These two leading organizations play a vital role in providing music licenses. These two are copyright societies registered under section 33 of the Copyright Act, 1957. Transfer of interest is basically called a license under the Copyright Act, 1957. Licensing is a term used to describe a bundle of rights. If any establishment is using copyrighted music or sound recordings for public performance and commercial use, it is required to take two different music licenses. The first one is for sound recording, which is to be taken from Phonographic Performance Limited, and another one is for underlying rights, which are with authors, lyrists or composers who are registered members of IPRS. The royalty collected is\ndisturbed amongst its members after deducting the organization\u2019s administrative\ncost. The India Performing Right Societies is a nonprofit making organization\nand a limited by Guarantee Company under companies Act 2013, formed on 23<sup>rd<\/sup>\nAugust 1969. <\/p>\n\n\n\n<p>Under Section 33 of the <strong>Copyright Act, 1957<\/strong><sup><a href=\"https:\/\/copyright.gov.in\/documents\/copyrightrules1957.pdf\"><strong>[1]<\/strong><\/a><\/sup>, IPRS is registered to issue a license for music and literary work. In order to show rightful ownership of copyright, it is necessary for IPRS to get registration under copyright. <\/p>\n\n\n\n<p>PPL is Phonographic\nPerformance Limited, a separate organization which provides licenses to use\npre-recorded music in public places, on Radio or TV or on the internet on\nbehalf of record companies and performers. Initially, the Indian Phonographic\nIndustry (IPI) came into existence which was an association of phonogram\nproducers established in the year 1936. The main aim was to administer the\nbroadcasting rights and public performance, and therefore, Public phonographic\nLimited (PPL) came into existence in 1941, just like IPRS. It\u2019s important to\nunderstand Difference between PPL and IPRS license. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Are_IPRS_and_PPL_the_same_thing\"><\/span>Are\nIPRS and PPL the same thing?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>No, there is difference\nbetween PPL and IPRS License . The IPRS collects a royalty on behalf of its members and distributes\namongst them, whereas PPL is a music licensing and performing rights\norganization which issues licenses to play pre-recorded music in the public\narea from different mediums such as Radio, TV, CD ETC.<\/p>\n\n\n\n<p>PPL licensee gets the right to play music which is\nthere in PPL&#8217;s Collection or Commercially related registered music. If the\nmusic falls outside PPL&#8217;s ambit, then a person is not required to take any\nlicense.&nbsp; <\/p>\n\n\n\n<p>Both IPRS and PPL are the Copyright Societies that\nissue music licenses in India. Both these organization has made the issuance of\nmusic license hassle-free. If the producer of music gets a music license, it\nhelps them to keep a check on how their work is being used. <\/p>\n\n\n\n<p>One needs to register with Phonographic Performance\nLimited (PPL) to play the music in a restaurant or cafe, whereas, to use the\nlyrics or musical chords in a band performance or a concert, the applicant has\nto register with the Indian Performing Rights Society (IPRS).<\/p>\n\n\n\n<p>An application is to be drafted in a prescribed\nformat in order to get a Music License and is also required to make payment as\nper the tariff plan under the Copyright Act of India. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_penalties_for_the_offender\"><\/span>What\nare the penalties for the offender?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per Section 63 and 63 A. of the Copyright, if any person or\nentity does not get registration as per the said act, then they will be liable\nfor penalties under the law <\/p>\n\n\n\n<p>&nbsp;As per section 63, if any\nperson infringes the copyright or other rights:<\/p>\n\n\n\n<ul><li>Imprisonment &nbsp;is for at least six months- to 3 years; and<\/li><li>Fine of minimum Rs 50 000\nup to 2 00 000 INR.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Therefore, we concluded that without IPRS or PPL music license as the case may be, no one is allowed to use the copyrighted music for their benefit. Before applying for any music license, one has to be sure about the difference between PPL and IPRS license. The procedure for obtaining this license is not very straightforward.
