pertaining to the name availability of Section 8 entities must be made in the &#8216;Reserve Unique Name&#8217; facility. It is worth noting that the words like Private Limited or Limited cannot be a part of the name of <a href=\"https:\/\/corpbiz.io\/learning\/what-are-section-8-companies\/\"><strong>Section 8 Company<\/strong><\/a>. <\/p>\n\n\n\n<p>The\nSection 8 company name should end with the standard terms such as a forum,\nfoundation, federation, association, confederation, chambers, electoral trust,\ncouncil, etc. The RUN service allows the proposal of two names at once and a\nresubmission.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Overview_on_RUN_Service\"><\/span>An Overview on RUN Service<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The MCA\nhas eased out the company name approval process by launching a new digital\nportal called Reserve Unique Name (RUN) on 26th January 2017. It is a\nuser-friendly and intuitive process that aids in name reservation for a new\ncompany or name alteration for an existing company. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Where_to_locate_the_RUN_facility_and_who_can_use_it\"><\/span>Where to locate the RUN facility, and who can use it?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Only a\nregistered applicant of the MCA web-based portal can file an application under\nthe RUN service. Once the applicant has logged onto the portal, he must opt for\nRUN service from the main menu. An individual intending to register a new\ncompany or change the name of a prevailing company can use this service for\nname reservation. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Vital_Requirements_for_Reserving_Section_8_Company_Name\"><\/span>Vital Requirements for Reserving Section 8 Company Name<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>When a\nperson applies to the portal to reserve the name of a new company or alter the\nname of an operating company, it has to be ensured that the proposed name(s)\nare valid and not banned under the Company Name Availability guidelines. <\/p>\n\n\n\n<p>A\nsearch related to trademark is also conducted to ensure that such names are in\nline with the provisions of Section 4(2) of the Companies Act 2013. The desired\nname shall be rejected if it violates the underlying guidelines. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Validity_of_a_Name_Approval\"><\/span>Validity of a Name Approval<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>A\ncompany whose name has secured approval according to the RUN&#8217;s guidelines remains\nvalid for duration of: <\/p>\n\n\n\n<ul>\n<li>20 days from the approval date (in case the name\nreservation is made for a new company)<\/li>\n\n\n\n<li>60 days from the approval date (to alter the\nexisting company&#8217;s name)<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Submission_of_Objects\"><\/span>Submission of Objects<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The objects of the proposed entity have to be shared along with the relevant submission to bolster the proposed name. As of now, applicants are allowed to submit only one name in the <strong>RUN form<\/strong>. There is no arrangement of adding multiple names in the application in the preference order. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"NOC_submission_for_Reserving_Section_8_Company_Name\"><\/span>NOC submission for Reserving Section 8 Company Name<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>There\nis no requirement to attach any documentation while furnishing a RUN\napplication. However, it is recommended to furnish NOC from the prevailing\nentity or consent from relevant agencies and other submissions to support the\nname application. All submissions must be filed as a sole document; the file\nsize should not surpass 6 MB. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Application_Fee_and_Receipt_Generation\"><\/span>Application Fee and Receipt Generation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>All\napplications shall go along with an application fee amounting to Rs 1000. Upon\napplication and fee submission, the portal shall generate a receipt enclosing\nthe SRN or Service Request Number. The SRN encloses the fees details paid by\nthe applicant. There is no refund relating to a fee in case the application is\nrejected for any reason. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_there_has_any_criteria_of_Resubmission_under_RUN_services\"><\/span>Is there has any criteria of Resubmission under RUN services? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The\nname applied might attract either approval or rejection of authority, with nil\npossibility of resubmissions. A fresh payment worth Rs 1000 must be remitted\nfor application furnished via the RUN facility. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Application_Scrutiny_by_the_Central_Registration_Centre\"><\/span>Application Scrutiny by the Central Registration Centre<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>All\nname applications shall undergo processing conducted by Central Registration\nCentre. The name applied shall be thoroughly scrutinized by the CRC. Upon\ncompleting this, the authority decides whether to accept or reject the\napplication. The information regarding this shall be duly shared with the\napplicant via e-mail.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Precautions_to_be_taken_to_avert_the_likelihood_of_application_rejection\"><\/span>Precautions to be taken to avert the likelihood of application rejection<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>To\navert the possibility of the application rejection, the applicant must get\naccustomed to the Companies (Incorporation) Rules 2014 and should perform a\ntrademark search. <\/p>\n\n\n\n<p>The\nCentral Registration Centre performs a name check by taking phonetic\nsimilarities and similar meanings into account. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p> Section 8 company name rule is not as complicated as it seems on the surface.
