The draft rules are proposed by the Central Government in the exercise of powers given under Sections 6, 8 and 25 of the Environment (Protection) Act, 1986. The draft rules notification is made available to the public for 60 days from the date of its publication in the Official Gazette. Any interested person who wants to make any objection or suggestion has to do so in writing within the specified time period through the post to the Secretary of the Ministry of Environment, Forest and Climate Change.\u00a0\u00a0<\/p>\n\n\n\n<p>The total number of chapters in this\nnew Draft is VII with 32 Rules. It is also applicable to the refurbisher and recycler involved in manufacturing, transferring, selling, purchasing, and processing e-waste or EEE. It also applies to the components, consumables, spares and parts that make the electronic product operational.\u00a0<\/p>\n\n\n\n<p>The Draft is not applicable to the\nfollowings:<\/p>\n\n\n\n<ul><li>The used batteries as covered under the Batteries (Management and\n     Handling) Rules&nbsp;<\/li><li>The packaging plastics as covered under the Plastic Waste\n     Management Rules, 2016<\/li><li>Micro-enterprises (service sector) defined under the Micro, Small\n     and Medium Enterprises Development Act, 2006<\/li><li>The radioactive wastes as covered under the Atomic Energy Act, 1962\n     and the Rules as made thereunder.<\/li><\/ul>\n\n\n\n<p>The applicability of this Draft is on\nthe items mentioned in the list provided under the Schedule I, such as\ninformation technology and telecommunication equipment, Consumer Electrical and\nElectronics and Photovoltaic Panels, large and small Electrical and Electronic\nEquipment, Electrical and Electronic Tools (except large-scale stationary\nindustrial tools), toys, leisure and sports equipment and the Medical Devices\n(except all implanted and infected products).&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Definition_clause_under_the_new_Draft\"><\/span>Definition clause under the new Draft<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"has-drop-cap\">The new Draft of E-waste Management Rules has removed many definitions from the earlier Rules. These rules have included the definitions of Act, bulk consumers, business, components, consumables, disposal and treatment, end-of-life, environmentally sound management of e-waste, electrical and electronic equipment, e-retailer, e-waste, Extended Producer Responsibility, facility, historical e-waste, manufacturer, orphaned products, part, producer, recycler, refurbisher, spares and target.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"EPR_Framework_under_the_Draft_of_E-waste_Management_Rules\"><\/span>EPR Framework under the Draft of\nE-waste Management Rules<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A new chapter with the name\u00a0EPR Framework\u00a0is added in the new Draft. This was not there in the existing E-waste Management Rules, 2016.\u00a0<\/p>\n\n\n\n<p>It has mentioned the Entities to be\ncovered under the EPR framework. The followings are such entities:<\/p>\n\n\n\n<ul><li>Manufacturer<\/li><li>Producer<\/li><li>Recycler<\/li><li>Refurbisher<\/li><\/ul>\n\n\n\n<p>It has also discussed the CPCB\nregistration by the above-mentioned entities. The registration is made\nmandatory for the entities to carry out the business. The registered entities\nare prohibited from dealing with unregistered entities. If the registered\nentities provide false information at the time of registration or conceal any\ninformation, or even in case of any irregularity, the CPCB revokes the\nregistration for a period of three years; however, before such revocation, the\nCPCB gives such entity an opportunity to be heard. If any entity falls under\nmore than one category, then it has to register in all categories separately.\nThe CPCB charges a fee and annual maintenance charge from such entities on the\ncapacity of the e-waste generated, recycled, or handled by them. Such fees or\ncharges are decided by the CPCB with the Steering Committee&#8217;s approval.&nbsp;<\/p>\n\n\n\n<p>With the approval of the Steering\nCommittee (SC), the CPCB issues necessary guidelines for the registration\nprocedure.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Responsibilities_as_given_under_the_new_Draft\"><\/span>Responsibilities as given under\nthe new Draft<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Chapter III of the new Draft of E-waste Management Rules covers the responsibilities of various entities. It has changed and limited the responsibilities of the existing Rules. In the existing E-waste Management Rules, 2016, the responsibilities are dealt with under Chapter II.\u00a0<\/p>\n\n\n\n<p>The responsibilities of the following\nentities are given under this Draft:<\/p>\n\n\n\n<ul><li>Manufacturer<\/li><li>Producer<\/li><li>Refurbisher<\/li><li>Bulk Consumer<\/li><li>Recycler<\/li><li>Central Pollution Control Board<\/li><li>State Pollution Control Boards or Pollution Control Committees of\n     Union Territories<\/li><li>State Government<\/li><li>Urban Local Bodies (Urban and Rural)<\/li><li>Port authority under Indian Ports Act, 1908 and Customs Authority\n     under the Customs Act, 1962<\/li><li>Bureau of Indian Standards\/ MeitY<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_storage_of_E-waste_and_other_EPR_Regime\"><\/span>Procedure for storage of E-waste\nand other EPR Regime&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Under the new Draft of E-waste Management Rules, Chapter IV deals with the procedure for storage of the e-waste. Every entity stores the e-waste for a specified period of 180 days as per the relevant rules or guidelines. It maintains a record of the sale, transfer and storage of e-waste and also makes such records available for inspection.