Under the Water (Prevention &amp; Control of Pollution) Act and Air (Prevention &amp; Control of Pollution) Act, any industry, unit, operation or process which is likely to discharge sewerage or trade effluent in the environment or is likely to emit any air pollution in the atmosphere must obtain consent. Once an industry is set up along with the required pollution control system, then it requires to obtain consent to operate its unit and the State Pollution Control Board grants such consent for a given period of time. Thus, the consent to operate requires regular renewal.\u00a0<\/p>\n\n\n\n<p>Depending on the hazard potential of their\nactivities, the industries are categorized. The said categorization is Red,\nOrange, Green, White, and Exempted. Considering the compliance with\nEnvironmental laws by these industries, the State Pollution Control Board\ngrants consent to operate in such industries.&nbsp;<\/p>\n\n\n\n<p>&nbsp;The said Board grants the consent to operate\nfor a limited period of time, and so the industries need to apply for consent\nto operate renewal. The application for renewal should be made prior to the\nexpiry of said consent to operate.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Consent\nto Operate under Air Act<\/strong><\/h3>\n\n\n\n<p>According to the <strong>Air Act<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Clean_Air_Act_(United_States)\"><strong>[1]<\/strong><\/a><\/sup>, every person should apply for consent to operate before establishing and operating any industry in an air pollution control area. The prior consent is obtained from the State Pollution Control Board. If an industry was operating in air pollution control areas before the commencement of amendment of the Air Act and for which no consent was required before such amendment can continue to do so for a period of three months from the commencement of amendment and if it has applied for the consent to operate then till the disposal of such application.\u00a0<\/p>\n\n\n\n<p>The industries must apply for consent to operate\nwith the prescribed fee and also with the details of the industry. If any\nindustry starts to operate immediately before the declaration of its area as an\nair pollution control area, then it shall apply for consent to operate within\nthe prescribed time period. Once the industry makes the application, it is\ndeemed to have Consented to operate by the State Pollution Control Board unless\nits application is refused by the Board. When Industries apply for consent to\noperate, then the State Pollution Control Board makes an inquiry to ensure that\nthe industry is fit for the consent.&nbsp;<\/p>\n\n\n\n<p>The State Pollution Control Board, within four\nmonths of receipt of the application for consent, grants consent to operate by\norder in writing. The consent to operate is granted for a fixed period of time.\nThe State Board may also refuse to grant the consent by order in writing. The\nState Pollution Board has the power to cancel the consent within the prescribed\nperiod of time granted by it, i.e., it may cancel the consent before the expiry\nof such consent to operate if the conditions specified in the consent are not\nfullfed. The State Board, before refusing or cancelling the consent, gives an\nappropriate opportunity to the concerned person or entity to be heard.&nbsp;<\/p>\n\n\n\n<p><strong>The conditions to be followed by the person or\nindustry to whom such consent to operate has been granted by the State\nPollution Control Board are:<\/strong><\/p>\n\n\n\n<ul><li>Only those\n     control equipment are installed or operated in the industry, which is\n     approved by the State Pollution Control Board.<\/li><li>The already\n     installed or operated control equipment is altered or replaced as per the\n     directions of the State Pollution Control Board.<\/li><li>The control\n     equipment must be in good running condition.<\/li><li>All other\n     necessary equipment is erected or re-erected as per the approval by the\n     State Pollution Control Board.&nbsp;<\/li><li>These\n     above-mentioned conditions or any specified conditions comply within the\n     time period as specified by the State Pollution Control Board.&nbsp;<\/li><\/ul>\n\n\n\n<p>The State Pollution Control Board, due to any\ntechnological improvement or otherwise, is of the opinion that any of the\nabove-mentioned conditions requires variation; then, after giving the\nopportunity to be heard, it varies such condition or conditions, and the\nindustry is then bound to comply with such variation.<\/p>\n\n\n\n<p>If any person who obtained consent to operate\ntransfers his interest in the industry to any other person, then it shall be\ndeemed as the consent has been originally granted to such other person.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Consent\nto Operate under Water Act<\/strong><\/h3>\n\n\n\n<p>Under the Water Act, without the previous consent\nto operate from the State Control Board, no person shall take any step towards\nthe operation or process which is likely to discharge sewage or trade effluent\ninto stream or well or sewer or on land; or bring into use any outlet for\ndischarge of sewage; or begin to make new discharge of sewage. If a person who\nis already in the process of taking any steps towards such operation or process\nimmediately before the commencement of Amendment in Water Act for which no\nconsent was required before such amendment has started to apply for consent to\noperate, then he can continue the operation till the disposal of such\napplication.