In India, it is mandatory for every person who intends to open a drug shop needs to obtain <a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/drug-license\"><strong>Drug License<\/strong><\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Meaning of Drugs&nbsp;<\/h2>\n\n\n\n<p>Section\n3 of the Drugs and Cosmetics Act defines drugs. The drug includes all medicines\nas well as devices used for human beings or animals internally or externally. All\nsubstances used for or in the diagnosis, treatment, mitigation or prevention of\nany disease or disorder in human beings or animals, including preparation\napplied on the human body for the purpose of repelling insects. It also\nincludes all substances that can be used for the destruction of insects and all\ncomponents of drugs.&nbsp;<\/p>\n\n\n\n<p>In\n1964, an amendment took place where Ayurvedic and Unani drugs were also\nincluded in the meaning of drugs.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Drug Shop License&nbsp;<\/h2>\n\n\n\n<p>A drug License is made mandatory under the <strong>Drugs and Cosmetics Act, 1940<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/2409\/1\/a1940-23.pdf\"><strong>[1]<\/strong><\/a><\/sup> for business in India. This Act consolidates all laws related to drugs and cosmetics in India. The purpose of a Drug License is to permit or allow individuals or entities to engage in businesses related to drugs and cosmetics.<\/p>\n\n\n\n<p>There\nis a variety of drugs, and so are multiple numbers of drug shops. All the drug\nshops established in India require a drug license. The drug shop cannot be\nopened without an appropriate license. If an individual or entity operates its\ndrug business in more than two states, it must obtain it in each state where it\noperates.&nbsp;<\/p>\n\n\n\n<p>A drug License is location-specific. A drug license ensures quality compliance in drug shops at all times during its business is carried on. All records\/forms\/registers are maintained as specified by licensing authorities. And if the change is made in the drug shop, then it should be informed to the licensing authorities.&nbsp;<\/p>\n\n\n\n<p>A\ndrug license is valid for five years; however, it can be suspended or cancelled\nin between those five years by the Drug Department. It should be renewed before\nthe expiry of the original one.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Prerequisite for Drug Shop License<\/h3>\n\n\n\n<p>The\nprerequisites for obtaining a drug license are as follows:<\/p>\n\n\n\n<ul>\n<li><strong>Competent drug shop\nowner\/pharmacist<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>A\npharmacist or individual who owns a drug shop must be qualified in case he is\nin a retail business. And in the case of wholesale business, he must be a\ngraduate with one year of experience or an undergraduate with experience of\nfour years.<\/p>\n\n\n\n<ul>\n<li><strong>Space in shop<\/strong><\/li>\n<\/ul>\n\n\n\n<p>The\nrequirement of space means the area of the shop, and it is a very important\nprerequisite. The area of a shop having a drug business should be 10 square\nmeters. The area and height of the shop should be as per the guidelines stated\nby the National Building Code of India, 2005.<\/p>\n\n\n\n<ul>\n<li><strong>Storage facility<\/strong><\/li>\n<\/ul>\n\n\n\n<p>The\nstorage facility is another important prerequisite because some drugs are\nrequired to be stored in low temperatures. So, the air conditioners and\nrefrigerators are a must at the shop, and they must be in proper working\ncondition.&nbsp;&nbsp;<\/p>\n\n\n\n<ul>\n<li><strong>Technical  staff<\/strong><\/li>\n<\/ul>\n\n\n\n<p>The\ntechnical staff means the pharmacy staff at the drugs shop should have depth\nknowledge. The staff of the wholesale pharmacy shop must be a graduate with one\nyear of experience or an undergraduate with four years of experience.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Types of Drug Shop License&nbsp;<\/h3>\n\n\n\n<p>There\nare two types of licenses for the sale of drugs in a Drug Shop. These types are\nas follows:<\/p>\n\n\n\n<ul>\n<li><strong>Wholesale License:<\/strong><\/li>\n<\/ul>\n\n\n\n<p>Wholesale means the sale of drugs to a person or retailer for further sale of such drugs. A drug wholesaler needs to obtain a <strong><a href=\"https:\/\/corpbiz.io\/wholesale-drug-license\">wholesale license<\/a><\/strong>.<\/p>\n\n\n\n<ul>\n<li><strong>Retail License:<\/strong><\/li>\n<\/ul>\n\n\n\n<p>A retail sale means the sale of drugs to end consumers. Retailers can sell drugs to dispensaries, hospitals, and educational or research institutes. A <strong><a href=\"https:\/\/corpbiz.io\/retail-drug-license\">retail license <\/a><\/strong>is required for such retail sale of drugs and by retailers who are engaged in pharmaceuticals, cosmetics, ayurvedic shops, pharmacists, etc.\u00a0\u00a0<\/p>\n\n\n\n<p>So,\nanyone who is engaged in the wholesale or retail sale of drugs needs to obtain\na Drug License.&nbsp;&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Drug Shop License: Eligibility&nbsp;<\/h3>\n\n\n\n<p>The\neligibility criteria to obtain a Drug License for the sale of drugs are as\nfollows:<\/p>\n\n\n\n<ul>\n<li>Pharmacists registered under State Pharmacy Council<\/li>\n\n\n\n<li>A  graduate with at least one year of experience in pharma marketing and has passed SSLC<\/li>\n\n\n\n<li>An individual with four years of experience in pharma marketing and has passed SSLC<\/li>\n\n\n\n<li>A person approved by Drug Control Department.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Drug Shop License: Required Documents<\/h3>\n\n\n\n<ul>\n<li>Appropriate Application Form<\/li>\n\n\n\n<li>A copy of the Challan\u00a0<\/li>\n\n\n\n<li>ID such as PAN Card, Passport, Driving License, Voter ID, etc.<\/li>\n\n\n\n<li>A copy of Property Papers<\/li>\n\n\n\n<li>Proof of storage Availability<\/li>\n\n\n\n<li>Proof of Qualification of Registered Pharmacist and competent person<\/li>\n\n\n\n<li>Registration from State Pharmacy Council<\/li>\n\n\n\n<li>Experience Certificate<\/li>\n\n\n\n<li>Any other required document<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Drug Shop License: Procedure&nbsp;<\/h3>\n\n\n\n<p>The\nsteps involved in procedure for obtaining Drug License are as follows:<\/p>\n\n\n\n<ul>\n<li><strong>First step:<\/strong>\u00a0Applicant submits request letter along  with firm details<\/li>\n\n\n\n<li><strong>Second Step:<\/strong>\u00a0Applicant prepares documents and  affidavits as prescribed by law.<\/li>\n\n\n\n<li><strong>Third Step:<\/strong>\u00a0Applicant files application with the prescribed government fee.\u00a0<\/li>\n\n\n\n<li><strong>Fourth Step:<\/strong>\u00a0The application is marked for Inspection. The Drug Inspector personally visits the concerned shop to verify the documents and to check the correctness of details provided by      the applicant.\u00a0<\/li>\n\n\n\n<li><strong>Fifth Step:<\/strong>\u00a0After completion of the Inspection and verification process, the Controller of Drugs issues the License.\u00a0<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>The Drug License is obtained by manufacturers, retailers, wholesalers, importers, or anyone involved in the drug-related business. One running a drug shop needs to obtain a Drug Shop License by fulfilling the eligibility criteria and all the conditions prescribed by law. The State Drug Standard Control Organisation (SDSCO) is the authority to grant a Drug License for the sale of drugs. The sale of drugs is divided into two categories, wholesale and retail sales.
