Because of this\nreason, manufacturers require a Pollution board certificate for Asbestos\nproducts. Asbestos has a severe impact on people\nwho, for a short period of time, have been exposed to the high quantity of\nasbestos or on people who have been exposed to asbestos for a more extended\nperiod of time in low concentration. According to many types of research,\nexposure to asbestos may cause fatal diseases like Mesothelioma, which is a\ntype of cancer on the lining of the lungs and abdominal cavity, and Asbestosis,\nwhich is a type of scarring of the lungs that impacts breathing and Lung\ncancer. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Asbestos_effect_on_the_Environment\"><\/span>Asbestos effect on the Environment <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Asbestos released during demolition, mining, demolition and\nmanufacturing activities into the environment contaminates not only air and\nwater but also the ground where it can be redistributed through the air.\nAsbestos, when mixed with air, remains suspended for a more extended period of\ntime which is further carried away to outlying areas by wind or even water if\nit is mixed with a water body. Since it is not biodegradable or does not\ndisintegrate, it remains for a more extended period of time in the environment,\nposing a severe threat to human health and the atmosphere. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Air_and_Water_Act\"><\/span>Air and Water Act <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>When the issues relating to the environment started increasing, and the atmosphere started getting affected, especially Water bodies and Air, there was seen an urgent need for proper regulatory mechanisms and regulations. Therefore to accommodate those under one umbrella Water and Air Act was enacted by the Ministry of Environment, Forest and Climate Change. First, The Water (Prevention &amp; Control of Pollution) Act, 1974 was enacted, which was also one of the earliest legislation addressing the problem of pollution. This act established the functions of the Central Pollution Control Board and state board relating to curbing water pollution and monitoring the activities of an industry that are causing the same. This act also gives power to <a href=\"https:\/\/corpbiz.io\/state-pollution-control-board-spcb-noc\"><strong>State Pollution Control Board<\/strong><\/a> or Pollution Control Committee to provide a Consent Certificate to the industries according to their pollution index. These certificates are mandatory for industries to acquire before starting their businesses. <\/p>\n\n\n\n<p>After that <strong>Air (Prevention &amp; Control of Pollution) Act, 1981<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Air_(Prevention_and_Control_of_Pollution)_Act\"><strong>[1]<\/strong><\/a><\/sup>, was enacted by the Ministry of Environment, Forest and Climate Change in response to United Nations Conference on Human Environment to prevent and regulate air pollution in India. This Act also prescribes the functions of the Central Pollution Control Board and state board relating to reducing Air pollution and monitoring the activities of an industry that are affecting the air quality. Air Act also mandates the authorisation of Consent Certificates granted by the State Pollution Control Board or Pollution Control Committee. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pollution_Board_Certificate_for_Asbestos_Products\"><\/span>Pollution Board Certificate for Asbestos Products<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Pollution Board Certificate for Asbestos Product is governed\nby the Ministry of Environment, Forest and Climate Change and Central Pollution\nControl Board, regulated under Air and Water Act. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents required for Pollution Board Certificate for Asbestos Products<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">Consent to Establish <\/h4>\n\n\n\n<p>According to Air and Water Act, for acquiring Pollution\nControl License for Scrap, one has to submit the following documents: &#8211;<\/p>\n\n\n\n<p>1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Registration\/lease\nor sale deed<\/p>\n\n\n\n<p>2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Detailed\nProject Report <\/p>\n\n\n\n<p>3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Layout\nPlan\/Site Plan <\/p>\n\n\n\n<p>4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; GST\nCertificate <\/p>\n\n\n\n<p>5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Aadhar Card <\/p>\n\n\n\n<p>6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Copy of Self\nDeclaration form with signatures <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Consent to Operate<\/h4>\n\n\n\n<p>According to Air and Water Act, for acquiring Pollution\nControl License for Scrap, one has to submit the following documents:-<\/p>\n\n\n\n<p>1.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Electricity\nBill <\/p>\n\n\n\n<p>2.