For a cosmetic product to be imported into India for marketing purposes, the applicant or manufacturer must fill out form COS-2. First, the applicant must sign up on the Sugam online portal. After signing up, users should share the required documents and pay the fees. After looking at the Application, <a href=\"https:\/\/corpbiz.io\/cdsco-registration\"><strong>CDSCO<\/strong><\/a> will either ask for more paperwork or give the import registration certificate through Form COS-1 and COS-2.<\/p>\n\n\n\n<p>In Section 3 (aaa) of the <strong>Drugs and Cosmetics Act of 1940<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Drugs_and_Cosmetics_Act,_1940\"><strong>[1]<\/strong><\/a><\/sup>, &#8220;cosmetic&#8221; is defined. The CDSCO regulates the import of cosmetics into India through a registration system based on the provisions of the Drugs &amp; Cosmetics Act of 1940 and the Cosmetics Rules of 2020. Before it can be brought into the country, any item that fits the definition of a cosmetic must be registered, along with its pack size, variations, and place of manufacture. No cosmetic may be brought into India unless it has been registered under the rules by the Central Licensing Authority, which the Central Government appoints under rule 3(f), or by a person to whom such powers may be delegated under rule 5.<\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_82_2 counter-hierarchy ez-toc-counter ez-toc-grey ez-toc-container-direction\">\n<div 2020&#8217;s Form COS-1 is a request for the issuance of a\nRegistration Certificate to Import Cosmetics into India.<\/p>\n\n\n\n<p>According to the\nCosmetics Rules, 2020, Form COS-2 is an Import Registration Certificate that\nmust be issued for the import of cosmetics into India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_is_Eligible_to_Apply_for_a_Certificate_of_Cosmetic_Registration_FORM_COS-1_and_COS-2_in_India\"><\/span>Who is Eligible to Apply for a Certificate of Cosmetic Registration (FORM COS-1 and COS-2) in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A cosmetic\nproduct that will be brought into India must be registered through the Central\nGovernment&#8217;s online portal using FORM COS-1 and COS-2. This can be done by the\nmanufacturer, his authorized agent, the Importer in India, or the\nmanufacturer&#8217;s subsidiary in India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_points_to_be_followed_by_the_Importer\"><\/span>Key points to be followed by\nthe Importer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>An importer must\nmake the following provisions in order to obtain an import licence for the sale\nand distribution of cosmetics in India:<\/p>\n\n\n\n<ul><li>All legal documents must be verified for validity.<\/li><\/ul>\n\n\n\n<ul><li>The applicant must make sure that the product names, manufacturer and importer names, and addresses are consistent throughout all documents.<\/li><\/ul>\n\n\n\n<ul><li>FORM COS-1 and COS-2 must be obtained.<\/li><\/ul>\n\n\n\n<ul><li>English must be used in all documentation.<\/li><\/ul>\n\n\n\n<ul><li>The applicant must also offer additional pertinent data, such as a heavy metal declaration and product label claims. Additionally, the cosmetic product&#8217;s specifications must follow the ninth schedule listed in the Bureau of Indian Standards.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_qualifications_for_bringing_cosmetics_into_India\"><\/span>What are the qualifications for\nbringing cosmetics into India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In order to\nbring cosmetics into India, they must be registered with the Central Drugs\nStandards Control Organization. This is done by sending in an application and\ngetting a Registration Certificate through FORM COS-1 and COS-2.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Documents_Required_to_Obtain_a_Certificate_of_Registration_for_Cosmetics_in_India\"><\/span>Important Documents Required to\nObtain a Certificate of Registration for Cosmetics in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following\npaperwork must be submitted in order to obtain an import registration\ncertificate:<\/p>\n\n\n\n<ul><li>Approval from the manufacturer.<\/li><\/ul>\n\n\n\n<ul><li>Product labelling, certification of analysis, and product specification.<\/li><\/ul>\n\n\n\n<ul><li>No-cost Sales Certificate.<\/li><\/ul>\n\n\n\n<ul><li>Testing Technique.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_of_Application_Filling\"><\/span>Procedure of Application\nFilling <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>An application\nfor the issuance of an Import Registration Certificate for cosmetics that are\nintended to be imported into India must be made online in FORM COS-1 and COS-2\non the SUGAM Portal of CDSCO by either the manufacturer himself or by his\nauthorized agent or Importer in India, or by the subsidiary in India that the\nmanufacturer authorizes to make the Application to the Central Licensing\nAuthority under the Cosmetics Rules, 2020. This Application must be submitted\nby the manufacturer to the Central Licensing Authority. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_of_Cosmetic_Registration_Certificate_FORM_COS-1_and_COS-2\"><\/span>Process of Cosmetic\nRegistration Certificate (FORM COS-1 and COS-2):<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Cos-1:<\/strong><\/p>\n\n\n\n<ul><li>The CDSCO has predefined Performa that must be\ncompleted in order to receive a registration certificate.<\/li><li>The &#8220;Sugam&#8221; portal allows for the\nonline completion of Cos1.<\/li><li>Information about the manufacturing facilities,\na description of the cosmetics, the brand name, the pack size, and any\nvariations are included.<\/li><li>A number of documents are attached to Cos1.<\/li><\/ul>\n\n\n\n<p><strong>Submission: <\/strong><\/p>\n\n\n\n<ul><li>Cos1 (properly completed, signed, and stamped) and\nother pertinent documents are delivered to the CDSCO&#8217;s Drugs Controller General\n(I) in New Delhi.<\/li><li>A challan containing the amount paid in INR and\nthe Importer&#8217;s information is submitted in the Application&#8217;s favour.<\/li><\/ul>\n\n\n\n<p><strong>Registration Certificate (Cos2):<\/strong><\/p>\n\n\n\n<ul><li>Cos2 is also known as the Registration\nCertificate.<\/li><li>The licenced Importer, distributor, or Indian\nauthorized agent must present the Registration Certificate when requested by\nthe licencing authority.<\/li><li>According to the 2020 Cosmetic Rules, the\napproval process will now take 180 working days.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_of_a_License\"><\/span>Validity of a License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The licence for\nCertificate of Cosmetic Registration (FORM COS-1 and COS-2) is valid for five\nyears.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Make sure your product is labelled under the appropriate categories, contains the appropriate ingredients, and complies with regulations before applying to become an Indian cosmetics supplier. The Bureau of Indian Standards and the 1945 Drugs and Cosmetics Rules must be followed in terms of the product&#8217;s content. Additionally, there are detailed guidelines for ingredients, colouring, and inner and outer labelling. There are numerous categories for both personal care and cosmetic products. These are determined by factors such as the product&#8217;s intended use, the area in which it is used, and others. There are about 80 categories for cosmetic products set forth in the import and registration guidelines that have been prepared by the regulatory authority in India. These include items for skin care, oral hygiene, hair care, and nail care, among other things. Cosmetics must be categorized according to their intended use.
