Due to this Ministry of Environment, Forest and Climate Change has delegated this responsibility to the Central and <a href=\"https:\/\/corpbiz.io\/state-pollution-control-board-spcb-noc\"><strong>state pollution control board<\/strong><\/a>.<\/p>\n\n\n\n<p>One of these responsibilities is granting a Consent certificate to the entrepreneurs, either online or offline. Still, with such a large country, it becomes very difficult for one authority to keep in check the activities under each state. Therefore, to delegate the responsibility of the Central Pollution Control Board, the state pollution control board for each state were established under Section 4 of The Water (Prevention and Control of Pollution) Act, 1974. The member of the State Pollution Control Board is nominated by Central\/State Governments whose primary functions are mentioned under The Water (Prevention and Control of Pollution) Act, 1974 and The Air (Prevention and Control of Pollution) Act, 1981. <\/p>\n\n\n\n<p>Some of these\nfunctions are:-<\/p>\n\n\n\n<ul><li>The State\n     Pollution Control Board is the statutory body established to plan,\n     monitor, cement, research and development as well as educate and train on\n     pollution Control.<\/li><li>Design and\n     execute the comprehensive programme for the prevention, control or\n     reduction of Air and water pollution.<\/li><li>Advise state\n     in the matters concerning prevention, control or reduction of Air and\n     water pollution<\/li><li>Collaborate\n     with the Central Pollution Control Board regarding the training of\n     personnel who are or are to be engaged in programs related to prevention,\n     control or reduction of Air and water pollution.<\/li><li>Assist in\n     technical aspects as well as guide investigations and research in relation\n     to issues of increasing Air and water pollution and prevention, control or\n     reduction of Air and water pollution.<\/li><li>Determine or\n     modify the standard for streams or wells and the quality of Air in\n     collaboration with the State Government.<\/li><li>Assist state\n     government in matters relating to the location of the premises of any\n     industries that are likely to cause Air and water pollution.<\/li><li>SPCB is\n     headed by Chairman, followed by Member Secretary.<\/li><\/ul>\n\n\n\n<p>The state\npollution control board is also responsible for providing Certificates to\nindustries of Consent to establish or Consent to operate.<\/p>\n\n\n\n<p>West Bengal also\nhas its own state pollution control board having the power to grant WBPCB\nConsent to establish online.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Certificate_of_Consent\"><\/span>Certificate of Consent<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Before\nestablishing any manufacturing business\/Production plan, it is very important\nto acquire a Certificate of Consent from the State Pollution Control Board. A\ncertificate of Consent is deemed mandatory for any production units under The\nWater Act, 1974 and The Air Act, 1981. The units which come under E-Waste\n(Management) Rules, Hazardous and Other Wastes (Management and Transboundary\nMovement) Rules, Plastic Waste (Management) Rules and Bio-Medical Waste\n(Management) Rules. They are also required to apply for the Consent Certificate\nunder The Water Act, 1974 and The Air Act, 1981.<\/p>\n\n\n\n<p>Certificate of\nConsent is granted by the State Pollution Control Board under Section 17 (f) of\nThe Water Act, 1974, which stipulates that &#8220;<em>to inspect sewage or trade\neffluents, works and units for the treatment of sewage and trade effluents and\nto scrutinize plans, specifications or other data relating to plants set up for\nthe treatment of water, works for the purification thereof and the system for\nthe disposal of sewage or trade effluents or in connection with the grant of\nany consent as required by this Act;&#8221; <\/em>and Air (Prevention and\nControl of Pollution) set the procedure for establishing under Section 21.<\/p>\n\n\n\n<p><strong>As per the governing laws, the Certificate of Consent is acquired in two parts:<\/strong><\/p>\n\n\n\n<p>Consent To\nEstablish \u2013 Consent To establish properly known as NOC (No objection\nCertificate) are mandated to be acquired for the new industry as per The Water\nAct, 1974 and The Air Act, 1981. This Consent Certificate is provided by the\nState Pollution Control Board, for example, the West Bengal Pollution Control\nBoard, as per the categories of the industries like Red Category, Orange\nCategory, Green Category, White Category, and Exempted.