&nbsp;<\/p>\n\n\n\n<p>The application made for the consent to operate\nbefore the State Pollution Control Board must be accompanied by the required\nparticulars and the fee. The State Pollution Control Board makes an inquiry to\nensure the fitness of such an industry.&nbsp;<\/p>\n\n\n\n<p><strong>These are certain conditions required by the State\nPollution Control Board for granting the consent to operate:<\/strong><\/p>\n\n\n\n<ul><li>Conditions\n     to the point of discharge of sewage or to use of any outlet for the\n     discharge of sewage.<\/li><li>In case of\n     a new discharge, the conditions regarding the nature, temperature,\n     composition, volume or rate of discharge of effluent from the premises of\n     the industry from which the discharge is to be made.<\/li><li>The consent\n     to operate is valid for a fixed time period as specified by the State\n     Pollution Control Board in its order.&nbsp;<\/li><li>Any\n     conditions imposed by the State Pollution Control Board shall be binding\n     on the person to whom the consent to operate has been granted.&nbsp;<\/li><li>If the\n     State Pollution Control Board refuses the application for consent to\n     operate, then it notifies such refusal in writing.&nbsp;<\/li><\/ul>\n\n\n\n<p>If any industry is operating without taking such\nconsent to operate, then the State Pollution Control Board serves notice to\nsuch industry imposing such conditions which are needed to be imposed.<\/p>\n\n\n\n<p>Every State Pollution Control Board maintains a\nregister of all the particulars of the conditions imposed, and the register can\nbe opened for inspection at any reasonable hour by any interested person and\nthe conditions mentioned in the register shall be conclusive proof that the\nconsent has been granted complying to such conditions.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_to_apply_for_Consent_to_Operate\"><\/span><strong>Procedure to apply for Consent\nto Operate<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The procedure to apply for consent to operate is as\nfollows:<\/p>\n\n\n\n<ul><li><strong>Filing\nof Application<\/strong><\/li><\/ul>\n\n\n\n<p>The applicant files an application to the\nrespective State Pollution Control Board with all the required information or\nparticulars and the requisite fee.&nbsp;<\/p>\n\n\n\n<ul><li><strong>Inspection\n     of the Unit<\/strong><\/li><\/ul>\n\n\n\n<p>Once the applicant submits the application, the\nState Pollution Control Board goes for an inspection of the unit or industry to\nmake sure that it is fir for the consent to operate.<\/p>\n\n\n\n<ul><li><strong>Scrutinization\n     and recommendation<\/strong><\/li><\/ul>\n\n\n\n<p>A Supervising Officer, Scientific Officer, or\nEnvironmental Officer scrutinizes the application and makes its recommendation\nbased on it.&nbsp;<\/p>\n\n\n\n<ul><li><strong>Grant\n     of consent to operate&nbsp;<\/strong><\/li><\/ul>\n\n\n\n<p>Based on the recommendations of the Supervising or\nscientific officer, the Consent to Operate is granted to the applicant by the\nState Pollution Control Board.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_for_application_of_Consent_to_Operate\"><\/span><strong>Documents required for\napplication of Consent to Operate<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To apply for consent to operate, the applicant\nrequires the following documents:<\/p>\n\n\n\n<ul><li>Detailed\n     layout plant of all processes and point source of effluent or sewage\n     discharge or emission&nbsp;<\/li><li>Process\n     flow sheet<\/li><li>Latest\n     analysis report on solid waste, effluent, hazardous waste and fuel gases<\/li><li>Details of\n     water pollution control instruments<\/li><li>Details of\n     Air pollution control instruments<\/li><li>Air quality\n     report<\/li><li>Water\n     budget calculations&nbsp;<\/li><li>Details of\n     chemical reactions with mass equilibrium<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Renewal_of_application_of_consent_to_operate\"><\/span><strong>Renewal of application of\nconsent to operate<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The holder of consent has to apply for consent to operate renewal 120 days prior to the expiry of such consent. The prescribed fee is to submit before the <a href=\"https:\/\/corpbiz.io\/learning\/consent-for-noc-from-state-pollution-control-board-india\/\"><strong>State Pollution Control Board<\/strong><\/a>. The documents for renewal of Consent to Operate are similar to the consent to operate. However, the applicant also provides the photocopy of previous consent to the State Pollution Control Board.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> All the operating units and the units starting operations after their establishment require consent to operate from the State Pollution Control Board. To apply for consent to operate, one has to make an application to their respective State Pollution Control Board with all the required particulars and the fee. The consent to operate is granted under the Water and Air Act.
