Transboundary Movement) Rules, 2016, E-Waste\n(Management) Rules, 2016, Plastic Waste Management Rules, 2016 and Bio-Medical\nWaste Management Rules, 2016, Water (Prevention &amp; Control of Pollution)\nAct, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1974 and Air (Prevention &amp; Control of Pollution) Act, 1981<\/strong><sup><a href=\"https:\/\/cpcb.nic.in\/water-pollution\/\"><strong>[1]<\/strong><\/a><\/sup>, have delegated its power and functions to DPCC, headed by Chairman also acts as a regulatory body for the implementation of environmental laws and policies of NCT of Delhi.<\/p>\n\n\n\n<p><strong>The main functions of DPCC include:<\/strong><\/p>\n\n\n\n<ul><li>Issuing of\n     the Consent form to different manufacturing units falling under green and\n     orange categories.<\/li><li>Issuing\n     Authorisation to health care services like hospitals, Blood Banks, Clinics\n     etc.<\/li><li>Act as an\n     Advisory body for the Delhi Government on matters concerning air and water\n     pollution prevention and control.<\/li><li>Spread\n     awareness on prevention, control and abatement of water and Air pollution\n     by organising through mass media.<\/li><li>Conduct\n     research on data relating to water and Air pollution as well as Prepare\n     and compile a technical manual and guidelines relating to the treatment of\n     sewage and trade effluents.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Application_of_Consent_and_its_types\"><\/span>Application of Consent and its types<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Water Act, 1974\nand the Air Act, 1981 stipulate that &#8220;<em>any industry, operation or\nprocess or an extension and addition thereto, which likely to discharge\nsewerage or trade effluent into the environment or likely to emit any air\npollution into the atmosphere will have to obtain the consent.\u201d<\/em><\/p>\n\n\n\n<p>Delhi Pollution\nControl Committee provide two different types of Consent, which include DPCC\nConsent to establish and DPCC Consent to operate.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">DPCC Consent to establish<\/h4>\n\n\n\n<p>The manufacturer\nrequires DPCC Consent to establish to start a business or enterprise stipulated\nmandatory under the Water Act, 1974 and the Air (Prevention &amp; Control of\nPollution) Act, 1981. To acquire the Consent to establish, the manufacturer\nmust fill the application within the given format attaching the required\ndocument and fees,, which is then followed by Inspection.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">DPCC Consent to Operate<\/h4>\n\n\n\n<p>After the\nindustry is established along with all the machines and pollution control\ndevices and the unit is ready to operate, the DPCC Consent to operate is\nrequired.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"DPCC_Consent_to_operate\"><\/span>DPCC Consent to operate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>DPCC Consent to\noperate is provided by the manufacturer when the industry is established as per\nthe stipulated norms under the Water (Prevention &amp; Control of Pollution)\nAct, 1974 and the Air (Prevention &amp; Control of Pollution) Act, 1981, along\nwith this have received Consent to establish, and the unit is ready to function.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_to_obtain_DPCC_Consent_to_operate\"><\/span>Documents required to obtain DPCC Consent to operate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>Pan Card<\/li><li>Aadhar Card<\/li><li>Authorisation\n     Letter<\/li><li>Municipality\n     or Industry license<\/li><li>Factory\/Trade\n     License<\/li><li>Health Trade\n     License<\/li><li>Proof of\n     Registration of unit<\/li><li>CA Letter\n     for the total cost of the project<\/li><li>Site Plan<\/li><li>FSSAI\n     Certificate (for food-related business)<\/li><li>Electricity\n     Bill<\/li><li>Proof of\n     ownership<\/li><li>Water Bill<\/li><li>GST\n     certificate<\/li><\/ol>\n\n\n\n<p>Along with this\nManufacturer, for Consent to operate, also have to show a Copy of the last\nConsent (Consent to establish), the Layout plan for the manufacturing process\nand the latest analysis report of solid waste effluent, hazardous waste and\nfuel gases.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Different_Categories_of_Industries_stipulated_by_DPCC\"><\/span>Different Categories of Industries stipulated by DPCC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>On the basis of\ntype of work and amount of pollutant produced by the units, these are divided\ninto different categories.<\/p>\n\n\n\n<ul><li>White\n     Category include industries which are the least polluting units and do not\n     require a Consent certificate.<\/li><li>Green\n     includes industries with a pollution index somewhere between 21 and 40.<\/li><li>Orange\n     Category includes industries with a higher pollution index than the green\n     category, somewhere between 41 and 59. These include industries that work\n     with acid, batteries, electric motors, transformers etc.<\/li><li>The red\n     category includes most polluting industries emitting highly hazardous\n     pollutants and is not allowed to operate in Delhi jurisdiction. These\n     industries include the duel oil industry, explosive industry, automobiles,\n     mining etc.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Industries_that_require_DPCC_Consent_to_operate\"><\/span>Industries that require DPCC Consent to operate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Manufacturing\n     entities<\/li><li>E-Waste\n     management entities<\/li><li>Solid Waste\n     Management industry<\/li><li>Health care\n     establishments<\/li><li>Traders<\/li><li>Plastic\n     Waste Management entities<\/li><li>Bio-Medical\n     Waste management entities<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_obtain_DPCC_Consent_to_operate\"><\/span>Procedure to obtain DPCC Consent to operate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>The required\n     application form is to be filled from the official site of the concerned\n     state pollution authorities must be filled and uploaded within mandated\n     provisions.<\/li><li>Then the\n     stipulated documents, and the fees, are to be uploaded on the official\n     site.<\/li><li>Once they\n     are uploaded, the application is sent to the authorised personnel for\n     revision which is then followed by personal Inspection and preparation of\n     a detailed analysis report which is submitted to the sub-regional officer.<\/li><li>At last,\n     after this, the application is either approved or rejected.<\/li><\/ol>\n\n\n\n<p>It is beneficial\nto keep in mind that no proposed industry is allowed within the approved\nresidential area stipulated by Municipal Corporation. No orange or red category\nindustries must be established within the municipal corporation limits barring\nthe industrial areas\/zone.<\/p>\n\n\n\n<p>Once the DPCC\nconsent to operate is given, the certificate remains valid for a period of 5\nyears for the red category industries, ten years for the orange category\nindustries and 15 years for the green category industries. For CTO, renewal is\nto apply through Online Consent Management &amp; Monitoring System before the\nexpiration of previous DPCC Consent to operate.<\/p>\n\n\n\n<p>The Air and\nWater Act also states the penalty in case any industry falling into\ngreen\/orange or red is operating without obtaining Consent. The penalty\nincludes imprisonment for a term which may extend to 3 months or a fine which\nmay extend to ten thousand rupees or with both.
