The Lawful Metrology\n(Packaged Commodities) Rules, 2011 (Rules) completely outline the compliance\nwith all legal requirements adhered to by those who deal with and make\ndeclarations regarding &#8220;Packaged commodities.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Scope_and_Applicability_for_Packer_Registration\"><\/span>Scope and Applicability for Packer Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Rule 27 contains provisions about\nregistration as a &#8220;Manufacturer,&#8221; &#8220;Packer,&#8221; and an\n&#8220;Importer.&#8221; Before we look at the registration process, it is crucial\nto be aware of the distinction between the terms&#8217; Manufacturer and\n&#8220;Packer.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_a_Manufacturer\"><\/span>What is a Manufacturer?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per Rule 2(d),\n&#8220;Manufacturer&#8221; is a term that refers to &#8220;Manufacturer&#8221;\nmeans and includes any one or any company who-<\/p>\n\n\n\n<ul><li>Make\/produce\nor create a commodity.<\/li><li>Puts\nor causes placed any label on any product packaging, and the mark implies that\nthe item in the package is a product made, manufactured, or produced by the\nperson or company.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_Packer\"><\/span>What is Packer?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per Rule 2(g), &#8220;Packer&#8221;\nmeans a person or firm that prepares any product in any packaging, container,\nor other containers, and in containers suitable for selling, either in retail,\nwholesale, or otherwise.<\/p>\n\n\n\n<p>The term &#8220;pre-packed&#8221; refers to\na product that is not purchased by the buyer and is packaged in a box\nregardless of the type, closed or un-sealed, to ensure that the item contained\nis of a certain quantity.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Applicability_for_Packer_Registration\"><\/span>Applicability for Packer Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Rule 27 allows for two types of licenses:<\/p>\n\n\n\n<ul><li>Packer\nand <\/li><li>Importer.\n<\/li><\/ul>\n\n\n\n<p>The rule states that the registration is\navailable to anyone who packs or imports any product to be delivered or sold.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Timeframe_for_filing_application\"><\/span>Timeframe for filing application <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\nThe\nApplication shall be made before the Director\/Controller of Legal Metrology. It\nshall be made within ninety days from the date on which he or it commences such\npre-packing\/importing\n\n\n\n<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Form_and_Manner_to_applying_for_Packer_registration\"><\/span>Form and Manner to applying for Packer registration&nbsp; <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Each applicant shall make an application\nfor registration to the Director\/Controller, as the case may be with the\nfollowing information:<\/p>\n\n\n\n<p>a) Applicant&#8217;s name<\/p>\n\n\n\n<p>b) The complete address of the premises\nwhere the applicant carries out the import or pre-packing of one or several\ngoods<\/p>\n\n\n\n<p>Here, &#8220;Complete address&#8221; means\nthe factory&#8217;s address. In other cases, provide the city name, the number (if\nthere is one) attributable to the location of the packer or Manufacturer or the\ncity or state in which the packer or Manufacturer conducts the business and the\nPostal Index Number Code. <\/p>\n\n\n\n<p>(c)The title of the product or other\ncommodities pre-packed and imported by the requestor.<\/p>\n\n\n\n<p>Alongside the above specifics about the\nimport of goods and details of countries where the products are imported must\nbe disclosed in the case of the need to register as an importer.<\/p>\n\n\n\n<p>A shorter address is permitted when the\nController\/Director is satisfied that address is enough to allow the consumer\nor other person to identify the Manufacturer, Manufacturer, or the packer. <\/p>\n\n\n\n<p>The Application and supporting documents\nmust be submitted with the fee of Rs. Five Hundred. Following the verification\nof the Application and the required documents, the Controller or Director\nissues the Certificate of Registration in the event of a dispute. It will be\nissued with the designation of &#8220;packer&#8221; Importer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Process_for_Packer_Registration\"><\/span>Process for Packer Registration<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Department of <a href=\"https:\/\/corpbiz.io\/legal-metrology-act-registration\"><strong>Legal Metrology issues Registration Certificates<\/strong><\/a> to all Packers, Manufacturers, and Importers for any product packages. These Registration Certificates have a certain validity. However, in case of modification, the licensee needs to apply for Amendment of Certificates.<\/p>\n\n\n\n<p>The process to get a Packer registration\nis mentioned below-<\/p>\n\n\n\n<ul><li>Register\n\/ Create an Account for Online Application<\/li><li>Login\nWith Valid Credentials<\/li><li>Select\nthe most appropriate License Type under the &#8216;Apply for New License the link<\/li><li>Fill\nin the Online Application Form<\/li><li>Upload\nthe required Documents<\/li><li>Tap\non the Preview tab To Verify &amp; Confirm The Application Form<\/li><li>Submit\nThe Application<\/li><li>Tap\non the Preview to secure the Printout Of Submitted Application Form<\/li><li>Submit\nself-attested photocopies of the uploaded documents and Application Forms by\ngoing to the appropriate office<\/li><li>A\nconcerned officer will visit the area for an inspection on the spot.<\/li><li>After\neverything is in order and everything is in order, the licensee will have to\npay a new license fee.<\/li><li>Obtain\nThe Electronic Copy of the License<\/li><\/ul>\n\n\n\n<p><strong>Note- Any change on the registration\ncertificate should be made known to the Registrar in writing with a charge of\none hundred rupees.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Offences_and_Penalty_related_to_Packer_registration\"><\/span>Offences and Penalty related to Packer registration <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Whoever violates the rules 27 to 31 is\npunished with a fine of four thousand rupees. If a corporation infringes, each\ndirector or the responsible person will be held accountable differently.<\/p>\n\n\n\n<p>It is important to remember that registration under Rule 27 is obligatory for all &#8220;pre-packed goods.&#8221; Outside of the meaning given within the <strong>Legal Metrology Act 2009<\/strong><sup><a href=\"https:\/\/www.indiacode.nic.in\/handle\/123456789\/2102\"><strong>[1]<\/strong><\/a><\/sup><strong>,<\/strong> there is no clear definition of the word. Although several High Courts and the Supreme Court have tried to interpret the term using various Judicial Precedents, a lack of clarity in this respect continues to prevail among businesses and entities that are not in compliance with the conditions in these rules.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><p>In a nutshell, there are various business\noperations to go through measurement and weighing for excellent performance.
