The owner of the premises where the restaurants\nare situated or the owners of such restaurants, or the landlord do not take\nadequate measures to comply with the fire department&#8217;s requirements.&nbsp;<\/p>\n\n\n\n<p>The\nGovernment of India has taken measures in order to ensure that every building\nor any other similar occupancy has a secure form of NOC of the fire department.\nEvery commercial or residential building, which is more than 12 meters, should\nhave the NOC from the fire department before starting its business\/operation.\nAnd hence, it is important for every restaurant to obtain NOC from the fire\ndepartment of their respective state. Before granting such NOC, the authority\ncarries out a proper inspection to ensure that the restaurant is complying with\nthe rules or laws related to fire safety. The set\nstandards are mentioned under the BIS requirements and the concerned state\nauthority. The BIS, on a regular basis, issues certain standards which are\nrequired to be followed.&nbsp;<\/p>\n\n\n\n<p>The\nfire department inspects the fire safety standards before granting the NOC to\nthe restaurants. However, these standards are different in different\nstates.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirements_of_the_fire_NOC_for_Restaurants\"><\/span>Requirements of the fire NOC for Restaurants<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The <a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/fire-department-noc-in-india\"><strong>fire NOC<\/strong><\/a> is required for the following reasons:<\/p>\n\n\n\n<ul><li>Fire\n     NOC is an essential requirement for a trade license to carry out trading\n     activities.<\/li><li>For\n     carrying out any form of activity or business, fire NOC is mandatorily\n     required.<\/li><li>Fire\n     NOC acts as evidence that the safety precautions are there and no harm is\n     going to be caused to any individual.<\/li><li>Fire\n     NOC ensures the health and well-being of the people working on the premises.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Checklist_for_the_Fire_NOC_for_restaurants\"><\/span>Checklist for the Fire NOC for restaurants&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nfollowings are the checklist to be taken care of before obtaining the fire NOC:<\/p>\n\n\n\n<ul><li>Pre-construction\n     Requirements<\/li><li>Post-construction\n     Requirements<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Pre-construction Requirements<\/h3>\n\n\n\n<p>The\napplicant fulfils the following requirements before starting the construction\nof the building for the restaurants:<\/p>\n\n\n\n<ul><li>The\n     applicant gives information related to the premises, such as name,\n     location, and other required information.<\/li><li>The\n     applicant provides the blueprint or the sanction plan along with the proof\n     of proper fire systems installed.<\/li><li>After\n     receiving the application, the department sends a fire safety officer to\n     make sure that the fire safety compliances are maintained. Such inspection\n     is carried out after ten days of receiving the application.&nbsp;<\/li><li>When no\n     issue is discovered, then a provisional NOC is granted to the applicant.<\/li><li>Any\n     recommendation or suggestion by the fire department is taken care of by\n     the applicant. Recommendations are immediately implemented.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Post Construction Requirements<\/h3>\n\n\n\n<p>The\napplicant carries out the following requirements after the construction of the\nrestaurants:<\/p>\n\n\n\n<ul><li>The\n     fire department officer carries out the requirements of a fire safety\n     audit. The technical officer revisits the restaurant to carry out the surveillance\n     related to the building.&nbsp;<\/li><li>Recommendations\n     are given by such officers that are forwarded to the head of the\n     department to secure a final NOC.<\/li><li>The\n     fire NOC is granted only when the head of the department approves its\n     application.&nbsp;<\/li><\/ul>\n\n\n\n<p>Before the construction of the restaurant is completed, the provisional NOC from the fire department is granted to the applicant after conducting a proper investigation. The fire safety audit is compiled after the inspection. After obtaining the provisional NOC, the applicant commences the construction by complying with the fire safety audit report requirements. When the construction is complete, then another inspection is done by the fire department, and after a successful inspection, the final fire NOC is granted.