The events\nlike stage show, musical concerts, dance competitions, brand promotion\ncampaigns, etc., also fall under the ambit of this license. Playing the\npre-recorded soundtrack in public places without the PPL license is a legal\noffence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Overview_on_Phonographic_Performance_Limited\"><\/span>An Overview on Phonographic\nPerformance Limited<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The purpose of PPL, i.e. Phonographic\nPerformance Limited, is to grant a license to the copyright-protected\nsoundtrack for radio broadcasts and the general public. This license is also\nrequired for streaming recorded soundtracks in places like clubs, restaurants,\neating houses, radio etc. You will require this license even if you wish to\nplay a small portion of pre-recorded soundtrack publically.<\/p>\n\n\n\n<p>While a PPL license is needed only for\npublic places\/events where the recorded soundtrack is streamed, the license\ngranted by the Indian Performing Right Society (IPRS) covers copyright\nregistration for all literary and musical works.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_a_role_of_Indian_Performing_Right_Society\"><\/span>What is a role of Indian\nPerforming Right Society? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Indian Performing Right Society\nrefers to a representative body of artists that includes lyricists, music\nowners, composers, and publishers of music. The IPRS secures a royalty on\nbehalf of its registered members (composers, publishers, authors) from the\nmusic users and distributes the same amongst the members after reducing the\nadministrative expenses.<\/p>\n\n\n\n<p>GOI established the IPRS on the 23rd of\nAugust 1969. It is a non-profit institution which holds a status of a Company\nlimited by guarantee under the Companies Act, 2013.<\/p>\n\n\n\n<p>The IPRS also holds a legal status under\nSection 33 of the Copyright Act, 1957. This authorizes them to grant the\nlicense for the lawful usage of music and literary work<\/p>\n\n\n\n<p>The<a href=\"https:\/\/corpbiz.io\/music-license\"><strong> IPRS registration<\/strong><\/a> under the <strong>Copyright Act, 1957<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Copyright_law_of_India\"><strong>[1]<\/strong><\/a><\/sup> is mandatory to represent lawful ownership of copyright. IPRS issues the license in accordance with the section 30 of the Copyright Act, as it is the copyrights&#8217; owner via the assignment deed drawn with its members, who are the rightful owners and have assigned the rights to the Society<\/p>\n\n\n\n<p>The license secured under IPRS attracts\ndifferent tariffs based on the premises and the utilization of the musical\nwork. The tariff-based on-premises is levied depending on the areas of the\npremises like malls, pubs, restaurants, and cafes. These tariffs are formulated\non the specified criteria. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"General_Norms_around_the_License_under_IPRS\"><\/span>General Norms around the\nLicense under IPRS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>All\nusers must submit the applicable license fees as per the tariff. It applies to\nrecorded and live music.<\/li><li>The\nyearly license fees are submitted in advance within the standard duration in\nthe tariff, i.e. one month or as per the duration mentioned in the agreement.<\/li><li>There\nshall be an 18 per cent penalty and the same threshold of interest if the\nyearly license fee is not paid in the standard timeline.<\/li><li>The\ntariffs will be escalated by 10 per cent on each tariff&#8217;s anniversary<\/li><li>All\nthe royalties are not inclusive of all applicable taxes and GST. Taxes are\ncharged in advance for a duration of 12 months and should be paid at the start\nof the period.<\/li><li>All\nissued licenses shall be executed on or behalf of the IPRS and shall be exposed\nto the norms cited in the agreement, and shall be considered accepted by the\nlicence holder.<\/li><li>In\nthe case of Non- Compliant licenses that seek to regularise preceding\nviolations of Society&#8217;s rights, including the breach of agreements, the penalty\nshall be 30 per cent above the prevailing tariff and is imposed at the\nSociety&#8217;s discretion. Whereas complaint licenses shall be charged @ 5 per cent\nat the Society&#8217;s discretion.<\/li><li>The\narea of licensing is non-dependent on the audibility of the soundtrack or music\nbeing played, which implies that if the music is being played at one end of the\npremises and is audible to other sections, then the overall area shall be taken\ninto account for fee calculation.<\/li><li>Light\nand heavy vehicles shall have identical meanings as per the RTO&#8217;s guidelines.\nCarpet Area\/floor area\/square feet of the premises implies wall to wall area.<\/li><li>For\nopen concerts or shows, the ground plan must be shared to avail 40 per cent of\nthe scheme, and the permit application should be made eight days before the\nperformance date.<\/li><li>Two\npasses to the event must be shared for the vetting while seeking the license.<\/li><li>The\nlicense granted by the IPRS is applicable to the &#8216;Performing Rights&#8217; of the\nMusical Works and\/or the literary works linked with it. The word &#8216;Performing\nrights&#8217; implies and consolidates the right of performing, broadcasting and\ntransmission to subscribers to the distribution in the regime of musical and\/or\nassociated literary works.<\/li><li>The\nnorms include the utilization of the music\/soundtrack and the allied literary\nwork in any form and via any method.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Public Performance License is a mandatory requirement for playing the pre-recorded soundtrack in a public place.
