a delicate subject due to a large amount of illegal importing of E-Waste from developing countries in spite of regulations present in both international as well as domestic legislation.
