These batteries are believed to have\na shelf life of three to five years, after which it is considered as battery\nscraps which are hazardous in nature and is highly regulated in regard to Cross\ncountry movement. Lead battery scarp is available everywhere in the forms of\nWet Whole Intact Batteries (RINK), Drained\/Dry Whole Intact Lead Batteries\n(RAINS) and Lead Battery Plates (RAILS).<\/p>\n\n\n\n<p>Many countries\nexport scrap batteries to India. The financial value of scrap battery imports\nin 2020-21 was 893 million dollars, up from 152.9 million dollars in 2018.\nBattery imports have increased year after year, especially between 2014 and\n2018. India has purchased scrap batteries from the United States, with exports\nvalued at $106.5 million in 2020-21 and Malaysia, with the values close to\n72.89 Million USD.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legislations_Governing_Battery_Scrap_Import_License_in_India\"><\/span>Legislations Governing Battery Scrap Import License in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">The Batteries (Management and handling) Rules, 2001<\/h3>\n\n\n\n<p>The <strong>Batteries (Management and Handling) Rules, 2001<\/strong>, were enacted to ensure the safe and secure disposal of discarded batteries with lead-acid along with regulating the sale and import of lead-acid batteries. This legislation also provides guidelines for applying for battery scrap import licenses in India and recycling these scraps in a sustainable way. These rules are applicable to anyone who is a Manufacturer, Importer, Re-conditioner, Assembler, Dealer, Recycler, Auctioneer and Bulk Consumer or whoever is involved in the process of manufacturing, exporting, import and use of batteries and their scraps.<\/p>\n\n\n\n<p>According to laid\nrule 5 of the Batteries (Management and handling) Rules, 2001 Ministry of\nEnvironmental and Forest have delegated the power to grant registration to the\nimporters to the Central Pollution Control Board. Hence registration of importers\nwith CPCB is necessary.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Personnel Who Are Required To Register Under Batteries (Management\nand Handling) Amendment Rules, 2010<\/h4>\n\n\n\n<ol>\n<li>Importers<\/li>\n\n\n\n<li>Recyclers<\/li>\n\n\n\n<li>Assemblers<\/li>\n\n\n\n<li>Manufacturers<\/li>\n\n\n\n<li>Dealer<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Hazardous Waste Management Rules, 2016<\/h3>\n\n\n\n<p>Hazardous waste\nmanagement rules, 2016 was enacted to regulate industries, units, plants or\noperations which are involved in the generation or consumption of hazardous\nwaste mentioned under the act. The industry involved in such a process under\nthis rule is required to obtain authorization or registration from the\ncompetent Authority.<\/p>\n\n\n\n<p>These rules also\nensure the secure treatment, import, storage, transportation, collection,\nhandling and disposal of hazardous waste.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Duties_of_Importers_under_the_Act\"><\/span>Duties of Importers under the Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul>\n<li>Importers\n     need to ensure that used batteries are collected back as per the\n     regulations, excluding those that are sold back to the original\n     manufacturer or producers. Also, the used batteries that are collected are\n     similar to those new batteries which are sold.<\/li>\n\n\n\n<li>Importers\n     are required to file half yearly returns of their sale and buyback by 30\n     June and 30 December to the state board on form 1.<\/li>\n\n\n\n<li>Importers\n     also have to send the used batteries or battery scarps to the registered\n     recyclers.<\/li>\n\n\n\n<li>It is also\n     important to ensure that regulated transportation of scrap batteries is\n     done to registered recyclers with no damage to the environment done.&nbsp;\n     &nbsp;<\/li>\n\n\n\n<li>Create\n     general awareness among the public on the hazards of lead through various\n     forms of media.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Registration_for_Battery_Scrap_Import_License_in_India\"><\/span>Registration for Battery Scrap Import License in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol>\n<li>The application      is to be submitted to the <strong><a href=\"https:\/\/corpbiz.io\/state-pollution-control-board-spcb-noc\">State Pollution Control Board<\/a><\/strong> by the recycler      who has the license from the state pollution control board for recycling      such material and wanting to import scrap batteries.<\/li>\n\n\n\n<li>After the\n     application is submitted state pollution control board will then move\n     forward along with the recommendations and stipulations for secure\n     transport. This must be reverted within 30 days of receipt of the\n     applications.<\/li>\n\n\n\n<li>After\n     this, NOC is provided by the state government to the importer if he\/she\n     has submitted an authorized consent letter with an authenticated copy from\n     authorities of the state exporting.<\/li>\n\n\n\n<li>This\n     certification is viable to both recyclers and traders on the basis of\n     which an importer can start battery scrap import.<\/li>\n<\/ol>\n\n\n\n<p>Further, under the\nrules, the importer has to adhere to certain guidelines, including maintenance\nof record of waste imported in Form 3 for making it available to the\nauthorities; along with this, the importer should also file an annual return in\nForm 4 to state pollution Control Board.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_Required_For_Battery_Scrap_Import_License_in_India\"><\/span>Documents Required For Battery Scrap Import License in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The document the\nprocess is: &#8211;<\/p>\n\n\n\n<ol>\n<li>Commercial\n     Invoice<\/li>\n\n\n\n<li>Import\n     License<\/li>\n\n\n\n<li>Bill of\n     landing<\/li>\n\n\n\n<li>Insurance\n     Certificate<\/li>\n\n\n\n<li>Industrial\n     License<\/li>\n\n\n\n<li>Bill of\n     entry<\/li>\n\n\n\n<li>Purchase\n     order\/Letter of credit<\/li>\n\n\n\n<li>Technical write-up,\n     literature, etc., for specified goods, if any.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The import and recycling of battery scraps in India will result in lesser waste and lesser burden on a landfill and a more sustainable way of completing the constant rise of battery scrubs in India.
