An application\nfor model approval needs to be filled with documents and details of the model.\nUpon approval, a unique code is assigned to the instruments, which is affixed\non the label of such instruments at the time of they are sold. The model\napproval can be suspended by the authority in case of failure to comply with\nthe rules and standards set by the legal metrology department in the Act or\nrules made thereunder. The Director of the legal metrology department shall\ncause the model certificate to be published in the Official Gazette, and the\ncertificate of model approval will be effective from the date of such\npublication.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_22_of_the_Legal_Metrology_Act\"><\/span><strong>Section 22 of the Legal Metrology Act<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Model approval for imported weights and measures Instruments is issued by the Legal Metrology department as per the Section 22 of the <strong>Legal Metrology Act 2009<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/2102?sam_handle=123456789\/1362\"><strong>[1]<\/strong><\/a><\/sup> to importers of weights and measures instruments.\u00a0<\/p>\n\n\n\n<p>According to this section, every importer importing weights and measures must obtain a model approval for imported weights and measures instruments. Under proviso of this section states that approval cannot be required for some products such as cast iron, brass, bullion, carat weight, beam scale, length measures (not measuring tapes) which are basically used in retail trade for measuring textile and timber, capacity measures (not exceeding twenty litres) used in retail trade for measuring kerosene, milk or potable liquors. The section has given a further exception (proviso) that the prescribed authority may, after satisfying that the model of any weight and measure has been approved in a foreign country conforms to standards given under <a href=\"https:\/\/corpbiz.io\/legal-metrology-act-registration\"><strong>Legal Metrology Act<\/strong><\/a> or rules, approve such models without any test or after the test as if deems fit.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_Metrology_Model_Approval_Rules_2011\"><\/span><strong>Legal Metrology (Model Approval) Rules 2011<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nissuance of model approval for imported weights and measures instruments by the\nCentral Government is governed by the Legal Metrology (Model Approval) Rules.\nIt regulates uniform and standard use of instruments in the market and thereby\navoids faulty and unauthorised instruments. The testing of each model\ninstrument in government-approved laboratories has been mandatorily required by\nthis Rule.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_for_Model_approval_for_imported_weights_and_measures\"><\/span><strong>Documents for Model approval for imported weights and measures<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Documents\nrequired for Model approval for Imported Weights and Measures instruments:<\/p>\n\n\n\n<ul><li>Certificate of incorporation\/ Certificate of Partnership deed, in case of partnership firm<\/li><li>Memorandum of Association<\/li><li>Other business licenses related to the business<\/li><li>Schematic diagram of the model (weights and measures)<\/li><li>Two passport-sized photographs\u00a0<\/li><li>A declaration that no change had been made to the product before it was put on sale in India<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_procedure_of_Model_Approval_for_imported_Instruments\"><\/span><strong>The procedure of Model Approval for imported Instruments<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nprocess of model approval for imported weights and measures instruments\nincludes the following steps:<\/p>\n\n\n\n<ul><li>Filing of application form<\/li><li>Submission of duly filled form along with all the requisite documents<\/li><li>Initial inspection\/assessment by the legal metrology department<\/li><li>If the department is satisfied that no error exists in the application form, then it will grant the model approval certificate.\u00a0<\/li><\/ul>\n\n\n\n<p>In\nthe case of model approval for imported weights and measures instruments of the\nproduct, testing is not required.&nbsp;&nbsp;<\/p>\n\n\n\n<p>If\nthe model submitted for approval is not up to the mark, it is resubmitted for\napproval after making required modifications, and it should be treated as a\nfresh application for approval of the model.&nbsp;<\/p>\n\n\n\n<p>The\napplication for model approval for imported weights and measures instruments\nshall contain the following requisite:<\/p>\n\n\n\n<ul><li>the name and address of the applicant,\u00a0<\/li><li>name and address of manufacturer and dealer in India,<\/li><li>a brief description, class and use of weights and measures<\/li><li>data regarding metrology and technical characteristics of weights and measures<\/li><li>trade or brand name and type of weights and measures.<\/li><li>Government required fee<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Contents_of_Model_Approval\"><\/span><strong>Contents of Model Approval&nbsp;<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\ncontents of the certificate of model approval for imported weights and measures\ninstruments shall contain:<\/p>\n\n\n\n<ul><li>Number of the model approval certificate<\/li><li>Brief description of the model\u00a0<\/li><li>Mark assigned to the model after approval<\/li><li>The category of approved weights or measures<\/li><li>Other requirements as per the Legal Metrology (Model Approval) Rules 2011<\/li><\/ul>\n\n\n\n<p>If\nthe model approval is issued for any special use of weights or measures, then\nthe certificate of such weights or measures should mention the special\nuse.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mark_of_Approval\"><\/span><strong>Mark of Approval<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nmark assigned to the weights and measures after approval should contain the\nfollowing:<\/p>\n\n\n\n<ul><li>National identification number<\/li><li>The last two digits of the year in which it was issued<\/li><li>Code number of the model<\/li><\/ul>\n\n\n\n<p>Such\nmarks should be affixed at the specified place of the model as mentioned in the\ncertificate, and if the mark cannot be affixed, then it will be associated with\nit as per the conditions stated in the certificate. If the model approval for\nimported weights and measures instruments is of limited character, then the\nmark shall be accompanied by a special mark stating limitations of approval,\nand there should be different special marks for each limitation.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Revocation_and_Suspension_of_Certificate_of_Approval\"><\/span><strong>Revocation and Suspension of Certificate of Approval<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nCentral Government may revoke the certificate of model approval for weights and\nmeasures instruments in the following cases:<\/p>\n\n\n\n<ul><li>If it no longer complies with the unit specified under the Rules<\/li><li>It has ceased to conform to standards for the time being in force<\/li><li>Defects in reliability, accuracy and performance of the weights or measures<\/li><li>When the approved design has been altered<\/li><\/ul>\n\n\n\n<p>Before\nsuch revocation, the holder of such certificate should be given an opportunity\nto show cause against the proposed action. Once the revocation is done, the\nproduction of such instruments shall be stopped.&nbsp;<\/p>\n\n\n\n<p>The\nDirector of the Department of Legal Metrology may suspend the certificate of\nmodel approval for imported weights and measures Instruments in case of any\nomission or failure on the part of the holder of such certificate. The\nsuspension will not be done without giving such a holder an opportunity to show\ncause.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The\nrevocation and suspension of the certificate of the model shall be published in\nOfficial Gazette.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Model Approval for imported weights and measures instruments is granted by the Department of Legal Metrology as per section 22 of the Legal Metrology Act, 2009. Such Model Approval is guided by the Legal Metrology (Model Approval) Rules, 2011, and it has rules related to the procedure, revocation and suspension to obtain such model approval. The Model Approval shall be notified in the Official Gazette by the Director. The model approval shall be accompanied by a certificate.
