The different\nstakeholders may include producers, manufacturers, consumers and Brand Owners\nwho have the liability and Responsibility to properly manage the waste created\nby them during the manufacturing process.<\/p>\n\n\n\n<p>This\nResponsibility bestowed upon the producers\/Importers\/Brand Owners to properly\nmanage the waste produced is called extended producers&#8217; Responsibility. In\nIndia, EPR is the statutory obligation of the producers that is part of the\nsustainable business practice governed by the Ministry of environment, forest\nand climate change, regulated under the plastic waste and E-Waste management\nRules. Later with the enactment of\ndifferent acts, including the Air (Prevention &amp; Control of Pollution) Act,\n1981 and The Environment (Protection) Act, 1986, the scope of Responsibility of\nthe Central Pollution Control board was widened to accommodate the new acts.<\/p>\n\n\n\n<p>Although these\nacts are governed by the Ministry of Environment, Forest and Climate change,\nMoEFCC has delegated the Responsibility to the central pollution control board\nto overlook the activities of the enterprises, industries or any other\nconcerning the matter which comes under the domain of the environment law.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Functions of Central Pollution Control Board<\/h3>\n\n\n\n<p>The primary functions of CPCB are mentioned under <strong>The Water (Prevention &amp; Control of Pollution) Act, 1974 and The Air (Prevention &amp; Control of Pollution) Act, 1981<\/strong><sup><a href=\"https:\/\/cpcb.nic.in\/water-pollution\/\"><strong>[1]<\/strong><\/a><\/sup>, which are:-<\/p>\n\n\n\n<ol><li>CPCB has the\n     Responsibility to promote the cleanliness of wells and water bodies\n     located in the different parts of the states via the prevention, reduction\n     and control of Water Pollution.<\/li><li>Also, to\n     improve the Air quality via prevention, reduction and control of Air\n     Pollution.<\/li><\/ol>\n\n\n\n<p>CPCB is also\nallocated with the additional National level function, apart from these primary\nfunctions. Some of them are:-<\/p>\n\n\n\n<ol><li>Act as an\n     advisory body for the Central Government regarding matters related to the\n     management of Air and Water pollution.<\/li><li>Design and\n     execute the countrywide program with regard to the management of Air and\n     Water Pollution.<\/li><li>Overlook the\n     functions and activities of the state pollution Control Board and resolve\n     any differences occurring among them.<\/li><li>Act as an\n     assisting body for state pollution control board by providing them\n     technical guidance along with this also participate and sponsor in the any\n     investigation and research happening in the matter of management of Air\n     and Water Pollution.<\/li><li>Design and\n     execute the training sessions for personnel involved in programs related\n     to the management of Air and Water Pollution.<\/li><li>Organised a\n     comprehensive awareness program with the help of various mass media on\n     prevention, reduction and control of Air and Water Pollution.<\/li><li>Organise for\n     statistical and technical data collection compilation and publication\n     relating to air and water pollution as well as design plans and measures\n     for its management.<\/li><li>Recognise or\n     institute labs for the board to carry out its functions.<\/li><li>Perform any\n     functions which are directed by the Government of India.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_is_CPCB_EPR_registration_beneficial\"><\/span>Why is CPCB EPR registration beneficial?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>CPCB EPR\nRegistration is beneficial not only for Producers\u2019\/Importers\/Brand Owners but\nalso for the central pollution control board\/State Pollution Control Board by\nproviding them with pore to keep in track of the activities of the\nProducers\u2019\/Importers\/Brand Owners who have acquired CPCB EPR registration.<\/p>\n\n\n\n<p>Apart from this,\nthe Producers\u2019\/Importers\/Brand Owners are benefitted because:-<\/p>\n\n\n\n<ul><li>They provide\n     proper guidelines and procedures for the treatment of waste.<\/li><li>It provides\n     incentives to Producers\u2019\/Importers\/Brand Owners to curb pollution related\n     to plastic products or electrical products.<\/li><li>It urges the\n     producers\/Manufacturers to make sustainable products by using renewable\n     resources.<\/li><li>It sets\n     standards for manufacturing in order to provide assistance to\n     Producers\/Manufacturers.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_of_CPCB_EPR_Registration\"><\/span>Process of CPCB EPR Registration.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Extended\nproducers&#8217; Responsibility in India is mandated under two laws E-Waste\n(Management) Rules and Plastic waste (Management) Rules.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">CPCB EPR Registration under Plastic Waste (Management)\nRules<\/h3>\n\n\n\n<p>Producers\u2019\/Importers\/Brand\nOwner have to acquire CPCB EPR registration under the Plastic Waste (Management)\nRules. They have three alternatives for the execution of the extended\nproducers&#8217; Responsibility action plan:-<\/p>\n\n\n\n<ol><li>Plastic      Waste Management through direct engagement with Urban Local Body<\/li><li>Plastic      Waste Management through engagement with waste management agency (WMA),      which in turn should engage with Urban Local Body.