If not managed\nproperly, then it can have repercussions on the environment. Disposal of such\nwastes in the environment without any proper treatment can lead to pollution of\nland and water resources.&nbsp;<\/p>\n\n\n\n<p>Preventive measures are required to handle the generation and import of <strong>hazardous waste<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Hazardous_waste\"><strong>[1]<\/strong><\/a><\/sup>, and for this, the Central Government has notified some rules. The import of\nhazardous waste material to India without permission will be treated as illegal\ntrafficking. The importer of hazardous waste material must provide all the\ndetailed information to the Customs Authorities.&nbsp;<\/p>\n\n\n\n<p>The\nimporter importing hazardous waste to India should comply with the Articles of\nBasel Convention to which the Indian Government is a signatory. If any dispute\narises regarding the grant of permission to import of hazardous waste material\nto India, then it shall be referred to the Central Government for\ndecision.&nbsp;<\/p>\n\n\n\n<p>Rule\n13 deals with the import of hazardous waste. According to this rule, the\noccupier who wants to import such waste material shall apply to the State\nPollution Control Board or the appropriate committee. Such application should\nbe made before 120 days of the intended date of commencement of shipment. The\nSPCB examines the application within 30 days and forwards it with\nrecommendation and stipulation of transport, processing and storage to the Ministry\nof Environment &amp; Forest. The Ministry, after receiving the application from\nSPCB, will examine it and, after satisfying itself, shall grant permission for\nthe import of hazardous waste material to India. But such permission shall be\nsubject to certain conditions, such as:&nbsp;&nbsp;<\/p>\n\n\n\n<ul><li>Environment-friendly or appropriate technology should be used for re-processing.<\/li><li>The capability to handle and re-process such waste should be in an      environmentally sound manner.<\/li><li>There should be an accurate facility for the disposal and treatment of such wastes.\u00a0<\/li><li>There must be a no-objection certificate, approval and authorization from all appropriate authorities.\u00a0<\/li><\/ul>\n\n\n\n<p>The\nMinistry shall then forward the copy of permission to the Central Pollution\nControl Board (CPCB), State Pollution Control Board (SPCB), and concerning port\nand Customs Authorities for ensuring compliance with conditions of import and\nsafe handling of waste at the time of off-loading.&nbsp;<\/p>\n\n\n\n<p>The\noccupier, with permission for import, shall inform SPCB and CPCB and Port\nAuthorities 10 days prior to the arrival of the hazardous waste consignment.\nSuch occupiers importing hazardous waste material shall maintain a record of\nall the hazardous waste imported to India, and such records should be available\nfor inspection. Occupiers who are involved in the import of hazardous waste\nshould register themselves with the Ministry of Environment &amp; Forest or any\nother appropriate authority or agency.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"License_for_Import_of_Hazardous_Waste_Material_to_India\"><\/span><strong>License for Import of Hazardous Waste Material to\nIndia<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>An\napplication for a license to the Directorate General for Foreign Trade shall be\naccompanied by permission granted by the Ministry of Environment &amp; Forest\nto the importer.&nbsp;<\/p>\n\n\n\n<p>A\ntrader who wants to indulge in the import of hazardous waste material to India\nis required to have a license. Without the license, they cannot import such\nhazardous waste materials. the license is granted by the pollution board.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Documents for Import License&nbsp;<\/strong><\/h3>\n\n\n\n<p>The\nfollowings are the required documents for the license for import of hazardous\nwaste material to India:<\/p>\n\n\n\n<ul><li>Import Code issued by the Directorate General of Foreign Trade.<\/li><li>Certificate of GST<\/li><li>Identity Proof<\/li><li>Copy of  Address Proof<\/li><li>Details of the waste to be imported to India<\/li><li>Copy of purchase order\/invoice<\/li><li>Details of actual user<\/li><li>NotarizedMOU for selling imported scraps to actual user<\/li><li>Partnership Deed\/ AOA (if applicable)<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Process for Import License<\/strong><\/h3>\n\n\n\n<p>The\nlicense for import of hazardous waste material is generally granted for metal,\npaper, plastic and e-waste scrap import. The procedure to obtain a license for\nthe import of hazardous waste material to India has the following steps:<\/p>\n\n\n\n<ul><li>Filing of application with requisite documents<\/li><li>Inspection of application by the appropriate authority<\/li><li>Issuance of license<\/li><\/ul>\n\n\n\n<p>There\nwill be yearly compliance of the, if applicable, and renewal of the\nlicense.&nbsp;<\/p>\n\n\n\n<p>The\nlicense for import of hazardous waste material is generally granted for metal,\npaper, plastic and e-waste scrap import.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Illegal_Traffic_in_case_of_import_of_hazardous_waste_material_to_India\"><\/span><strong>Illegal Traffic in case of import of hazardous\nwaste material to India<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nimport of hazardous waste material to India shall be considered illegal if it\nis without permission of the Central Government or the permission has been\nobtained through fraud, misrepresentation or falsification. It is considered to\nbe illegal if it does not conform to the shipping details as provided in the\ndocuments.&nbsp;<\/p>\n\n\n\n<p>In\ncase of any illegal import of hazardous waste material to India, it shall be\nreturned back within 30 days to the exporter or the exporting country, or it\nshall be disposed of in 30 days from the date of off-loading to inability to\ncomply with the above-stated point then in accordance with the procedure laid\ndown by the State Pollution Control Board or Central Pollution Control\nBoard.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The waste that by reason of its chemical, physical, flammable, toxic, reactive, explosive or corrosive character causes danger to the environment or health of human beings, solely or with the contact of different substances is called hazardous waste. The Central Government has made rules for controlling and managing such hazardous waste. The import of hazardous waste material to India is not permitted, though it can be allowed for the purpose of recycling or reuse after permission is granted by the appropriate authority. With the permission, there is a grant of license too for the importer of such hazardous waste, such license is mandatory, and without it, the import of such waste is not possible.
