by Hazardous Waste\nAuthorization, if applicable. <\/p>\n\n\n\n<p>Further, they are required to install Waste Water Treatment Plants such as STP, ETP, and pollution control equipment such as Wet scrubbers, Dust collectors, Bag Filter, etc for curtailing pollution. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pollution_index_of_Red_and_Orange_Category_company\"><\/span>Pollution index of Red and Orange Category company<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Orange\nCategory Industries<\/em><\/strong><\/p>\n\n\n\n<p>Industrial\nsectors which contribute to the significant quantum of air\/water pollution or\ndischarge hazardous waste come under Orange category Industry. Pollution Index\nof the ranges Orange Category Industries ranges from 41 \u2013 59. These entities\nfall between the Red and Green category industries in terms of pollution\npotential.&nbsp; <\/p>\n\n\n\n<p>Industries\nunder Orange Category are liable to secure Consent to Establish and Consent to\nOperate. Apart from that, they are also required to deploy pollution control\ndevices such as Dust collectors, Wet Scrubber, and Waste Water Treatment Plants\nsuch as STP, ETP for Pollution Control. <\/p>\n\n\n\n<p><strong><em>Red\nCategory Industries<\/em><\/strong><\/p>\n\n\n\n<p>The\nred category of industries has a pollution index of 60. Entities falling under\nthis category are highly polluting and thus have the potential to damage\necological balance. These industries emit hazardous gases, discharge harmful\ntrade effluent, or both, and emit Hazardous Waste in concentrated forms. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pollution_Control_Measures_to_be_opted_by_Orange_and_Red_Category_Industries\"><\/span>Pollution Control Measures to be opted by Orange and Red\nCategory Industries<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Waste Water Treatment via ETP i.e. Effluent Treatment Plant\/ Sewage Treatment Plant (STP)\/ Oil and Grease Trap<\/li><li>Air Pollution Control via Dust Collector\/ Wet Scrubber\/ Anti Smog Gun\/ Bag Filter<\/li><li>Hazardous <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/waste-management\"> Waste Management <\/a> <\/strong>via safe storage &amp; disposal of Hazardous Waste<\/li><li>E-waste and Battery Waste Management\/ Plastic Waste Management as applicable<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Generalized_procedure_to_apply_for_CTE_and_CTO\"><\/span>Generalized procedure to apply for CTE and CTO <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Consent\nto Establish<\/em><\/strong><\/p>\n\n\n\n<ol><li>Select an apt industrial activity from the PCB\u2019s list of predefined Industrial activities. <\/li><li>Prepare a report of the project, undertakings, details relating to pollution control equipment, and other vital documents as applicable required for CTE application. <\/li><li>Fill and submit CTE application with requested documentation and fees. <\/li><li>Application shall be subjected to the scrutiny of a <strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/state-pollution-control-board-spcb-noc\"> Pollution Control <\/a>\n<\/strong> Official. A completed and accurate application form would be processed for the grant of CTE consent. <\/li><li>However, if the application has some errors, the applicant needs to correct them and revert to authority to avoid the cancellation.&nbsp; <\/li><\/ol>\n\n\n\n<p><strong><em>Consent\nto operate;&nbsp; <\/em><\/strong><\/p>\n\n\n\n<ol><li>First equipped your facility with Pollution Control Devices or;<\/li><li>Take relevant steps for the reduction of the Water\/Air\/Noise Pollution as applicable.&nbsp;&nbsp; <\/li><li>Thereafter, request a certified lab to inspect and certify the pollution control device installed in the facility. <\/li><li>File CTO application form with requested documentation, information &amp; fees.&nbsp; Also, apply for Authorization under Hazardous Waste Management if mandatory<\/li><li>Application subjects to the verification conducted by <strong>Pollution Control Official<sup><a href=\"https:\/\/cpcb.nic.in\/\"><strong>[1]<\/strong><\/a><\/sup>\n<\/strong><\/li><li>Applications go under the scrutiny of Pollution Control Official and a similar procedure is followed.