Every manufacturer, importer dealer, repairer, or manufacturer requires a valid license from the Department of Legal Metrology before conducting their respective activities.<\/p>\n\n\n\n<p><strong><em>Instruments\nsuch as thermometers, weighing scales, balances, hygrometers pressure monitors,\nmeasuring tapes, etc., fall within the authority of the Legal Metrology\ndepartment<\/em><\/strong>. <\/p>\n\n\n\n<p>In general, we\ncan say, any device that is designed for weighing or measuring any item in a\ncertain amount on the imperial or metric scale is within the jurisdiction of\nLegal Metrology.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Overview_on_the_Dealer_License_under_Legal_Metrology_Act\"><\/span>An Overview on the Dealer License under Legal Metrology Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The applicability of the Dealer license implies on a person or company involved in the trading and marketing of weights and measures. For obtaining the Dealer license, an applicant shall follow the provisions of State Legal Metrology (Enforcement) Rules, 2011 of the Legal Metrology Enforcement Rules, 2010.<\/p>\n\n\n\n<p>If the\nimporter or manufacturer wants to act as the Dealer of the equipment, they must\nalso obtain the Dealer License and the importer\/manufacturer license.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Form_Required_for_filing_Dealer_License\"><\/span>Form Required for filing Dealer License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To apply for a\nDealer License in weights and measurements, Form LD-1 in accordance with\nschedule-IIA is required. For the renewal application of a dealer&#8217;s license\nForm, LD-2 in schedule IIB is needed, and it is issued using the form LD-3 as\nper schedule III.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_for_obtaining_the_Dealer_License\"><\/span>Process for obtaining the Dealer License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The process of\nobtaining the Dealer license varies from state to state, and different states\nhave different application fees and timelines for approval of the permit. Once\nissued, the Dealer license is valid for a minimum period of one year and a\nmaximum period of five years.<\/p>\n\n\n\n<p>If a dealer\naims to trade and market weights and measures in more than one state, he\/she\nmust apply for a separate dealer license for each desired state of working.<\/p>\n\n\n\n<p>The document\npreparation, filing application, and other considerable and minor work is\ntiresome and time-consuming, especially if the applicant is not well familiar\nwith the process. Moreover, the application procedure may take around a few\nmonths to complete without daily follow-ups. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Documents_required_for_Dealer_License\"><\/span>Documents required for Dealer License<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To apply for a\ndealer license of weights and measures, below mentioned documents must be\nattached with the Form LD1. <\/p>\n\n\n\n<p>1. Applicant&#8217;s\nDetails<\/p>\n\n\n\n<p>2. Applicant&#8217;s\nPermanent Resident Certificate. <\/p>\n\n\n\n<p>3. <strong>Affidavit<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Affidavit\"><strong>[1]<\/strong><\/a><\/sup> confirming that the applicant will follow the norms of the Act\/ rules under which the license is sought and that the details provided is accurate. <\/p>\n\n\n\n<p>4. If the\napplicant is the owner of the premise, then the documents such as Tax receipt\nof local body\/authority. However, if any other family member holds the\npremises, their consent letter is duly notarized, and a record of ownership is\nrequired. <\/p>\n\n\n\n<p>On the other\nhand, copy the registered agreement if the premises are for rent. <\/p>\n\n\n\n<p>5. Relevant\ndocument related to the Business: Any relevant papers such as <\/p>\n\n\n\n<ul><li>Certificate of registration of industry, <\/li><li>If the unit is present within the village panchayat\narea, Registration under the Shops and Establishments Act shall be required.\nAlso, NOC is required from that Gram panchayat. <\/li><\/ul>\n\n\n\n<p>6. A\nregistered document is required in the proprietorship\/partnership firm. A\nregistration certificate is required in the case of Companies. Also, MOA and\nAOA shall be required <\/p>\n\n\n\n<p>7. Copies of\nappointment letters of employees along with photographs, qualifications, and\nexperience certificates, if any. <\/p>\n\n\n\n<p>8.\nRegistration certificate of Trademark\/logo(If any) from the competent\nauthority. <\/p>\n\n\n\n<p>9. Latest\nelectricity bill. <\/p>\n\n\n\n<p>10. Site plan\nof trading premises<\/p>\n\n\n\n<p>11. Experience\ncertificate (if any). <\/p>\n\n\n\n<p><strong>Note-The\nreceipt (Original Treasury challan) of the fee of Rs. 100 Only to be paid into\nthe Department account.<\/strong><\/p>\n\n\n\n<p>Another option\nis that an applicant can deposit the fee with the concerned Legal Metrology\nOfficer against a valid Government Receipt. The true copy of that GR shall be\nattached with the form. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Issuance_of_a_Dealership_license\"><\/span>Issuance of a Dealership license<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>After receipt\nof Form LD1 duly annexed with all the documents mentioned above, the licensing\nauthority shall duly scrutinize the application along with the requisite\ndocuments. If the application form and attachments are accurate as required,\nthe authority will issue a license within 30 days of such receipt. <\/p>\n\n\n\n<p>However, there\nmight be a possibility that the authority refuses the application due to\nnon-compliance with all or any of the requisites. The reason for such rejection\nshall be duly communicated within 15 days to the applicant. The process of\nissuing the license, to the max, shall be completed within the scheduled time. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Renewal_of_Dealer_license\"><\/span>Renewal of Dealer license<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>For Renewal of the <a href=\"https:\/\/corpbiz.io\/rubber-board-license\"><strong>dealer license<\/strong><\/a>, an applicant must submit Form LD2 along with the dealer license. An applicant must pay Rs One Hundred only for the Renewal of the dealer license.<\/p>\n\n\n\n<p>Note- If the\napplicant is calling for objections, Cutting of Newspaper wherein a notice is\ngiven must be filed with the department concerned within seven days. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Conclusively, we can say that Legal Metrology has definite and stringent rules related to Weighing and measuring instruments.
