OCED defines it as&nbsp;<em>an\nenvironmental policy approach in which a producer&#8217;s responsibility for a\nproduct is extended to the post-consumer stage of a product&#8217;s life cycle.&nbsp;<\/em>It\nwas first coined in 1990 by Thomas Lindhqvist of Sweden in&nbsp;<em>Models for Extended Producer\nResponsibility, which<\/em>&nbsp;involve a shift in the burden of\nresponsibility from the government or state to the manufacturer or producers of\nwaste management and environmental protection. After this, it was implemented\nworldwide by various international schemes, Germany being the first to\nimplement it in 1991.<\/p>\n\n\n\n<p>The concept of <a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/epr-authorization-for-e-waste\"><strong>EPR<\/strong><\/a> responsibility is based on three foundation principles that are &#8220;Pollution prevention approach&#8221;, &#8220;life cycle thinking&#8221;, and &#8220;Polluter pay principle&#8221;.<\/p>\n\n\n\n<p>EPR responsibility\nmakes it the responsibility of the producers not only to take back products for\nrecycling but also to design better and longer life products to minimize the\namount of waste generated which is defined as the root cause of a gradual\nincrease in environmental pollution.<\/p>\n\n\n\n<p>E-Waste\n(management and handling) Rules, 2016 adopted Extended Producers Responsibility\nfor the first time in India, Stipulating that the producers are responsible for\nsetting up collection centres for e-waste and financing and organizing a system\nfor environmentally sound management of e-waste. Similar provisions were\nincluded in Plastic Waste Management Rules, 2016, laying down that producers of\nwaste are mandated to ensure that generation of plastic waste is minimized, and\nplastic waste is not littered and stored at the source, which is then handed\nover to local bodies or authorized agencies.<\/p>\n\n\n\n<p>Under these rules,\nthe producers have a responsibility to delegate this responsibility to the\nthird party or specialized organizations which manufacturers can financially\naid for proper waste management.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Advantages_of_EPR_Responsibility\"><\/span>Advantages of EPR Responsibility<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>By\n     adopting the EPR responsibility approach, producers get financial\n     incentives to design and produce more environmentally sound and\n     sustainable products to escape from the added cost of waste management and\n     recycling.<\/li><li>EPR\n     responsibility has opened the market to the new and innovative business of\n     Producers Responsibility Organisation waste management, which is proving\n     to be more lucrative for business owners and the environment.<\/li><li>EPR\n     responsibility puts more pressure on developed countries that are major\n     contributors to exporting E-Waste to developing countries to build their\n     recycling units and facilities.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"EPR_responsibility_Policies_in_India\"><\/span>EPR responsibility Policies in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>EPR responsibility in India, as mentioned above, is only extended to plastic and Electronic waste, the guidelines and regulations for which are mentioned in the Plastic waste management rules and the <strong>E-Waste<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Electronic_waste\"><strong>[1]<\/strong><\/a><\/sup> management rules. Ministry of Environment, Forest and Climate change define EPR responsibility as&nbsp;the responsibility of the producer for the environmentally sound management of the product until the end of its life.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">EPR Responsibility Policies under E-Waste Management Rules<\/h3>\n\n\n\n<p>E-Waste management\nrules were implemented to provide guidelines for efficient and proper\nmanagement and recycling of E-Waste in India, which include all and any\nelectronic material ranging from small SIM to Refrigerators.<\/p>\n\n\n\n<p>EPR responsibility\nunder E-Waste (management) Rules, 2016 stipulates collection targets of E-Waste\nfor producers, whether be it in weight or number, which shall be 30% of the\nestimated amount of waste generated in the first two years of the\nimplementation of the rules following 40% in 3rd and 4th year, 50% in 5th year\nand 6th year as well as 70% during 7th year onwards. Some other regulations\ninvolve:-<\/p>\n\n\n\n<ul><li>Implementation\n     of EPR responsibility by producers either through the take-back system or\n     by setting up collection centres or both to channel the E-Waste to\n     registered recycler or dismantler.<\/li><li>To spell\n     their EPR responsibility Plan for approval by the Central pollution\n     control board, the producers are required to have an arrangement with\n     dismantlers and recyclers through either the Producers responsibility\n     organization or the E-Waste exchange system.<\/li><li>Marketing\n     or selling any electronic equipment without EPR responsibility\n     Authorization is considered a violation of the rules.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">EPR responsibility Policy under Plastic Waste Management\nRules<\/h3>\n\n\n\n<p>The government\nrecently, through notification, have announced The Plastic Waste Management\n(Amendment) Rules, 2022, which provide guidelines for strengthening the\ncircular economy of plastic packaging waste as well as promoting alternatives\nto plastic.<\/p>\n\n\n\n<p>These new\nguidelines also include EPR responsibility Regulations such as:-<\/p>\n\n\n\n<ul><li>The\n     producers and manufacturers should provide details by July 20th 2022, of\n     recycling certificates from authorized recyclers along with the amount\n     sent for end-of-life disposal, which online portals will further\n     cross-check<\/li><li>In the\n     above case, if the figures are lower, they would be considered to fulfil\n     the EPR responsibility obligations of the producers, importers and brand\n     owners.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"EPR_responsibility_Certificate\"><\/span>EPR responsibility Certificate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>EPR responsibility\nCertificate is authorized by Central Pollution Control Board under MoEFCC,\nGovernment of India, which is mandatory for Producers\/Importers of the\nElectronic products.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Required Documents for Proprietor&nbsp;<\/h3>\n\n\n\n<ol><li>IEC\n     (Importer Exporter Code)&nbsp;<\/li><li>Sole\n     proprietor or KYC Authorized Signatory<\/li><li>Submit the\n     rent or lease proof.<\/li><li>Excel\n     sheet including details of imported products.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Required Documents for Public Limited Company or Private\nLimited Company&nbsp;&nbsp;<\/h3>\n\n\n\n<ol><li>Earlier\n     mentioned documents.<\/li><li>Memorandum\n     of Association.<\/li><li>Certification\n     of Incorporation (CIN).<\/li><li>Company&#8217;s\n     PAN card.<\/li><li>Board\n     Declaration for Authorized Signatory.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_of_obtaining_EPR_responsibility_Certificate\"><\/span>Process of obtaining EPR responsibility Certificate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>The\n     application form is to be filled with all the relevant details, including\n     the name of the producer, details of the electronic devices, etc.<\/li><li>The\n     information should also contain the details of the estimated generation of\n     E-Waste and estimated target collection for the impending year, along with\n     an overall strategy to fulfil Extended Producers Responsibility.<\/li><li>After the\n     information is filled, then the application form is submitted along with\n     the required document, which will then be reviewed by CPCB.<\/li><li>If the\n     applications are submitted as per the guidelines, the EPR responsibility\n     certificate will be provided by CPCB.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Challenges\"><\/span>Challenges<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>While CPCB, while\nimplementing the EPR responsibility policies, have done an admirable job, the\nmajor challenges like in EPR responsibility policy itself as the regulations\nfail to define each stakeholder&#8217;s individual responsibility, making it more\nconfusing for them to understand. Apart from this, due to the vast reach of\nillegal recycling units among the general public finding a lucrative and\nprofitable market for legal recycling plants has become very difficult and\ncostly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>With the influx in the number of Electronic products and new technology in the market, the recent years have seen an increase in E-Waste. EPR responsibility aims to decrease this influx by putting the responsibility on the producers to create a better product with better technology that can last longer.