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documentations_required_for_CTE_and_CTO_application_filing\"><\/span>Documentations required for CTE and CTO application filing <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>Applicant\u2019s Aadhar Card<\/li><li>Pan card of Partnership\nfirm\/Company <\/li><li>Rent Agreement if applicable<\/li><li>Layout Plan<\/li><li>Water and Electricity Bill<\/li><li>Project Report<\/li><li>Undertaking* about environment\npreservation<\/li><li>Capital Investment Certificate<\/li><li>Lab Test Reports<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Particular_to_be_included_by_Red_category_entity_in_undertaking_for_consent_to_operate\"><\/span>Particular to be included by Red category entity in undertaking for consent to operate <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>List of products and\nby-products to be processed at the proposed facility <ul><li>Raw materials &amp; chemicals\n(with quantity\/day) <\/li><\/ul><ul><li>Briefing on the manufacturing\nprocess <\/li><\/ul><ul><li>Plot area of the facility (in\nSquare meters)<\/li><\/ul><ul><li>Workforce detail <\/li><\/ul><ul><li>Electricity load (KW)<\/li><\/ul><ul><li>Year of establishment <\/li><\/ul><ul><li>Contact detail of the applicant<\/li><\/ul><ul><li>Total capital invested in the\nfacility<\/li><\/ul><ul><li>Water consumption detail\n(kl\/day) and its mode of disposal <\/li><\/ul><ul><li>Effluent discharge (kl\/day) and\nits mode of disposal<\/li><\/ul><ul><li>DG set capacity (KVA) and its\nstack height above the building\u2019s roof in meters<\/li><\/ul><ul><li>For dry unit, a declaration\nregarding the non-generation of trade effluent and future commitment for the\nsame<\/li><\/ul><ul><li>Declaration ensuring apt\nmeasures being implemented under Environment (Protection) Rules, 1986 for\nabatement of air\/water pollution.<\/li><\/ul><ul><li>Declaration regarding the set\nup of ETP and ECS <\/li><\/ul><ul><li>Declaration reflecting that apt\nmeasures have been taken for DG set noise reduction and its stack height to\nmeet the Environment (Protection) Rules, 1986<\/li><\/ul><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Points_to_be_considered_by_Orange_category_entities_for_form_filing\"><\/span>Points to be considered by Orange category entities for form filing <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul><li>Facilitation of incorrect\ndetail or non-disclosure of vital information relating to any of the items of\nthe application could lead to penal provisions under governing Act.<\/li><li>The applicant is mandated to\napply via an online portal along with the requested documents and fee. If the\napplicant has DSC, a physical copy of the application and documentation need\nnot be&nbsp; furnished in DPCC <\/li><li>If any of the items is\nirrelevant to the activity of the proposed entity, make sure to add \u201cNot\nApplicable\u201d <\/li><li>Use additional sheets if the\nspace for any item is inadequate. <\/li><li>Facilitate the name of the\nperson authorized by the applicant to address consent formalities. <\/li><li>Also state the competent\nagencies under whose the unit falls<\/li><li>The application shall be\naccompanied by the mandatory documentation cited on the last page of the form. <\/li><li>Consent applications in the\nprescribed form accompanied by the mandatory documentation are required to be posted\nto DPCC after enclosing signature on every page. <\/li><li>The unit involved with the\nManufacturing of Plastic Bags\/ Recycling Plastic Waste is mandated to apply for\nRegistration\/ Authorization under PWM Rules, 2016 along with mandatory\ndocumentation while applying for CTO under Air &amp; Water Act.<\/li><li>The unit cited under Hazardous\n&amp; Other Waste (Management &amp; Transboundary Movement) Rules 2016 must\napply for authorization under such rules along with mandatory documentation\nwhile seeking CTO\/Renewal Air &amp; Water Act.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Securing Consent to Establish\/Operate\/Renewal is a legal compulsion for pollution-prone industries in India.
