MoEF and CC also act as a nodal agencies for various international environmental agencies, including South Asia Co-operative Environment Program (SACEP), <strong>United National Environment Program (UNEP)<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/United_Nations_Environment_Programme\"><strong>[1]<\/strong><\/a><\/sup> and International Centre for Integrated Mountain Development (ICIMOD)<\/p>\n\n\n\n<p>Along with acting as a nodal agency\nministry also overlook the Environmental issues pertaining to the Global\nEnvironment Facility (GEF), Commission on Sustainable Development (CSD) and\nlocal bodies like the South Asian Association for Regional Co-operation (SAARC)\nand the Economic &amp; Social Council for Asia &amp; Pacific (ESCAP)<\/p>\n\n\n\n<p>The main objective of the Ministry of\nEnvironment, Forest and Climate Change are: &#8211;<\/p>\n\n\n\n<ol><li>Overlooking Welfare of Wilf\nLife<\/li><li>Prevention &amp; Control of\nPollution<\/li><li>Environmental Protection<\/li><li>Conducting a survey of\nFauna\/Flora\/Wildlife and Forest<\/li><li>Conducting Awareness Campaign<\/li><\/ol>\n\n\n\n<p>Apart from this, many environmental\nlegislations also prescribe functions of The ministry, including the National\nConservation Strategy &amp; Policy Statement On Environment &amp; Development,\nNational Forest Policy, National Environment Policy and National Forest Policy.<\/p>\n\n\n\n<p>Ministry, along with all these, also\nprovide specialised guidelines and authorisations for trading activities\nrelating to material that is toxic to the atmosphere and the health of human\nbeings, like MoEF permission for the import of Rubber Scrap.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rubber_Scrap\"><\/span>Rubber Scrap<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Rubber scrap is scrap material\nextracted from rubber waste which, unlike metal scrap, goes through a\nreclaiming procedure at the end of the process. This reclaimed rubber can be\nused in very innovative ways to regulate environmental pollution by providing\nsofter playground surfaces, reducing further possibilities of injuries among\nathletes etc. The process of recycling rubber scrap includes: &#8211;<\/p>\n\n\n\n<p>The reclaiming process relating to\nrubber scrap includes a method through which the provided scrap is converted\ninto a state which can be reprocessed or mixed and vulcanised again using\nthermal\/mechanical energy and chemicals.<\/p>\n\n\n\n<p>There are three commonly used\nreclaiming processes including: &#8211;<\/p>\n\n\n\n<ul><li>Pan Process where ground rubber\nis combined with reclaiming oils which are then subjected to high temperature\nand pressure.<\/li><li>The digester process includes a\nsteam vessel equipped with a paddle agitator for the constant stirring of the\ncrumb rubber while steam is being applied.<\/li><li>At last, a mechanical or\nreclamation process is used for persistent reclaiming of whole tire scrap. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Market_Overview_of_Import_of_Rubber_Scrap\"><\/span>Market Overview of Import of Rubber Scrap<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>It is estimated that India, in order\nto fulfil its rubber scrap requirement, imports from 51 countries, among which\nthe majority is imported from the United Kingdom worth 1.71 USD Million, the\nUnited Arab Emirates with the worth of 1.54 USD Million, Italy (0.85 USD\nMillion), Australia (0.78 USD Million) and at last Belgium which imports rubber\nscrap of worth 0.6 USD Million. By calculating this, it can be estimated that\nIndian importers source rubber scrap worth 8.36 million US Dollars in 2020-2021\n(Apr-Nov)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"MoEF_Permission_for_Import_of_Rubber_Scrap\"><\/span>MoEF Permission for Import of Rubber Scrap<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>MoEF and CC is the regulating\nauthority which overlooks the trading business, including the export and import\nof rubber scrap. It is mandatory for importers to get MoEF permission for\nimport, as, without it, the authorisation for custom authorities will not be\ngranted. In order to get the Ministry of Environment, Forest, and Climate\nChange permission for the import of rubber scrap, one has first to get a test\nanalysis report from the laboratory from the authorities of the importing\ncountry. In India, three sets of rubber samples are reported to the laboratory\nthat is notified by the Ministry of Environment, Forest &amp; Climate Change or\nthe Central Pollution Control Board.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Guidelines provided by the Ministry of Environment, Forest\nand Climate Change for the Import of Rubber Scrap<\/h3>\n\n\n\n<p>According to the MoEF Rules and\nControl of Pollution, the business owners must acquire a Certificate to Operate\nunder the Air and Water (Prevention) Act and Hazardous Waste Management\nAuthorisation from the concerned State Pollution Control Board. Some other\nguidelines include: &#8211;<\/p>\n\n\n\n<ul><li>The import of rubber scrap with\na personalised code is only permissible to authorised recyclers without a DGFT\nlicense.