As per Rule 3(dd), &#8220;Producer Responsibility Organization&#8221; means a professional organization authorized or financed collectively or individually by producers, which can take responsibility for the collection and channelization of e-waste generated from the &#8220;end-of-life&#8221; of their products to ensure environmentally sound management of such e-waste.&#8221;<\/p>\n\n\n\n<p>They are\nresponsible for the viable collection and transportation of plastic or E-Waste\nin an environmentally friendly and sustainable way. Another main function of\nthe Producer Responsibility organization helps the producers or manufacturers\nto achieve their mandated target set by the state pollution control board of\nthat particular state.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In the extended producers&#8217;\nresponsibility model, the producers&#8217; responsibility organization is one of the\nmost important stakeholders responsible for setting up, designing, and\nmaintaining a waste management system.<\/p>\n\n\n\n<p>It was recorded\nthat by the end of May 2020, India will have 34 producer responsibility\norganizations (PRO) registered under the stipulated rules with the name\navailable in the public domain on the official website of the Central Pollution\nControl Board.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Different_Producers_Responsibility_Organization_Model\"><\/span>Different Producers&#8217; Responsibility Organization Model<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>PRO can implement\nEPR through different models:-<\/p>\n\n\n\n<ol><li>PRO As a\n     Private Organization<\/li><li>PRO as a\n     non-profit Corporation<\/li><li>PRO as a\n     state-run institution\/ Authority&nbsp;&nbsp;<\/li><\/ol>\n\n\n\n<p>However, the\nproducers&#8217; responsibility organization model does not impact the amount or\nproportion of plastic waste\/E-waste to meet the obligations delegated to the\nproducers by the state pollution control board.&nbsp; &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Functions_of_Producers_Responsibility_Organisation\"><\/span>Functions of Producers Responsibility Organisation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The most important\nfunctions of producers&#8217; responsibility organization involve:-<\/p>\n\n\n\n<ol><li>The producer&#8217;s      primary responsibility is to achieve the stipulated goals set up by the      state pollution control board for producers as part of fulfilling extended      producers&#8217; responsibility.<\/li><li>Implementing      a proper and sustainable collection mechanism for efficiently and      effectively collecting the waste.<\/li><li>Implementing      the policy of buyback and taking back properly<\/li><li>Managing      and ensuring the environmentally friendly way of dismantling and recycling      the waste collected<\/li><li>Managing      the documents and logistics<\/li><li>Assisting      the producers with the annual\/quarterly returns filing as per stipulated      provisions.<\/li><li>The      function of the producer&#8217;s responsibility organization also includes      providing an effective EPR action plan as instructed by the legislation.<\/li><li>Conducting      various programs to spread general awareness regarding the collection and      channelization of waste among producers\/Consumers or bulk consumers.<\/li><li>Collection      centres\/points are to be established by the Producers Responsibility Organisation. As per the recommendations      published by the Central Pollution Control Board, this may entail the      establishment of the collection godowns or the operation of warehouses.<\/li><li>Ensure the      traceability of e-waste collected and channelled, as well as the disposal      of processed waste and end-of-life plastic garbage.<\/li><\/ol>\n\n\n\n<p>Along with these,\nPRO is also required to specify its capacity for handling waste, including\ncollection, storage and the data on the recyclers it has contracts with to\nproperly manage this waste.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Recognition_and_Registration_of_Producers_Responsibility_Organization\"><\/span>Recognition and Registration of Producers&#8217; Responsibility\nOrganization<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For registration and recognition of PRO, the owner had to primarily submit an application form to the central pollution control board as prescribed under the annexure part of the E-Waste and Plastic waste management rules. Although E-Waste management rules do not recommend any minimum obligation for registering Producers Responsibility Organisation, the plastic waste management rules do have minimum requirements, which include:-<\/p>\n\n\n\n<ol><li>The\n     producers&#8217; responsibility organization should be registered by a statutory\n     body.<\/li><li>These\n     organizations must have a minimum experience of five years in waste\n     management, including municipal solid waste and plastic waste.<\/li><li>They must\n     be properly recognized and have success stories on the proper disposal of\n     municipal solid waste and plastic waste.<\/li><li>They must\n     have TAN, PAN, and GST Numbers.<\/li><\/ol>\n\n\n\n<p>Nevertheless, of\nthese minimum requirements, the Central pollution control board has the\nauthority to properly scrutinize, verify, and examine the submitted application\nand make their decision accordingly. The Central pollution control board have\n25 days to respond to the submitted applications. Once the registration is\ndone, it will be valid for three years as per E-Waste management rules which\ncan be renewed before 60 days of its expiry. If there are any discrepancies,\nthe appeal shall be made to the central pollution control board chairman.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Challenges_Faced_By_Producers_Responsibility_Organization\"><\/span>Challenges Faced By Producers&#8217; Responsibility Organization<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>With multiple\nproducer responsibility organizations emerging in India and constant changes in\nnorms, it is expected that the market for these organizations will be\nfavourable. However, in reality, the PRO sector is still struggling to find a\nplace in India due to a lack of proper accountability, transparency, and\nlegitimacy. The major challenges faced by the PROs include lack of\nsustainability or long-life commitment, lack of awareness among people and\nconsumers, and lack of proper supervision in the waste management sector, which\nhave led to corruption and malpractices. Lack of proper infrastructure and\ncollection points are also the factors contributing to the failure and closure\nof many producers&#8217; responsibility organizations in India.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To fulfil the EPR expectations, it is very important that the functions of the producers&#8217; responsibility organization are properly implemented and solidify the inducements for sustainable products and packaging. Along with that, the policies need to be implemented at the individual level to avoid the dilution of the incentives.
