The reasoning behind\nthis decision is best discovered by studying the following instances.<\/p>\n\n\n\n<p>1. If the person is appointed as the\nDirector of the company, and there&#8217;s been wrongdoing committed by the company\nthat violates the Legal metrology act, then being a director of that company,\nyou would be solely accountable and liable for any penalty accordingly. You&#8217;ll\nbe the one to pay the fines, while your company&#8217;s security would be assured.<\/p>\n\n\n\n<p>2. If the company does not nominate the Director to handle the legal aspects of your business&#8217;s products or service and the company is found to have committed an act that is in direct contravention to the legal metrology act, then the entire company will be held accountable. Also, the company will be subject to a penalty.<\/p>\n\n\n\n<p><strong>The penalty could range from a\nsubstantial penalty fee or, depending on the gravity of the offence, can result\nin the company&#8217;s liquidation.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Requirements_for_Directors_Nomination_in_the_cases_of_associations_or_firms_of_individuals\"><\/span>Requirements for Directors Nomination in the cases of associations or firms of individuals-<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 49 of the Legal Metrology act\nclarifies the reasons behind the Director&#8217;s Nomination. Also, Subsection (7) of\nSection 49 describes the role of the Director and the company. Where<\/p>\n\n\n\n<ul><li><strong>&#8220;Company&#8221;\nalso refers to Firms and associations of individuals.<\/strong><\/li><li><strong>Directors\nalso mean &#8220;partners&#8221; in the case of a firm.<\/strong><\/li><\/ul>\n\n\n\n<p>However, it is to be considered that the\nperson mentioned above shall get the same advantage as the directors of the\ncompany. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_for_Director_Nomination_under_legal_Metrology\"><\/span>Procedure for Director Nomination under legal Metrology-<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Director Nomination under legal\nMetrology is a simple procedure which is explained u\/s 49 (2) of the Legal\nMetrology Act. The company can nominate the Director to act on its behalf.<\/p>\n\n\n\n<p>For Director&#8217;s Nomination, the company\nfollows <strong>Section 49(2) of the Legal Metrology Act.<\/strong> The process of\nDirector Nomination is mentioned below-<\/p>\n\n\n\n<ul><li>The\ncompany will choose directors.<\/li><li>Before\nappointing, the company first needs to get the approval of the Director of the\ncompany whom it wants to appoint as Director as per the legal metrology Act.<\/li><li>Written\nconsent of the Director is a must.<\/li><li>The\ncompany will then issue an order written in the same kind.<\/li><li>The\ncompany will then notify the Director or controller of the department of Legal\nMetrology of the identical.<\/li><\/ul>\n\n\n\n<p><strong>Notice: In case of multiple branches of\nthe same company or group of persons exist; everyone holds the right to choose\ntheir Director according to the legal metrology act<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Appointment_of_Nominee_Director_In_case_of_Partnership_Firm\"><\/span>Appointment of Nominee Director, In case of Partnership Firm-<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Section 49 of the Legal Metrology Act specifies\nthe Directors nomination by the Partnership Firm. As far as subsection (7) is\nconcerned, it clarifies the company&#8217;s vide explanation and the role of the\nDirector.<\/p>\n\n\n\n<ul><li>The\ncompany here includes body corporates, further including firms and association of\npersons.<\/li><li>In\nthe context of a Partnership firm, Director means partners in the firm.\nHowever, it must be noted that the person as mentioned above (s) shall get the\nsame benefits as the Director Nominated by the company. <\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_to_cancel_the_appointment_of_the_Nominee_Director\"><\/span>How to cancel the appointment of the Nominee Director?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Below mentioned are the reasons where the\nDirector appointed under the Legal Metrology act will get cancelled:<\/p>\n\n\n\n<ul><li>When the notice is received from the company&#8217;s Director, Concerned Controller or any such <strong>authorised officer<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Authorised_officer\"><strong>[1]<\/strong><\/a><\/sup>. <\/li><li>The Nominated person who ceases to be a director of the company shall communicate the detail of cessation to the Company&#8217;s Director, Concerned Controller or any such authorised officer.<\/li><li>The person nominated requests the Company&#8217;s Director, Concerned Controller, or any authorised officer to cancel the nomination. <\/li><li>The request shall be in written form and shall act following the Company&#8217;s Director, Concerned Controller or authorised legal metrology officer. <\/li><li>The Director nomination shall not be deemed cancelled earlier than the date of the request letter.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In a nutshell, we can say, Director Nomination in context with Legal Metrology is different from directors&#8217; appointments in the company&#8217;s ordinary business.