<\/li><li>There are several Rubber Scraps\nthat are restricted import.<\/li><li>Capital goods can be\nsubstituted with second-hand goods.<\/li><li>The business owner needs to\nhave Import Export Code details<\/li><li>Recyclers of Rubber Scrap must\nhave facilities prescribed by the Central Pollution Control Board.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Consent_to_Operate_under_the_Air_Water_Prevention_and_Control_of_Pollution_Act\"><\/span>Consent to Operate under the Air &amp; Water (Prevention\nand Control of Pollution) Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Importers must acquire a Certificate\nto Operate under the Air and Water (Prevention) Act once the industry is\ninstituted and is ready to operate. Consent to operate has validity for five\nyears for the red category industry with the highest PI, ten years for the\norange category industry with higher PI and 15 years for the green category\nindustry with low PI.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents for Consent to Operate<\/h3>\n\n\n\n<ol><li>Electricity Bill<\/li><li>Rent agreement or lease agreement<\/li><li>Pan Card<\/li><li>Aadhar Card<\/li><li>Municipality or Industry license for trading business<\/li><li>Health Trade License<\/li><li>Site Plan\/layout<\/li><li>CA Letter on the financial breakup of the scrap trading business<\/li><li>GST certificate<\/li><li>Form-V under Rule 14 of the Environmental (Protection) Act<\/li><li>Authorisation Letter<\/li><li><a href=\"https:\/\/corpbiz.io\/factory-license\"><strong>Factory\/Trade License<\/strong><\/a><\/li><li>Proof of Registration of unit under Companies Act or LLP Act<\/li><li>Consent to establish a certificate<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Hazardous_Waste_Authorisation\"><\/span>Hazardous Waste Authorisation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Authorisation relating to\ntransboundary movement of hazardous waste that includes the import of rubber\nscrap is regulated under The Hazardous Wastes (Management, Handling and\nTransboundary Movement) Rules, 2008.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents mandated for submission<\/h3>\n\n\n\n<p>The documents which are required while\nsubmitting the application for hazardous waste Authorisation are: &#8211;<\/p>\n\n\n\n<ul><li>CTO<\/li><li>CTE<\/li><li>Certificate of incorporation (CIN)\/LLP<\/li><li>Memorandum Of Association<\/li><li>Article of Association<\/li><li>Board resolution for appointing an authorised person<\/li><li>Aadhar card<\/li><li>PAN copy<\/li><li>GST certificate of business<\/li><li>Layout Plans<\/li><li>Factory license\/Trade license<\/li><li>Rent\/proof of ownership<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"NOC_from_MoEF_the_Ministry_of_Environment_Forest_Climate_Change\"><\/span>NOC from MoEF (the Ministry of Environment, Forest &amp;\nClimate Change)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The no objection certificate granted\nby the Ministry of Environment, Forest and Climate Change is mandatory for\nhazardous substances, including the import of rubber scrap.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents Submitted<\/h3>\n\n\n\n<p>The documents that are to be submitted\nby the importer to get permission from the ministry for the import of rubber\nscrap are: &#8211;<\/p>\n\n\n\n<ul><li>SIMS Registration<\/li><li>KYC Documents<\/li><li>Consent Certificate from the\nconcerned State Pollution Control Board<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Process for Acquiring NOC from the Ministry of\nEnvironment, Forest and Climate Change<\/h3>\n\n\n\n<p>As per the provisions provided by the\nministry, the importer has to submit a report to declare the nature and type of\nrubber scrap, w.r.t to the guidelines of the customs circular on Hazardous\nWaste Rules. After the complete submission of the Report to the Ministry of\nEnvironment, Forest and Climate Change, only then is NOC granted from MOEF. On\nthe basis of this certificate, the clearance process for rubber scrap import is\ncommenced with the customs authority.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Guidelines_to_be_followed_for_Import_of_Rubber_Scrap\"><\/span>Guidelines to be followed for Import of Rubber Scrap<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>The importers have to mandatorily foremost a record on the rubber scrap handled for inspection by the ministry. <\/li><\/ul>\n\n\n\n<ul><li>The importers have to make sure that importing unit must be accompanied by the mandated paperwork. <\/li><\/ul>\n\n\n\n<ul><li>The importers, for permission, have to submit an online application and hard copy.