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_for_the_fire_NOC_for_Restaurants\"><\/span>Documents required for the fire NOC for Restaurants<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Every\nstate authority has prescribed different forms of documents for the fire NOC,\nwhich are required to be submitted to the required authority. However, the\nfollowings are the basic documents that are required to obtain the Fire NOC:<\/p>\n\n\n\n<ul><li>Site\n     plan with the analysis report of the property\/restaurant<\/li><li>Model\n     of building\/restaurant<\/li><li>The\n     registered office of the restaurant<\/li><li>Fire\n     compliance certificate<\/li><li>Checklist\n     prepared by the architect<\/li><li>Copy of\n     Aadhar Card and PAN Card<\/li><li>Photographs\n     of the building\/restaurant (clicked inside and outside)<\/li><li>Information\n     on wiring in the restaurant<\/li><li>Any\n     other analysis as per the requirement by the certified\/authorised officer\n     related to safety compliance.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_obtain_Fire_NOC_for_Restaurants\"><\/span>Procedure to obtain Fire NOC for Restaurants<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\napplicant may apply for the fire NOC online and offline. The following are the\nsteps that are followed while obtaining the fire NOC:<\/p>\n\n\n\n<ul><li>The\n     applicant files the application with all the required documents and\n     submits the same to the appropriate authority. The application is mostly\n     submitted to the <strong>Chief Fire Officer<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Chief_fire_officer\"><strong>[1]<\/strong><\/a><\/sup> or the Fire Service Department in offline mode.&nbsp;<\/li><li>Once\n     the CFO or the department receives the document, then he verifies the\n     documents.<\/li><li>After\n     verification of the documents, the same is forwarded to an officer of the\n     respective state authority.<\/li><li>The\n     inspector or the officer visits the restaurant or the premises to carry\n     out a report related to the fire safety audit.&nbsp;<\/li><li>After\n     the inspection is done and it is found that all the measures of fire\n     safety are followed, then the chief inspector issues a NOC for the\n     restaurant.&nbsp;<\/li><\/ul>\n\n\n\n<p>The\nfire NOC granted to a restaurant is valid for a period of 3 years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Renewal_of_fire_NOC_for_restaurants\"><\/span>Renewal of fire NOC for restaurants&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After\nthe expiry of the fire NOC, the applicant renews it by following these steps:<\/p>\n\n\n\n<ul><li>For\n     renewal of the NOC, the same mode is always followed, which was opted at\n     the time of obtaining the original one.&nbsp;<\/li><li>The\n     applicant submits the renewal application with a declaration stating that\n     all the necessary electric installations are complied with by him.&nbsp;<\/li><li>If the\n     application for renewal is not made on time, then the applicant will pay\n     charges as per the period of delay. The charges with the period of delay\n     are mentioned here:<\/li><\/ul>\n\n\n\n<table class=\"table table-bordered\"><tbody><tr><td>\n  <strong>Delay (in days)<\/strong>\n  <\/td><td>\n  <strong>Charges (in Rupees)<\/strong>\n  <\/td><\/tr><tr><td>\n  0-7 days\n  <\/td><td>\n  No charges\n  <\/td><\/tr><tr><td>\n  7-15 days\n  <\/td><td>\n  Rs. 5\/per day\n  <\/td><\/tr><tr><td>\n  More than 15 days\n  <\/td><td>\n  Rs. 15\/per day\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<ul><li>However, the\ncharges\/penalty payable by the applicant depends on each state&#8217;s\nrequirements.&nbsp;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There is a need for the fire NOC for restaurants. Each restaurant, before its construction starts, must obtain the fire NOC. The provisional fire NOC is granted by the fire department of the respective state, and then the construction of such a restaurant begins. The provisional NOC is granted after the inspection of the location and verification of documents. The final NOC is granted after the restaurant is constructed and further, inspection is done. The fire NOC that is granted to the restaurant is valid for three years only. The appropriate authority grants the renewal of such NOC after inspecting the restaurant once again.
