The <a href=\"https:\/\/corpbiz.io\/noc-from-west-bengal-state-pollution-control-board\"><strong>West Bengal Pollution Control Board<\/strong><\/a> requires all units starting operations in West Bengal to obtain a NOC called the Consent to Operate (CTO) after getting the consent to establish. Based on the pollution and hazard potential of the industry, the West Bengal pollution control board consent to operate is granted into Red,\u00a0Orange and Green categories. Once the industry is established along with the required pollution control systems, the entrepreneur must obtain consent to operate the unit. This consent is given for a particular period, which must be renewed periodically. West Bengal pollution control board consent to operate is awarded for 7 years for Green Category and 5 years for Orange and Red category industries. The NOC issuing Authority for the West Bengal\npollution control board consent to operate is as follows.<\/p>\n\n\n\n<ul><li>For Small Scale Green Category industry, the GM,\nDIC, Sub- DIC or the officer in charge is the consent issuing authority.<\/li><li>For Small and Medium Scale Orange and Red category\nindustry (other than EC attraction unit) and for Medium scale Green Category\nIndustry the Regional Office (RO) of WBPCB will be the consent Issuing\nauthority for both new applications and renewals.<\/li><li>For EC attracting units, the O&amp;E cell of the\nWBPBC will be the consent issuing authority<\/li><li>For Brickfield units, the DL and LRO will be the\nconsent issuing authority, while for the Stone crushing industry, the BDO and\nSDO will be the consent issuing authority.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Location_Policy_applicable_under_the_West_Bengal_pollution_control_board_consent_to_operate\"><\/span>Location Policy applicable under the West Bengal pollution\ncontrol board consent to operate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Apart from the type of industries\ncategorised by the CPCB, there are&nbsp;some location policies and site\nrestrictions for Red, Orange and Green category industries in the state. For\nissuing the West Bengal pollution control board consent to operate, the WBPCB\nwill inspect the site and oversee its compliance with environmental laws.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Location_Policy_for_Red_Category_Industries\"><\/span>Location Policy for Red Category Industries<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>No red category industry is permitted within the municipal areas of <strong>Kolkata Metropolitan Area<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Kolkata_metropolitan_area\"><strong>[1]<\/strong><\/a><\/sup> (KMA) and within municipal areas of the Burdwan district (except Jamuria Industrial Estate). However, a red category industry can be set up beyond the municipal areas of KMA and Burdwan district with an adequate pollution abatement system subject to site clearance by the local authority. However, few of the notified industries under the red category may be considered within KMC and Burdwan but will be location-specific.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Location_Policy_for_Orange_Category_Industry\"><\/span>Location Policy for Orange Category Industry<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Orange category industry is not\npermitted within Kolkata Municipal Corporation (KMC) and Howrah Municipal\nCorporation (HMC) areas (except industrial estates in KMC and HMC area) as per\nthe guidelines issued by the WBPCB. However, such an industry can be set up beyond\nthe KMC and HMC areas and industrial estates in KMC and HMC areas with adequate\npollution control measures subject to site clearance by the local authority. However,\na few of the notified industries in the orange category can be considered within\nKMC and HMC but will be location-specific. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Location_Policy_for_Green_Category_Industry\"><\/span>Location Policy for Green Category Industry<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Setting up a Green category industry is\npermitted in any area of West Bengal as per the guidelines issued by WBPCB,\nprovided that it has adequate pollution control measures and is subjected to\nsite clearance by the local authority. However, for a few of the notified the Green\ncategory industry, the consideration for siting will be location-specific and decided\nby the Board.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Location_Policy_for_White_Category_Industry\"><\/span>Location Policy for White Category Industry<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There is no necessity to obtain West\nBengal pollution control board consent to operate<\/p>\n\n\n\n<p>for the White Category of industries. A\nsimple intimation to WBPCB is sufficient. However, it may be noted that some\nspecific white category industries are not permitted in municipal areas and\ncongested areas of West Bengal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_for_West_Bengal_pollution_control_board_consent_to_operate\"><\/span>Process for West Bengal pollution control board consent to\noperate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For applying for West Bengal pollution\ncontrol board consent to operate, the following procedure needs to be followed<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Submitting the Application<\/h3>\n\n\n\n<p>WBPCB has streamlined the application\nprocess for different categories of industries. The applicant needs to identify\ntheir category and fill the respective application form with all relevant\ninformation and documents.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fee for West Bengal pollution control board consent to operate<\/h3>\n\n\n\n<p>Application Fee for the West Bengal\npollution control board consent to operate can be submitted in offline or\nonline mode and is decided by the WBPCB as per the category in which the\nparticular industry falls. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Documents needed for obtaining West Bengal pollution control board consent to operate<\/h3>\n\n\n\n<p>The following documents are needed by the\nWest Bengal pollution control board\nconsent to operate.<\/p>\n\n\n\n<ul><li>Any land related document (rent agreement,\n     porcha, lease document, rent receipt, land deed as applicable)<\/li><li>Gross Capital Investment Certificate (Self-certified\n     undertaking)<\/li><li>Self-certified site plan\/layout along with road\n     map\/route map<\/li><li>A detailed report of the project along with\n     details of emission, effluent, solid waste management plan, raw materials,\n     finished products, and manufacturing process, including a list of\n     machines.<\/li><li>Copy of Consent to Establish (NOC) Certificate <\/li><li>Test Reports for emission\/effluent (done within\n     the last year)<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Inspection of the unit for West Bengal pollution control board consent to operate<\/h3>\n\n\n\n<ul><li>Before granting the consent to Operate certificate\nand renewal, the WBPCB inspects the site and verifies the information declared\nin the application form. The inspection is carried out by the inspecting\nofficer in the presence of the owner or their representative. <\/li><li>The inspecting officer will collect all the required\ninformation in the prescribed inspection report. During Inspection, the inspecting\nofficer can also collect wastewater samples, hazardous waste and ground\/\nsurface water, depending upon the requirement. In the case of a legal sample,\nthe procedure given in the Water (P&amp;CP) Act is followed.<\/li><li>The inspecting officer shall inform about any\nnon-compliance orally and record it in the inspection report.<\/li><li>Based on the Inspection Report, the West Bengal\npollution control board consent to operate will be issued.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Testing <\/h3>\n\n\n\n<p>A few\ncertified laboratories have also been notified for testing the samples for the West\nBengal pollution control board consent to operate. The Central\nLaboratory&nbsp;at Kolkata and&nbsp;five Regional Laboratories&nbsp;at\nBarackpore, Hooghly, Haldia, Durgapur and Siliguri are authorised to perform\nquality and standardisation tests needed for the West Bengal pollution control\nboard consent to operate. These labs are also tasked with assessing water\nquality and conducting various R&amp;D projects in specific areas of interest. WBPCB\nhas also prescribed standard Sampling and Analysis charges which may be needed for\nthe West Bengal pollution control board consent to operate certificates for\nboth fresh and renewal applications.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Renewal for West Bengal pollution control board consent to operate<\/h3>\n\n\n\n<p>Renewal application to be submitted 120\ndays before the expiry of the previous certificate. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Consent to Operate is an important NOC\nissued by an SPCB\/PCC that will ensure the smooth running of the business. New\napplication for Consent to Operate usually requires a comprehensive analysis of\nthe applicable laws and environmental regulations beforehand so that there are\nno objections raised in the subsequent stages. CTO for fresh and renewal will\nonly be granted after a thorough inspection and testing of the installed\nmachinery, pollution control devices and discharges\/ effluents.
