After China, India is the second-largest bricks manufacturer, producing over 10 per cent of the global production, and has about 140,000 brick-making undertakings, accounting for 250 billion brick masonry units. In developed nations, the Brick kilns have been replaced by continuous tunnel kilns that produce millions of high-quality bricks in less time. class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In traditional kilns, Bricks are handmade\nand transported by horses, mules, donkeys, etc. They transport many tonnes of\nbricks each day in carts or packs within the kilns and to other locations for\nconstruction. Because of the same practice, Injuries and diseases were caused\nby extreme temperatures, lack of shade, water, rest, difficult terrain and\noverloading. Bricks are manufactured in brick Kilns that emit harmful gases,\naffecting humans, the environment, and the economy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Overview_on_the_Brick_Kilns_Regulation_2010\"><\/span>An Overview on the Brick Kilns Regulation, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Brick Kilns regulation is an act to\nregulate and control the establishment of Brick Kilns in the respective State.\nThis Act could be referred to as &#8220;the Jammu and Kashmir Brick Kilns\n(Regulation) Act, 2010.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Establishment_of_a_Brick_kilns_Regulation_2010\"><\/span>Establishment of a Brick kilns Regulation, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Brick kilns shall be set up on any land\nother than-<\/p>\n\n\n\n<p>(a) Agricultural land,<\/p>\n\n\n\n<p>(b) A land fit for cultivation of any\nagricultural produce,<\/p>\n\n\n\n<p>(c) A land not been declared as\nBanjri-Kadim in the Revenue records, or<\/p>\n\n\n\n<p>(d) A land within the demarcated forest\narea of the State under the Jammu and Kashmir Forest Act, 1987.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Appointment_of_Licensing_Authority\"><\/span>Appointment of Licensing Authority<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Government may appoint the below-mentioned officers by issuing a\nnotification in the Government Gazette,<\/p>\n\n\n\n<p>(a) Officers of the Government as it thinks fit to be the licensing\nauthorities for this Act, and<\/p>\n\n\n\n<p>(b) Brief the limits within which such authority shall exercise the\npowers conferred on a licensing authority by or under this Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Grant_of_a_License_under_Brick_Kiln_Regulation_2010\"><\/span>Grant of a License under Brick Kiln Regulation 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol>\n<li>Anyone who wishes to set up the brick\nkiln in an area in the State, following the guidelines laid out in section 4,\nshall apply in writing to the licensing authorities in the region for granting\npermission to establish the brick kiln to begin manufacturing bricks on it.<\/li>\n\n\n\n<li>Anyone who owns a kiln in disuse who\nwishes to resume the brick manufacturing process must make an identical application\nbefore the licensing authorities in the location to grant a license to resume\nthe brick manufacturing process within the kiln.<\/li>\n\n\n\n<li>The owner of an existing kiln must,\nwithin 30 days of the date of inception of the Act, make an application with\nthe licensing authorities in the region for the granting of a license for the\ncontinuation of manufacturing bricks in the kiln.<\/li>\n\n\n\n<li>Each\napplication under subsections (1) and (2) must be in the prescribed format. It\nshall include details about the brick kiln&#8217;s location, size and type, and other\nrequired information.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Restrictions_on_the_establishment_under_Brick_Kilns_Regulation_Act_2010\"><\/span>Restrictions on the establishment under Brick Kilns Regulation Act, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After the commencement of Brick kiln\nRegulation 2010-<\/p>\n\n\n\n<ol>\n<li>No individual may build a new brick kiln\nwithout obtaining a license under or following this Act.<\/li>\n\n\n\n<li>No brick kiln owner may continue brick\nmanufacturing operations without a license.<\/li>\n\n\n\n<li>No\nowner of a brick kiln-<\/li>\n<\/ol>\n\n\n\n<p>(a) After the expiration of the license,\nno brick manufacturer shall be allowed to operate in a brick kiln owned by\nsomeone who has received a license under section 6,<\/p>\n\n\n\n<p>(b) The License for a brick kiln is\nrevoked or suspended according to <strong>section 10.<\/strong> Brick manufacturing\noperations cannot be carried out in the brick kiln by the owner after the\nrevocation or during the suspension period,<\/p>\n\n\n\n<p>(c) The License for a brick kiln is\nrevoked or suspended according to section 10. Brick manufacturing operations\ncannot be carried out in the brick kiln by the owner after the revocation or\nduring the suspension period,<\/p>\n\n\n\n<p>(d) The brick kiln owner must obtain\npermission from the licensing authority before expanding the brick kiln.<\/p>\n\n\n\n<p><strong>Note: If the application for a License is\npending approval before the licensing authorities, the validity period of a\nlicense shall not be considered expired for clause (a).<\/strong><\/p>\n\n\n\n<p>No person shall set up a brick kiln or\napply for renewal unless a person-<\/p>\n\n\n\n<ol>\n<li>Generates transfer of land use rights\ncertificate from Revenue Department,<\/li>\n\n\n\n<li>Get an environment clearance certificate\nfrom the Department of Environment and Remote Sensing,<\/li>\n\n\n\n<li>It\nhas enough mud to serve as a raw material for the brick kiln, and it is located\non insufficiently balanced, non-productive land. To establish the same, the\napproval of the Director of Agriculture is required.