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Rent\nagreement or lease agreement <\/p>\n\n\n\n<p>3.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Pan Card <\/p>\n\n\n\n<p>4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Aadhar Card <\/p>\n\n\n\n<p>5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Municipality\nor Industry license for trading business <\/p>\n\n\n\n<p>6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Health Trade\nLicense <\/p>\n\n\n\n<p>7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Site\nPlan\/layout <\/p>\n\n\n\n<p>8.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; CA Letter on\nthe financial breakup of the scrap trading business <\/p>\n\n\n\n<p>9.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; GST\ncertificate <\/p>\n\n\n\n<p>10.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Form-V <\/p>\n\n\n\n<p>11.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Authorization\nLetter<\/p>\n\n\n\n<p>12.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Factory\/Trade\nLicense<\/p>\n\n\n\n<p>13.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Proof of\nRegistration of unit under Companies Act or LLP Act <\/p>\n\n\n\n<p>14.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Consent to\nestablish <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_of_Authorisation_for_Pollution_Board_Certificate_for_Asbestos_Products\"><\/span>Process of Authorisation for Pollution Board Certificate for Asbestos Products<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For Asbestos products manufacturing plant Consent to\nestablish, the applicant is mandated to register with the State Pollution\nControl Board\/Pollution Control Committee official portal and submit the completed\napplication according to Form I with the stipulated documents. Once these\ndocuments are scrutinised by the authorities, the State Pollution Control\nBoard\/Pollution Control Committee grants the business authorisation for\nestablishment. <\/p>\n\n\n\n<p>For Consent to operate, the procedure is pretty much the\nsame as the consent to establish with the owner of the manufacturing unit is\nmandated to register with the official portal and submit the application\naccording to Form I with the stipulated documents. Once these documents are\nscrutinised by the authorities, the State Pollution Control Board\/Pollution\nControl Committee send authorised personnel for inspection, who, on the basis\nof inspection, formulate a report according to which authorisation is granted\nto the business for operation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Hazardous_Waste_Management_Handling_and_Transboundary_Movement_Rules_2008\"><\/span>Hazardous Waste (Management, Handling and Transboundary Movement) Rules,\n2008<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In 1989, the Ministry of Environment, Forest and Climate\nChange implemented Hazardous Waste (Management and Handling) Rules 1989 to\naddress the increase in Hazardous waste by industries and regulate its\nmanagement, but with an increase in unregulated import and export of this waste,\nthere was also need for proper regulation governing that therefore in 2008\nHazardous Waste (Management, Handling and Transboundary Movement) Rules, 2008.\nThese rules include regulations relating to the responsibility of stakeholders\ninvolved, Import and export of Hazardous Waste as well as storage, dumping and\ntransport etc. These rules also mandate manufacturers to file applications in accordance\nwith the e Forms, including info related to grant\/renewal of authorisation,\nmaintaining records, Applications for import or export, Applications for\nrecovery or co-processing etc.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents needed under HWR for Pollution Board Certificate for Asbestos Products<\/h3>\n\n\n\n<p>The documents which are required while submitting the\napplication for a Pollution board certificate for Asbestos products are: &#8211;<\/p>\n\n\n\n<ul><li>CTO;<\/li><li>CTE;<\/li><li>Certificate of incorporation (CIN)\/LLP;<\/li><li>Memorandum Of Association;<\/li><li>Article of Association;<\/li><li>Board resolution for appointing an authorised person;<\/li><li>Aadhar card;<\/li><li>PAN copy;<\/li><li>GST certificate of business;<\/li><li>Layout Plans;<\/li><li>Factory license\/Trade license;<\/li><li>Rent\/proof of ownership;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_of_Authorisation_under_HWR_for_Pollution_Board_Certificate_for_Asbestos_Products\"><\/span>Process of Authorisation under HWR for Pollution Board Certificate for Asbestos\nProducts<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per rule 6 of Hazardous Waste (Management, Handling and\nTransboundary Movement) Rules, 2008, application for authorisation is\nprescribed under Form 1 of the State Pollution Control Board\/Pollution Control\nCommittee which is submitted with the stipulated documents. Once the\napplication is submitted, the inquiry is conducted depending on which report is\nmade.