\u00a0<\/p>\n\n\n\n<p>The CPCB can extend such a specified\nperiod of 180 days to 365 days in the case where e-waste needs to be\nspecifically stored for the development of a process for its recycling or\nreuse.&nbsp;<\/p>\n\n\n\n<p>Chapter V talks about modalities of\nthe EPR Regime that all producers have to fulfil the EPR obligations as per\nschedule III, which provides the E-waste recycling target. Schedule III also\nmentions that the importers of used EEE have a 100 per cent EPR obligation for\nthe imported material after the end of life if not re-exported.&nbsp;<\/p>\n\n\n\n<p>It further states that the EPR\nobligations for each product are decided based on the information given by the\nproducers and the product&#8217;s life period, as suggested by the CPCB. The\ncompliances of EPR are monitored by the Central or State Pollution Control\nBoard.&nbsp;<\/p>\n\n\n\n<p>The Producers have to fulfil the EPR\nobligations by purchasing an EPR certificate from the registered recyclers and\nsubmitting the same by filing the quarterly return. The details given by the\nproducers and registered recyclers are cross-checked, and if there occurs any\ndifference, then the lower figure is considered towards the fulfilment of the\nProducer&#8217;s EPR obligation. The certificates are subject to an environmental\naudit by the CPCB&#8217;s authorized agencies.&nbsp;<\/p>\n\n\n\n<p>The new Draft talks about the <a href=\"https:\/\/corpbiz.io\/epr-registration\"><strong>EPR Certificate<\/strong><\/a> Generation by the CPCB for Recycling and Refurbishing. A producer purchases the EPR Certificate and refurbisher certificate limited to its liability in the current year plus any left-over liability of the preceding year. All such transactions are recorded by the Producers\/Recyclers and submitted at the time of filing the quarterly return.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Reduction_of_Hazardous_Substance_under_the_New_Draft\"><\/span>Reduction of Hazardous Substance\nunder the New Draft<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Draft of E-waste Management Rules\nunder chapter VI discusses the reduction of Hazardous Substances in the\nmanufacture of EEE and its components, consumables, parts or spares. Every producer\nensures that new EEE and its components, consumables, parts or spares do not\nhave Lead, Cadmium, Mercury, Hexavalent Chromium, Polybrominated Biphenyls and\nPolybrominated diphenyl ethers beyond 0.1% by weight of its concentration value\nin homogenous materials for Lead, Mercury, Hexavalent Chromium, Polybrominated\nBiphenyls and Polybrominated diphenyl ethers and 0.01% by weight in homogenous\nmaterials for Cadmium. The applications which are exempted from the previously\nmentioned rule of reduction of hazardous substances are listed under Schedule\nII. For these exempted applications, schedule II has also given the limits of\nhazardous substances to have complied.&nbsp;<\/p>\n\n\n\n<p>In the product user documentation,\nevery producer provides detailed information about the EEE and its components,\nconsumables, spares or parts with the declaration of conformance to the\nreduction of hazardous substances. This information is self-declaration. The\nmanufacture and supply of EEE used for defence and any other similar strategic\napplications are also exempted from following the reduction rule. The\nmanufacturers are asked to use such technology or methods to make the end of\nthe product recyclable. The manufacturer ensures that the components or parts\nmade by the different manufacturers are compatible with each other so as to\npossibly reduce the quantity of the e-waste.&nbsp;<\/p>\n\n\n\n<p>The CPCB conducts a random sampling\nof EEE to monitor and verify the compliance of the provision related to the\nreduction of the hazardous substance. If the product fails to comply with the\nsame, then the producer takes the corrective measures and withdraws or recalls\nthe product from the market within the specified time period provided by the\nCPCB guidelines.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Other_Miscellaneous_Provisions_under_the_new_Draft\"><\/span>Other Miscellaneous Provisions\nunder the new Draft<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>No entity is allowed to carry any\nbusiness without proper registration under the Draft of E-waste Management\nRules regulations. The CPCB may provide timely issue guidelines for the\ncollection, transportation, storage, segregation, refurbishment, recycling and\ndisposal of the e-waste under these regulations with the approval of the\nCentral Government. The CPCB have to submit an annual report regarding the\nimplementation of E-waste Management Rules with the quantitative and\nqualitative analysis with its recommendations to the Ministry of Environment,\nForest and Climate Change within one month from the end of the financial\nyear.