The essential objective of the <a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/legal-metrology-act-registration\"><strong>Legal Metrology<\/strong><\/a> Packaged Commodities Rules, 2011 is to ensure that a public guarantee is being provided for the terms of determining the security and accuracy of Weighments and Measurements.<\/p>\n\n\n\n<p>There are a few provisions enacted through\nthe Constitution of India for Weights and Measures that are stated as follows \u2013<\/p>\n\n\n\n<ul><li>Under the Union List, Entry 50,\nit is stated about the establishment of the set Standards Weights and Measures\nwhere the Entry establishes the framework for the Acts and rules in accordance\nwith the Legal Metrology of Packaged\nCommodities, specifications in regard to the set standards and the relation of\nthe Weighments and Measurements on an international level, the training\nrequirements of Legal Metrology, etc.<\/li><li>Under\nthe Concurrent List, Entry 33 A, it is stated about the enforcement of the laws enacted in relation\nto the Legal Metrology.<\/li><\/ul>\n\n\n\n<p>The <strong>Legal Metrology Act<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/\"><strong>[1]<\/strong><\/a><\/sup>, 2009 was implemented by the Department of Consumers Affairs, under\nthe governance of the Indian Government for the purpose of enacting provisions\nspecifically covering provisions of the now repleaded act \u2013<\/p>\n\n\n\n<ul><li>Standards of Weights and\nMeasures Act, 1976,<\/li><li>Standards of Weights and\nMeasures (Enforcement) Act, 1985.<\/li><\/ul>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_82_2 counter-hierarchy ez-toc-counter ez-toc-grey ez-toc-container-direction\">\n<div class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The following are the Rules enacted by the\nDepartment of Consumers Affairs, under the governance of the Government of\nIndia, to be read along with the Legal Metrology Act, 2009 \u2013<\/p>\n\n\n\n<ul><li>The Legal Metrology (General)\nRules, 2011,<\/li><li>The Legal Metrology (Packaged\nCommodities) Rules, 2011,<\/li><li>The Legal Metrology (Approval\nof Modules) Rules, 2011,<\/li><li>The Legal Metrology (National\nStandards) Rules, 2011,<\/li><li>The Legal Metrology (Numeration)\nRules, 2011,<\/li><li>Indian Institute of Legal\nMetrology Rules, 2011,<\/li><li>Legal\nMetrology (Government Approved Test Center) Rules, 2013.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Declarations_for_each_Packaged_Commodity\"><\/span>Declarations for each Packaged Commodity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In accordance with the Legal Metrology Act\nand the Legal Metrology Packaged Commodities\nRules, the definition of a \u201cPre-Packaged Commodity\u201d is any commodity that\nis packaged without the presence of the purchaser; whatsoever may be the nature\nof the product being packaged, no matter whether sealed or not, the commodity\nthat is packaged is to have a Pre-Determined Quantity. The commodity becomes a\nPackaged Commodity when brought to the final stage of the sale in retail to the\nCustomer.<\/p>\n\n\n\n<p>In accordance with the Legal Metrology Packaged Commodities Rules, the Department\nof Consumers Affairs has enacted certain declarations to be mandatorily\nfollowed for each and every type of packaged commodity, which are mentioned as\nfollows \u2013<\/p>\n\n\n\n<ul><li>The Details of the Name and\nAddress of the Producer, Packager, and Importer of the Packaged Commodity.<\/li><li>In the case of Imported\nPackaged Commodity, the Country of Origin of the Product<\/li><li>The Generic Name of the\nPackaged Commodity.<\/li><li>The Net Quantity of the\nPackaged Commodity, strictly in accordance with the set Standard Unit of the\nWeights and Measures or in Numerical.<\/li><li>Date, Month and Year of the\nPackaged Commodity\u2019s Production, Packaging, and Importation.<\/li><li>The Maximum Retail Price, also\nknown as MRP, of the Packaged Commodity that is Inclusive of all Taxes, in INR.<\/li><li>The Customer Care Details of\nthe Producing Company.<\/li><\/ul>\n\n\n\n<p>Along with the Rules mentioned above to be\nfollowed mandatorily, the government in the Legal\nMetrology Packaged Commodities Rules has implied that 19 Commodities are to be Packaged\nin the prescribed sizes as mentioned in the Regulations that is in the interest\nof the Customer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Legal_Metrology_Packaged_Commodities_Amendment_Rules\"><\/span>The Legal Metrology (Packaged Commodities) Amendment Rules<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>With Reference to the Notification issued\non 2<sup>nd<\/sup> November 2021, amendments in relation to the Legal Metrology Packaged Commodities Rules were\nscheduled to come into effect on 1<sup>st<\/sup> April 2022, which is\nrescheduled with an extension on 1<sup>st<\/sup> October 2022, as per the recent\nNotification issued by the Government of India on 28<sup>th<\/sup> March 2022 in\naccordance with the amended LMPC Rules that is also to come on effect on the\nsame date.<\/p>\n\n\n\n<p>The below\nmentioned are the essential clarifications made to the Legal Metrology Packaged\nCommodities Rules that are to be enforced from the effective date \u2013<\/p>\n\n\n\n<ul><li>There will be no further requirement\nfor mentioning the Unit Sale Price in accordance with the amended LMPC Rules as\nthe new amendment states that the Unit Sale Price of the Packaged Commodity is\nto be equal to the Retail Sale Price. <\/li><li>Prosecution against the Producer\nor Packager or the Importer of the Pre-Packaged Commodity is prohibited even if\nthe Producer or Packager or the Importer is utilising the amended labels from 1<sup>st<\/sup>\nApril 2022.<\/li><li>As Rule 5 of the LMPC Rules is\nomitted in accordance with the latest amendment, the Second Schedule of the Legal Metrology Packaged Commodities Rules, 2011 is\nalso to be revoked that states the list of Packaged Commodities that are\nrequired to be in accordance with the Standard Quantities.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Clarifications for the USP under the latest Amendment<\/h3>\n\n\n\n<p>The below mentioned are the clarifications\nmade for the Unit Sale Price, also known as the USP, in accordance with the\nlatest amendment of the Legal Metrology Packaged\nCommodities Rules \u2013<\/p>\n\n\n\n<ul><li>The Unit Sale Price of the\nPackaged Commodity is to be estimated to the nearest two decimal numbers.<\/li><li>If the Net Quantity, length,\nvolume, number, etc., of the Packaged Commodity, is lesser than 1 kilogram,\nmeter, litre, number, etc., then the Unit Sale Price is to be declared in\naccordance with the applicable gram, centimetre, millilitre, number, etc.<\/li><li>The Unit Sale Price is not\nneeded to be mentioned in the Pre-Packaged Commodity when the Retail Sale Price\nis to be equal to the Unit Sale Price.<\/li><li>For Packaged Commodities\ncontaining liquor or any other alcoholic based beverages, the State Excise Laws\nand Rules enacted will be mandated only in the State of the Packaged Commodity\nbeing manufactured.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Due to the Extension provided, the Producer, Packager, and Importer have been furnished with an additional time frame to conform in accordance with the Amendment Rules 2021.