<\/li><li>Plastic Waste Management by their own distribution channel.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Process of registration<\/h3>\n\n\n\n<p>The process of\nCPCB EPR registration involves procedure with the following steps:-<\/p>\n\n\n\n<ol><li>Producers\u2019\/Importers\/Brand\n     Owners are required to apply for the CPCB EPR Registration by filling up\n     an application giving detailed information on the plant\/enterprise and\n     personal details. This application can be filled out through the online\n     registration portal with the required application.<\/li><li>Producers\n     are required to submit the FORM I. In contrast, every manufacturer is\n     required to file FORM III, and every recycler or person involved in the\n     recycling process is required to fill FORM II.<\/li><li>The\n     application filled according to the forms is to be submitted along with\n     the documents required.<\/li><li>The\n     documents are to be attested or signed by the concerned authority.<\/li><li>After the\n     application is filled out, the form is submitted to the appropriate\n     authority.<\/li><li>The CPCB or\n     the concerned Pollution Control Committee examine the application for\n     shortcomings which is then communicated to the applicant within seven\n     working days.<\/li><li>In case the\n     applicant has not responded within thirty days, the application is\n     presumed to be withdrawn.<\/li><li>Suppose,\n     within 30 days of the filing of the complete application with the required\n     document, there is no response from the central pollution control board.\n     In that case, the registration certificate will be presumed to have been\n     generated.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Documents required for CPCB EPR Registration under Plastic\nWaste Management Rule<\/h3>\n\n\n\n<ol><li>More than two\nstates&#8217; proof of sale (GST\/tax invoice, etc.)<\/li><li>If the unit has\na production facility, a DIC certificate is required.<\/li><li>If the unit\ncontains a production facility, valid consents under the Air and Water Act are\nrequired.<\/li><li>Documents\npertaining to the EPR Liability Action Plan (by state\/UT)<\/li><li>Document\nrelating to PIBO\/WMA engagement issued by ULB \/ authorised state authority (as\napplicable)<\/li><li>SPCBs\/PCCs issue\nregistrations to PWPF in order for them to work with them on PW processing.\nPIBO\/WMA enters into a PW processing agreement with PWPF (as applicable)<\/li><li>WMA and PIBO\nhave reached an agreement (as applicable)<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">CPCB EPR Registration under E-waste (Management) Act<\/h3>\n\n\n\n<p>CPCB EPR\nRegistration of the producers&#8217; of Electrical and Electronic Equipment (EEE) as\nstipulated under Rule 13 (1), (2), (3) and (4) of E-Waste Management Rules,\n2016.<\/p>\n\n\n\n<ol><li>The      application under Form 1 is to be filled by the applicant, which will      include the details information about the operating plant as well as      producers&#8217;.<\/li><li>Details on      E-Waste generation of Electric or Electronic equipment item-wise are to be      provided along with approximate target collection for the upcoming year.<\/li><li>Extended      Producers&#8217; Responsibility action plan information needs to be provided.<\/li><li>The      application form submitted should accompany the required document.<\/li><li>After      submission, the application will be reviewed by Central Pollution Control      Board.<\/li><li>After the      application is reviewed, the <a href=\"https:\/\/corpbiz.io\/epr-registration\"><strong>EPR Certificate<\/strong><\/a> will be provided by CPCB.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\">Documents required under E-Waste Management Rules<\/h3>\n\n\n\n<p>Documents\nrequired for OPC\/LLP\/Sole Proprietor and partnership firm<\/p>\n\n\n\n<ol><li>Importer\n     Exporter Code<\/li><li>Authorized\n     Signatory KYC or Sole proprietor&nbsp;<\/li><li>&nbsp;submit\n     the rent or lease proof to demonstrate the ownership of the site<\/li><li>Excel sheet\n     including details of imported products.<\/li><li>GST\n     Certificate<\/li><\/ol>\n\n\n\n<p>Documents\nRequired for Private or Public Limited Company<\/p>\n\n\n\n<ol><li>Memorandum\n     of Association.<\/li><li>Earlier\n     mentioned documents.<\/li><li>Certification\n     of Incorporation (CIN).<\/li><li>Company&#8217;s\n     PAN card.<\/li><li>Board\n     Declaration for Authorized Signatory.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>CPCB EPR registration makes sure that the activities of the producers in regard to their extended producers&#8217; Responsibility remain on track and regulated. But to strengthen the regulations regarding the operation of EPR more, the Government introduced a new draft of the EPR framework for uniform EPR in 2022. These guidelines are accompanied by the prohibition of identified single-use plastic that has low utility and high littering potential.