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_requirement_under_the_Brick_Kiln_Regulation_2010_%E2%80%93\"><\/span>Documents requirement under the Brick Kiln Regulation, 2010 \u2013<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Below mentioned documents must be\nattached to every application-\u2013<\/p>\n\n\n\n<ul>\n<li>A site map and a Revenue report and affixed by the respective Tehsildar to indicate the title, location, status, and kind of land-<\/li>\n\n\n\n<li>NOC from<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>Deputy  Commissioner.<\/li>\n\n\n\n<li>SPCB (State Pollution Control Board)<\/li>\n\n\n\n<li>Divisional Forest Officer concerned<\/li>\n\n\n\n<li>Wildlife Warden concerned<\/li>\n\n\n\n<li>Director, Geology, and Mining<\/li>\n\n\n\n<li>District Agriculture Officer      concerned<\/li>\n\n\n\n<li>Block Medical Officer concerned<\/li>\n\n\n\n<li>Tehsil Education Officer concerned<\/li>\n\n\n\n<li>The respective Executive Engineer (PWD\/R&amp;B) concerned, and <\/li>\n\n\n\n<li>Tehsildar is concerned. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_of_License\"><\/span>Validity of License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The license granted in these provisions is valid for two years from the\ndate of its issue. It can be renewed for two years consecutively, provided that\nit is accompanied by the royalty Clearance Certificate from the Geology &amp;\nMining Department. Also, the licensing authority will choose the kiln that is\nno longer in use over the building of brand-new brick kilns if it complies with\nthe standards set forth within the Act and the Rules made under it.<\/p>\n\n\n\n<p>Any person who has the authorization to operate the brick kiln has been\nissued and wishes to apply for brick kiln registration with the Industries and\nCommerce Department before creating the brick kiln.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fee_for_a_license\"><\/span>Fee for a license<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The fee for granting a license is thirty thousand rupees, and the annual\nrenewal fee for this license shall be Rs ten thousand. However, by notification\nin the Government Gazette, the Government may revise the license fee and\nrenewal fee. The licensing authority must forward a copy to each department\nafter the license has been granted-<\/p>\n\n\n\n<ul>\n<li>Industries and Commerce Department,<\/li>\n\n\n\n<li>Consumer Affairs and Public Distribution Department,<\/li>\n\n\n\n<li><strong>Commercial Taxes Department,  <\/strong><\/li>\n\n\n\n<li>Geology and Mining Department,<\/li>\n\n\n\n<li>District Development Commissioner; and<\/li>\n\n\n\n<li><strong><a class=\"text-primary\" href=\"https:\/\/corpbiz.io\/state-pollution-control-board-spcb-noc\">Pollution Control Board<\/a> <\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Protection_of_the_environment\"><\/span>Protection of the environment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Anyone who holds a Brick Kiln license\nshall abide by the laws governing pollution. They must make every effort to\ntake the measures and put those devices required to protect the environment and\nreduce pollution as determined by the authority in charge. Dust pollution from\nexhaust fumes is controlled and kept within permissible limits under the laws\napplicable to them in time.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Revocation_or_suspension_of_license_under_Brick_Kilns_Regulations_Act_2010\"><\/span>Revocation or suspension of license under Brick Kilns Regulations Act, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In case that the authority was of the\nview that, based on a reference made in this manner or in any other way that,\n\u2013\u2013<\/p>\n\n\n\n<ul>\n<li>A license issued under section 6 was obtained by false reporting of the essential facts; or<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The License holder has, without just reason, has not complied with the conditions to which the license was granted; or<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The License holder has ceased the manufacturing or production of bricks without any rational thought to create artificial scarcity.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The License holder violated any of the requirements of the Act and the regulations formulated under it.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>The holder of a license is convicted and prosecuted according to section 21 of the Act in that case. Without prejudicing any other penalties for which the holder of the license may be held accountable under this Act, the licensing authority could, after having given the person who holds the license the opportunity to present a reason or revocation, suspend or revoke the license, or even forfeit the amount that it is, if there is it is any or a portion of it deposited as security to ensure the proper fulfillment of the conditions to which the license was granted. <\/li>\n<\/ul>\n\n\n\n<p><strong>Note-The licensing authority may also\nidentify the brick kiln owner and prohibit him from issuing the license for not\nexceeding ten years.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Payment_of_royalty_under_Brick_Kilns_Regulation_Act2010\"><\/span>Payment of royalty under Brick Kilns Regulation Act,2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any kiln proprietor licensed can take and\nconsume the clay used to create bricks after obtaining a valid license upon\npaying such royalty as prescribed by the Geology and Mining Department, subject\nto revision for two years. Failure to pay royalty will render the licensee\nresponsible for the recovery of royalty, fines, penalties, or even the\nannulment of the license by the appropriate authority.