There is also the Department of Legal Metrology or Department of weights and measures in different states to regulate the use of weights and measures. These departments are also regulating the model approval for Indian weights and measures instruments. Testing is mandatory for model approval for Indian Weights and Measures instruments.&nbsp;<\/p>\n\n\n\n<p>As stated in Section 22 of the Legal Metrology Act 2009, every weight and measure instrument must satisfy the standards set by the Department of Legal Metrology. The power of model approval for Indian weights and measures instruments lies with the Department of Legal Metrology governed by the Government of India under the ambit of the <strong>Ministry of Consumer Affairs<\/strong><sup><a href=\"https:\/\/consumeraffairs.nic.in\/\"><strong>[1]<\/strong><\/a><\/sup>, Food and Public Distribution located in New Delhi.&nbsp;<\/p>\n\n\n\n<p>The\nmanufacturer should obtain such model approval before manufacturing the weights\nand measures instruments. With the application of model approval for Indian\nweights and measures instruments, the manufacturer must provide the requisite\nfee and all the required documents as per the Legal Metrology laws.&nbsp;<\/p>\n\n\n\n<p>A\nminimum of two samples of each model should be sent for testing to labs\nestablished by the Government. For such testing, the Government has set up\neight laboratories at different places in India. Once the testing is done\nsuccessfully, the Director of the Legal Metrology Department issues the\ncertificate for model approval for Indian weights and measures instruments to\nthe manufacturer.&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Application_of_Model_Approval_for_Indian_Weights_and_Measures\"><\/span>Application of Model Approval for Indian Weights and Measures<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\napplication of model approval for Indian weights and measures instruments\nshould be made to the Director of the Legal Metrology Department. The\nfollowings should be the contents of the application:<\/p>\n\n\n\n<ul><li>Details\n     of the applicant, such as name and address<\/li><li>Brief\n     descriptions of weights and measures, including class and uses<\/li><li>Metrological\n     and technical characteristics and qualities of weights and measures<\/li><li>Test\n     procedure<\/li><li>Trade\n     or brand name and types of weights and measures<\/li><li>The fee\n     as required by the Government<\/li><li>At\n     least two copies of sketch and drawing of general arrangements and\n     installation, including details of construction of such weights and\n     measures<\/li><li>No less\n     than two copies of documents describing the followings:<\/li><\/ul>\n\n\n\n<ol><li>Principle\n     of construction and method of operation<\/li><li>Safety\n     devices are provided to prevent the fraudulent or inaccurate\n     operation&nbsp;<\/li><li>Manned\n     and extend to which the weights and measures are corrected or adjusted<\/li><li>Place\n     where verification stamp or seal has been affixed.<\/li><li>General\n     arrangements and installation drawings, including detailed installation\n     instruction (if necessary) of weights and measures<\/li><li>Photographs\n     of model<\/li><li>Actual\n     circuit diagram<\/li><li>Copies\n     of the user manual, printed pamphlet, etc.<\/li><li>Any\n     other information<\/li><\/ol>\n\n\n\n<ul><li>If the\n     weight or measure is provided with supplemental or additional devices,\n     then full information of such supplemental or additional devices.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Test_for_model_approval_for_Indian_weights_and_measures\"><\/span>Test for model approval for Indian weights and measures&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nmodel submitted for model approval for Indian weights and measures instruments\nneeds to go for a test of assessment of its fitness. Such test should be made\nwith a view to:<\/p>\n\n\n\n<ul><li>Ascertain\n     whether the model conforms to the standard established by the Act or rules\n     made thereunder; or any International Organisation.&nbsp;<\/li><li>To find\n     out the ability of the model to maintain the accuracy and technical\n     characteristics or qualities after it has been put to work for a minimum\n     number of times as the Director specifies.<\/li><li>Determine\n     the performance of the model under varied conditions of use.<\/li><li>Determine\n     the metrological and technical characteristics of the use<\/li><li>Determine\n     whether they carry mandatory declarations as required by Legal Metrology\n     laws<\/li><li>Determine\n     whether the place of sealing of instrument as suggested by the\n     manufacturer is sufficient to prevent the fraudulent use<\/li><li>Determine\n     the behaviour of the model<\/li><\/ul>\n\n\n\n<p>Every\nmodel for approval should be tested as per the procedure stated by the Director\nof the Department or recognised laboratory.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Certificate of Recognition to the Laboratories<\/h3>\n\n\n\n<p>The\nlaboratory that seeks to carry out the test for model approval should apply to\nthe Director, and the principal officer should make the application to the\nlaboratory. One or more officers are sent by the Director to such applicant\nlaboratory to obtain the following information:<\/p>\n\n\n\n<ul><li>Measuring\n     equipment, testing facility and properly maintained building<\/li><li>Qualified\n     staff and components to undertake the test<\/li><li>Appropriate\n     environment<\/li><li>Adequate\n     recording system<\/li><li>Expeditious,\n     efficient and adequate service<\/li><li>Ready\n     and willing for verification by the appropriate laboratory as specified by\n     the Director&nbsp;<\/li><li>Certified\n     by the NABL (National Accreditation Board of Laboratories)<\/li><\/ul>\n\n\n\n<p>After\nobtaining the information, the Director issues a certificate of recognition and\na code number to such applicant laboratory. The principal officer shall annually\nreport to the Director about the details of the test along with the fee\nmade.