and the Standards of Weights & Measures (Enforcement) Act, 1985<\/em><\/strong>. The provisions of the Act came into force on April 01, 2011. The Act was passed to set standards of measures & weights in trade & commerce and to guarantee the public security and legality in products or services of an owner.<\/p>\n\n\n\nFollowing are some salient features of the Legal\nMetrology Act:<\/em><\/strong><\/p>\n\n\n\n- The Act defines the metric\nsystem as the units of measures & weights, which should be in accordance\nwith the international system of units.<\/li>
- As per Section 5 of the Act,\nthe base unit of weights & measures are as follows:<\/li>
- For time-second;<\/li>
- For luminous intensity \u2013\nCandela;<\/li>
- For mass-kilogram;<\/li>
- For length \u2013 meter;<\/li>
- For electric current \u2013 ampere;<\/li>
- For the amount of substance \u2013\nmole;<\/li>
- For thermodynamic temperature \u2013\nLevin.<\/li>
- The base units for numeration\nare specified as the international form of Indian numerals, numeration shall be\nmade as per the decimal system, as mentioned under Section 6 of the Act.<\/li>
- The Act authorised the Central\nGovernment to form rules as & when needed.<\/li>
- Any non-standard weights &\nmeasures shall not be imported.<\/li>
- All the repairers, sellers, and\nmanufacturers need to obtain a license from their respective Controller.<\/li>
- An importer needs to get\nregistered themselves with the concerned Director. <\/li>
- An individual dealing in\nimporting or manufacturing shall get the consent of the model of weight and\/or\nmeasure before manufacturing\/importing from the competent authority.<\/li>
- Any usage, method, practice, or\ncustom apart from the manner prescribed in the Act which is contrary to the Act\nshall be void.<\/li>
- The Act authorised the Central\nGovernment to form rules as & when needed.<\/li>
- The Act facilitates the Union\nGovernment power to appoint a Director of Legal Metrology to accomplish duties\nconcerning inter-state trade & commerce, and the Act also provides the\nState Government shall appoint a Legal Metrology Controller to perform duties\nregarding intra-state trade & commerce.<\/li><\/ul>\n\n\n\n

Cancellation of Legal Metrology Act License<\/h2>\n\n\n\n
Following are the reason for the Suspension or\nCancellation of Legal Metrology Act License:<\/p>\n\n\n\n
- When the Controller is pleased\nafter the inquiry that the license holder has contravened any law or has made\nincorrect or false statements of any nature mentioned under sub-rule (1), he or\nshe shall cancel the Legal Metrology License. However, reasonable opportunity\nshall be provided to the license holder to show cause against such an order.<\/li>
- Every licensee whose license\nwas cancelled shall surrender their license to the competent authority.<\/li>
- Every licensee after the\nsuspension or cancellation of Legal Metrology Act License shall dispose of\ntheir weights & measures within 30 days of time, or any such further\nperiod, which shall not exceed three months. In case he or she fails to do so,\nthen the Controller or any such authority\/officer authorised on their behalf,\nin writing, may seize & dispose of\/distribute, in the manner prescribed.<\/li>
- In case any license holder\nmakes any statement that is false\/incorrect in any material particular\/has\ncontravened any provision of the Act\/any rule, then the Controller or any other\nofficer certified by them may order to cancel the license. However, a sensible\nopportunity shall be given to the owner of the license to show cause against\nsuch an order. Moreover, if the inquiry is not completed within 3 months from\nthe suspension date of the license, such suspension or cancellation shall stand\nvacated on the expiry of such period.<\/li>
- The licensee shall immediately\nstop worming and shall not resume business after their license gets suspended.<\/li><\/ol>\n\n\n\n