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Power_of_inspection\"><\/span>Power of inspection<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Any person authorized by the Government shall\nhave authorization;<\/p>\n\n\n\n<ul>\n<li>To enter and inspect any brick kilns<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>To seize order production of any document, book, or register that has the owner or the controller of any brick kiln or any employee has prepared. The authority shall inspect when he believes an infraction or violation of the Act or its regulations is currently being committed.<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>To stop Any vehicle or cart carrying bricks for sale,  storage, supply, or other purposes; and<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>To seize bricks from any person, vehicle, or cart if he believes that there has been, is being, or will be a violation of the Act or its rules.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fixation_of_price_under_Brick_Kilns_Regulation_2010\"><\/span>Fixation of price under Brick Kilns Regulation, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Through a notification via the Government\nGazette, the Government could periodically fix the maximum brick price for the\nentire State or specific areas of the State. Different prices can be established\nfor various bricks based on their weight and size, the strength of all bricks,\nand the ratio between quarter (broken) bricks for every thousand.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Quality_of_Bricks_under_Brick_Kilns_Regulation_2010\"><\/span>Quality of Bricks under Brick Kilns Regulation, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The bricks made by the licensed owner of the kiln will conform to the requirements established for the product in the Indian Bureau of Standards or any other authority authorized to do so, and any deviations will constitute an offence by <strong>section 21 <\/strong>of the Act.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Delegation_of_powers_under_Brick_Kilns_Regulation_2010\"><\/span>Delegation of powers under Brick Kilns Regulation, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Government may, through an\nannouncement published in the Government Gazette, direct that the powers\nconferred by it under section 13 subject to the conditions or limitations as\nare specified in the directions, be exercised as well by any official or\nauthority that is who is subordinate to it as is specified in the notification.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_are_the_Appeals_and_Penalties_under_Brick_Kilns_Regulation_Act_2010\"><\/span>What are the Appeals and Penalties under Brick Kilns Regulation Act, 2010?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong><em>Appeal<\/em><\/strong><strong><em><\/em><\/strong><\/p>\n\n\n\n<ul>\n<li>Anyone who is dissatisfied by a ruling of the licensing authority could, in 30 days following the day on which the judgement is made known to him, decide to appeal to an Appellate Authority as may be designated by the Government in this regard; provided it is noted that      Appellate Authority may entertain the appeal after the thirty days, but not later than sixty days after it finds of the fact that an appellant is prevented due to enough reason not to file the appeal within the time frame.<\/li>\n\n\n\n<li>When it receives any appeal made under subsection (1),  an Appellate Authority shall, after allowing the appellant to be heard,  decide on the matter as quickly as it is feasible.<\/li>\n<\/ul>\n\n\n\n<p><strong><em>Penalties\n<\/em><\/strong><em><\/em><\/p>\n\n\n\n<ol>\n<li>Someone violates any of the rules in this\nAct and the regulations enacted under it. In that case, he\/she will be punished\nwith imprisonment for a period that may be extended to two years or with a fine\nthat could be up to fifty thousand rupees or both.<\/li>\n\n\n\n<li>The\nperson who is punishable under subsection (1) includes a corporation or another\ncorporate body; each Director, Manager, Secretary, Officer, or Agent will\nunless he can demonstrate that the contravention occurred without his\nknowledge. He took all the necessary precautions to stop the infringement and be\nfound guilty of the violation<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Power_to_exempt_under_Brick_Kilns_Regulation_Act_2010\"><\/span>Power to exempt under Brick Kilns Regulation Act, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>By special or general order or special\norder, the Government can exclude any particular area from the effect of all or\nany provisions under the Act. It may also amend, vary, or cancel any of these\norders.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Protection_of_action_taken_under_Brick_Kilns_Regulation_Act_2010\"><\/span>Protection of action taken under Brick Kilns Regulation Act, 2010<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A lawsuit, prosecution, or legal action\nwill be brought against any officer or authority for any action done with good\nfaith or planned to be carried out according to the Act and any other rule or\ndecision made under it. Any suit or legal actions shall be brought on behalf of\nthe Government for any loss caused or likely to cause due to anything done in\ngood faith or is intended to be carried out under this Act and any other rule\nor order issued under it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Takeaway\"><\/span>Takeaway<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Brick Kins Regulation Act, 2010 helps in controlling the establishment of Brick Kilns in the respective State.