&nbsp;<\/p>\n\n\n\n<p>In\ncase of urgent necessities, the Director may grant a provisional certificate of\nrecognition to any laboratory which fulfils the requirements after taking the\nconsent of its principal officer. This provisional certificate will be valid\nfor one year only. But the manufacturer can apply for an extension of this one\nyear if the test is not completed in this one year.&nbsp;<\/p>\n\n\n\n<p>The\ncertificate of recognition can be suspended by the Director if any of the\nabove-mentioned conditions is violated, but the suspension will be done only\nafter giving an opportunity of showing no cause. Once the violation, omission\nor failure of the condition is made good, the suspension shall stand vacated. The\ncertificate of recognition can be cancelled in case the laboratory cannot\nfunction properly or is guilty of corrupt practices.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Testing of Substitute Material<\/h3>\n\n\n\n<p>The\nsubstitute material should be sent within seven days from its commencement by\nthe manufacturer to the Director, who will forward it to the recognised\nlaboratory for testing. If the laboratory finds that the substitute material is\nnot suitable, then the proposed model should be treated as a new model. The\nrecognised lab will send the finding to the Director, who will forward it to\nthe Central Government for model approval for Indian weights and measures\ninstruments.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Fee for the test by Recognised Laboratory&nbsp;<\/h3>\n\n\n\n<p>The\ngovernment fee for the testing of the model intended to be manufactured for\nsale, purchase, delivery or distribution in the course of trade:<\/p>\n\n\n\n<ul><li>Demand\n     draft of Rs. 5,000\/- for testing of mechanical type model<\/li><li>Demand\n     draft of Rs. 10,000\/-for testing digital\/electronic type of model<\/li><\/ul>\n\n\n\n<p>&nbsp;For\ntesting of substitute material, half of the above-mentioned fee needs to be\npaid.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Model_Approval_for_Indian_weights_and_measures\"><\/span>Procedure for Model Approval for Indian weights and measures&nbsp;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After\ncompletion of the test, the laboratory sends its report to the Director with\nits recommendation on whether the model is as per standards stated in laws of\nlegal metrology. The Director, after examining the report, sends it to the\nCentral Government and shall recommend the Central Government issue the\ncertificate of Model Approval for Indian weights and measures instruments. The\ncentral Government then issue the certificate and authorise him to authenticate\nthe certificate on its behalf. A code number shall be assigned to the model,\nand it shall be mentioned in the certificate of model approval.&nbsp;<\/p>\n\n\n\n<p>If\nthe recognised laboratory does not recommend model approval, then it can be\nre-submitted after making modifications. This re-submission shall be treated as\nfresh submission, and it will attract the requisite fee as a fresh\nsubmission.&nbsp;<\/p>\n\n\n\n<p>The\ncertificate shall become effective after publication in the official gazette by\nthe Director.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Contents_of_Certificate_of_Model_Approval\"><\/span><strong>Contents of Certificate of Model Approval&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\ncertificate of model approval for Indian weights and measures instruments shall\ncontain:<\/p>\n\n\n\n<ul><li>Number\n     of the certificate<\/li><li>Description\n     of the model (brief)<\/li><li>The\n     mark assigned<\/li><li>The\n     category of instruments<\/li><li>Result\n     of tests<\/li><li>Verification\n     and use of instruments<\/li><li>The\n     place where the verification seal or stamp is to be affixed<\/li><\/ul>\n\n\n\n<p>The\nmark assigned to the certificate must contain the followings:<\/p>\n\n\n\n<ul><li>The\n     National Identification Letter<\/li><li>The\n     last two digits of the year in which the certificate was issued<\/li><li>Code\n     number of laboratory<\/li><li>Code\n     number of model<\/li><\/ul>\n\n\n\n<p>The\nmark should be affixed at the place of manufacture and the instrument\nmanufactured.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Revocation_and_Suspension_of_Certificate_of_Approval\"><\/span><strong>Revocation and Suspension of Certificate of Approval&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\ncertificate of model approval for Indian weights and measures instruments may\nbe revoked by the Central Government in the following cases:<\/p>\n\n\n\n<ul><li>If it\n     no longer complies with the Unit specified under the Rules<\/li><li>It has\n     ceased to conform to standards for the time being in force<\/li><li>The\n     manufacturer is not following any of the condition<\/li><li>Defects\n     in reliability, accuracy and performance of the weights or measures<\/li><li>The\n     manufacturer or any other person has altered the model or circuit diagram<\/li><li>When\n     the approved design has been altered<\/li><\/ul>\n\n\n\n<p>Before\nsuch revocation, an opportunity to show cause against the proposed action\nshould be given to the holder of such certificate. The production of such\ninstruments shall be stopped after the revocation.&nbsp;<\/p>\n\n\n\n<p>The\nDirector can suspend the certificate of model approval for Indian weights and\nmeasures Instruments in case of any omission or failure on the part of the\nholder of such certificate. The suspension will not be done without giving any\nopportunity to show cause to the holder of such a certificate.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The\nrevocation and suspension of the certificate of the model shall be published in\nOfficial Gazette.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Model Approval for Indian weights and measures instruments is granted by the Director of the Department of Legal Metrology. Such Model Approval is guided by the Legal Metrology (Model Approval) Rules, 2011, passed by Central Government under Section 22 of the Legal Metrology Act. There should be mandatory testing of the model before issuing the certificate of model approval for Indian weights and measures instruments. The Model Approval shall be notified in the Official Gazette by the Director.