&nbsp;<\/p>\n\n\n\n<p>The transportation of waste for final\ntreatment, storage or disposal shall follow the Hazardous Waste (Management,\nHandling and Transboundary Movement) Rules, 2016. The producer, refurbisher,\ntransporter, dismantler or recycler has to inform the concerned SPCB\nimmediately if any accident occurs during the transportation of e-waste.&nbsp;<\/p>\n\n\n\n<p>In case of an order of suspension,\ncancellation or refusal of registration or renewal by the CPCB, the aggrieved\nperson within the period of 30 days from such order prefers an appeal in the\nform as prescribed by the Central Government. The Appellate Authority\nentertains the appeal after the expiry of said 30 days only if it is satisfied\nthat the appellant has sufficient cause of not filing the appeal in time.&nbsp;<\/p>\n\n\n\n<p>In case of any violation of any\nprovisions of the guidelines and regulations issued under this new Draft by any\nentity, the CPCB lays down the guidelines for the imposition and collection of\nthe environmental compensation on such entity. These guidelines for\ncompensation are approved by the Ministry of Environment, Forest and Climate\nChange. Such guidelines for imposition and collection of environmental\ncompensation are also laid down by the CPCB as approved by the MoEF&amp;CC in\ncase the producers fail to fulfil the obligations set out here or use a false\nEPR Certificate.&nbsp;<\/p>\n\n\n\n<p>Compensation is also imposed on the\nunregistered manufacturers, refurbishers, recyclers and producers or any other\nentity that aids or abets in the violation of these regulations.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The funds collected under\nenvironmental compensation are utilized for collection and recycling or\nend-of-life disposal of uncollected, historical, orphaned e-waste and non-recycled\nor not end-of-life disposal of e-waste on which the compensation is imposed,\nresearch and development, and other heads as decided by the committee. These\nfunds are kept in a separate Escrow account by the CPCB. The Steering Committee\nissues instructions related to the funds with the approval of the\nMoEF&amp;CC.&nbsp;<\/p>\n\n\n\n<p>A person who gives incorrect\ninformation for obtaining the EPR Certificate, uses a false or forged EPR\nCertificate or fails to cooperate in the verification and audit proceeding is\nprosecuted under the section 15 of the Environment (Protection) Act, 1986, and\nsuch prosecution is in addition to Environment Compensation levied under this\nRules.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The CPCB itself or through a\ndesignated agency verifies the compliance of the regulations of this Draft by\nthe manufacturer, refurbisher, recycler and producer. Such verification is done\nby random inspection and periodic audits.&nbsp;&nbsp;<\/p>\n\n\n\n<p>In the end, the Draft has talked\nabout the Steering Committee. The Steering committee is headed by chairman of\nCPCB. The other members are:<\/p>\n\n\n\n<ul><li>Representative of MoEF&amp;CC<\/li><li>Representative of MeitY<\/li><li>Representative of Electrical and Electronic Equipment Producers and\n     Manufacturer Association.<\/li><li>Representative of E-waste Recycler Association<\/li><li>Representative of SPCB or PCC&nbsp;<\/li><li>Head of the Concerned Division of CPCB- Member Convener<\/li><\/ul>\n\n\n\n<p>This committee is responsible for the implementation, supervision and monitoring of the guidelines of this Draft. It also decides if the dispute arises and refers to MoEF&amp;CC in case any substantial issue arises. It will also review and revise the guidelines, EPR target and the addition of any new EEE with the approval of the MoEF&amp;CC. It also has the power to remove a difficulty in the implementation of the regulations and refer any issue to the MoEF&amp;CC.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Schedules_under_the_Draft_of_E-waste_Management_Rules\"><\/span>Schedules under the Draft of\nE-waste Management Rules<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There are only three schedules with\nfour headings under this new Draft. Schedule I has mentioned the list of EEE\ncategories, including its components, consumables, parts, and spares covered\nunder this Draft. Schedule II has the list of applications that are exempted\nfrom the requirements of sub-rule 1 of Rule 21. Schedule III has provided the\nE-waste Recycling Targets, and Schedule III (A) has given the EPR targets for\nproducers who have recently started sales operations.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> The Central Government proposes the new Draft of E-waste Management Rules under the <strong>Environment Protection Act, 1986<\/strong><sup><a href=\"https:\/\/cpcb.nic.in\/env-protection-act\/\"><strong>[1]<\/strong><\/a><\/sup>. It is proposed to replace the E-waste (Management) Rules, 2016 and the E-waste (Management) Amendment Rules, 2018. The Draft is made public by the Central Government for any objection or suggestion. Such objection or suggestion is to be made in writing within the period of 60 days from the date of such publication in the Official Gazette to the Secretary, MoEF&amp;CC.