<\/p>\n\n\n\n<p>Consent to\nOperate- Consent To operate is mandated to be acquired for the industry, which\nhas already established all the operating units as per the No Objection\nCertificate issued by the state pollution control board as per The Water Act,\n1974 and The Air (Prevention and Control of Pollution) Act, 1981. The\nindustries applying for a Certificate to operate are also categorized as Red\nCategory (Industries coming under the Red category are categorized as producing\nmaximum pollution with the highest pollution Index score of 60 and above. These\nindustries are banned from any ecologically fragile area\/protected area),\nOrange Category (Industries that have a higher pollution index of 41 to 59 are\ncategorized under Orange Category. These include Lime manufacturing units,\nglass-making industries, Pharmaceutical formulation etc.), Green Category\n(Industries having a pollution index of 21 to 40 come under the green\ncategory), White Category (Industries having the least amount of pollutants\nreleased is up to 20. The industries included in white categories are not\nmandated to obtain Consent to operate. The simple information sent to SPCB\/PCC\nis enough) and Exempted according to the pollution or hazard that may be caused\ndue to its operation. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"WBPCB_Consent_to_establish_online\"><\/span>WBPCB Consent to establish online<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As explained\nabove, Consent to establish is granted by the concerned state in which the\nindustry or manufacturing units are operating. For establishing new industry\nstate pollution control board has sited restrictions, especially while\nselecting land, which the upcoming entrepreneurs are required to keep in\nconsideration.<\/p>\n\n\n\n<p>For every different type of industry, there are different issuing authorities for granting <a href=\"https:\/\/corpbiz.io\/noc-from-west-bengal-state-pollution-control-board\"><strong>WBPCB Consent<\/strong><\/a> to establish online.<\/p>\n\n\n\n<ul><li>Small Scale\n     Industry (Green and Orange) &#8211; DIC, Officer-in-charge, Sub DIC<\/li><li>Medium Scale\n     (Green and Orange) and Small and medium scale (Red) \u2013 Regional Offices of\n     WBPCB<\/li><li>All\n     large-scale units \u2013 O&amp;E Cell of WBPCB at head offices<\/li><li>All EC\n     attracting units \u2013 EIM Cell of WBPCB at head office<\/li><li>Brickfield \u2013\n     DL &amp; LRO<\/li><li>Stone\n     crusher \u2013 BDO &amp; SDO<\/li><\/ul>\n\n\n\n<ol><li>The Consent\n     to establish is acquired by the entrepreneurs\/Manufacturers from the state\n     pollution control board through their official site, after which the No\n     Objection Certificate is granted, whose validity last for seven years.<\/li><\/ol>\n\n\n\n<ol><li>The\n     Application for Consent to establish is submitted with the applicable fees\n     through online payment and required documents.<\/li><li>After\n     submitting the application, it is reviewed by the authority, followed by a\n     personal inspection by the officer.<\/li><li>After\n     inspection, the report is made on the basis of the visit, on the basis of\n     which the Certificate to Consent is provided.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Documents required for submitting WBPCB Consent to\nestablish online<\/h3>\n\n\n\n<ul><li>Any\n     Documents related to Land (Rent receipt, rent agreement, porch, Lease\n     agreement, land deed)<\/li><li>Gross\n     Capital Investment Certificate (Self-certified undertaking)<\/li><li>Project\n     reports consisting of details on effluent, solid waste management,\n     emission, finished products, raw materials, and manufacturing process,\n     including the list of machinery.<\/li><li>The\n     self-certified site plan\/layout with road map\/route map<\/li><li>SSI\n     Certificate of Partners\/Directors, Industry Department Certificate<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Nowadays, it is very easy for entrepreneurs to acquire WBPCB Consent to establish online because of the less confusing process and time-saving methods. But then also, many a time, producers\/manufacturers because for some reason, do not obtain the Certificate making it very difficult for the government to keep in track of the environmental aspect.
