In the last six years,\nthe Import of electrical and electronic equipment (EEE) has increased at a pace\nof 12.3% per year, with a negative growth rate in 2019\u201320.<\/p>\n\n\n\n<p>Therefore\nE-Waste Management rules, 2016 dictate regulations regarding Import which\ninclude:-<\/p>\n\n\n\n<ul><li>EEE\n     (Electric and Electronic Equipment) will only be imported to the producers\n     having EPR Certification and authorization that is permission given by\n     CPCB (Central Pollution Control Board) as stipulated under Section 5(3) of\n     the E-Waste Management Rules, 2016.<\/li><li>Along with\n     submitting the Application for EPR, the importers also have to submit the\n     Extended Producers\u2019 Responsibility action plan.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Documents accompanying the Application<\/h3>\n\n\n\n<ul><li>Extended\n     Producers\u2019 Responsibility Plan, which involves the policies adopted by the\n     importer for channelization, collection and disposal of E-Waste generated\n     by EEE Import<\/li><li>Awareness\n     Plan<\/li><li>The amount\n     the importer is planning to spend for the execution of waste management<\/li><li>Compliance\n     with the reduction of Hazardous Substances provisions.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Liabilities of the importers<\/h3>\n\n\n\n<p>Under clause 21\nof the Rules, 2016, importers are held liable for any damage they have caused\nto the environment or any other party because of their mishandling and\nmismanagement by the importer. They may also be asked to pay a fine under\nE-Waste (Management) Rule, 2016.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Export_of_E-Waste\"><\/span>Export of E-Waste<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per the data\navailable, India has 90 E-Waste Scrap Export Shipments with around 15 suppliers\nmainly exported to Myanmar, Hong Kong and South Korea. The Export of E-Waste in\nIndia is governed by many different enforcing agencies like the Ministry of\nEnvironment, Forest and Climate Change, Central Pollution Control Board, State\nPollution Control Board, Directorate General of Foreign Trade and Port Authority\nand customs Authorities under the Customs Act, 1964.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"List_of_E-Waste_that_can_be_exported\"><\/span>List of E-Waste that can be exported<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Due to the high\ntoxicity of E-Waste, the Exporters have to keep in mind before seizing the\nE-Waste business opportunity the approved list of E-Waste that can be exported.\nThe E-Waste that can be exported are:-<\/p>\n\n\n\n<ul><li>Waste\n     Electrical and electronic assemblies or scrap.<\/li><li>Used\n     multifunction print and copying machines.<\/li><li>Clean,\n     uncontaminated metal scrap, including alloys, in bulk, finished form\n     (sheet, plates, beams, rods etc.) of Antimony scrap &#8211; Beryllium scrap &#8211;\n     Cadmium scrap &#8211; -Lead waste (excluding lead-acid batteries) &#8211; Selenium\n     scrap &#8211; Tellurium scrap. Etc.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Documents required for setting up Export E-Waste Business\nOpportunity<\/h3>\n\n\n\n<p>The following\nare the documents needed for the issuance of the license for E-Waste\nExportation \u2013<\/p>\n\n\n\n<ul><li>Permission\n     Certificate \/ License from Ministry of Environment, Forest and Climate\n     Change for export of E-Waste<\/li><li>NOC from the\n     Ministry of Environment, Forest and Climate Change<\/li><li>Consent\n     Letter from State Pollution Control Board under Air and Water Act.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Procedure for acquiring the license for Export of E-Waste<\/h3>\n\n\n\n<ul><li>For the      export of E-Waste, the person needs to apply to the Ministry of      Environment, Forest and Climate Change<\/li><li>In order to      acquire permission to export E-Waste, the applicant is required to show a      physical presence of business in India<\/li><li>Then they      are required to obtain NOC from the Ministry of Environment, Forest and      Climate Change and State Pollution Control Board.<\/li><li>Following      NOC, the exporter needs to get the prior consent\/permission from the      company where the waste is being exported, which is not only a condition      in India but is also a regulation under International Convention.<\/li><li>After      receiving the permission, the consent will be forwarded from the <strong>Ministry of Environment, Forest and Climate Change<\/strong><sup><a href=\"https:\/\/moef.gov.in\/en\/\"><strong>[1]<\/strong><\/a><\/sup> to the concerned state pollution      Control Board as per the E-Waste (Management) Rules, 2016, along with the      State pollution control board of the state where the port is situated and      the port and customs authority which are required to ensure the compliance      of the conditions of export permission.\u00a0\u00a0<\/li><li>Before      Exporting the E-Waste, the exporter needs to keep a couple of things in      mind:<\/li><\/ul>\n\n\n\n<ol><li>No       Export is done without prior consent from importing countries<\/li><li>Form       6 (Movement Document) should accompany the shipment<\/li><li>The       records of the E-Waste should be maintained.<\/li><\/ol>\n\n\n\n<ul><li>The      no-objection certificate or NOC granted by the Ministry of Environment,      Forest and Climate Change remains valid till the validity of the Consent      Certificate issued under the Air and Water Act by the <a href=\"https:\/\/corpbiz.io\/state-pollution-control-board-spcb-noc\"><strong>state pollution Control Board<\/strong><\/a>, which may vary from state to state.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Although due to\nthe large E-Waste production in India, import or dumping of E-Waste under\nHazardous and Other Waste (Management and Transboundary Movement) Rules, 2016\nis declared illegal, the E-Waste from developed countries is still imported\ninto India under the pretence of refurbished and re-exportation second-hand\ngoods. This becomes possible due to the lack of proper regulations and resources\nof the nodal body of excise, which have resulted in a staggering amount of\nE-Waste in India.
