The registration is mandatory and\nbinding on the importers of the commodities.&nbsp;<\/p>\n\n\n\n<p>This rule came\ninto force on 1st April 2011.<\/p>\n\n\n\n<p>All the products\nthat are packed in a packet, package, or container and have the weight of\n10g\/10ml-50kg are called <em>packaged commodities<\/em> and are covered under the\nLegal Metrology (Packaged Commodities) Rule, 2011.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The objective of Packaged\nCommodity Rule<\/strong><\/h2>\n\n\n\n<p>The main\nobjective of this Rule is to ensure and maintain the uniformity of the labels\naccording to the standard rules given under this Act so that the interest of\nthe consumer is protected and safeguarded.<\/p>\n\n\n\n<p>The Legal\nMetrology (Packaged Commodities) Rule has made mandatory provisions for\nregistration, declaration, or licensing to enforce these rules.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Rule 27 of Legal Metrology (Packaged Commodities) Rule,2011<\/h2>\n\n\n\n<p>Rule 27 is covered under Chapter VI of the Legal Metrology (Packaged Commodities) Rule,2011, which talks about the Registration of Manufacturers, importers, and packers.\u00a0<\/p>\n\n\n\n<p>A notification\npublished on 7th March 2011 under the Legal Metrology (Packaged Commodities)\nRule, 2011 states that any individual, firm, company, corporation, Hindu\nundivided family or society who or which wants to pre-pack or import commodity\nfor sale, delivery, or distribution needs to file an application to the\nDirector or Controller along with a fee of Rs. 500\/-, for registration of his\nor its name and complete address.&nbsp;<\/p>\n\n\n\n<p>The\nmanufacturers, importers, or packers shall apply within 90 days of commencement\nof the packaging procedure.<\/p>\n\n\n\n<p>If someone\ncontravenes the provisions of Rule 27, then he shall be punished with a fine of\nRs. 4000\/-.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Application for\nregistration under Rule 27&nbsp;<\/h3>\n\n\n\n<ul><li>The manufacturer, importer, or packer needs\n     to apply to the Director of Legal Metrology of Government of India at New\n     Delhi or Controller of Legal Metrology of State or UTs.<\/li><\/ul>\n\n\n\n<p><strong>Note:<\/strong>&nbsp;It is\nsuggested to apply at the headquarter in New Delhi. The registration will be\nvalid in the whole of India.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>The requirement of\nthe application:<\/strong><\/h3>\n\n\n\n<ol><li>The name&nbsp;<\/li><li>The complete address of the place where\n     pre-packaging and import of commodity takes place<\/li><li>The details of the commodities being packed<\/li><\/ol>\n\n\n\n<ul><li>If the application is considered\n     incomplete, it will be returned within seven working days of receipt of\n     the application.<\/li><li>If the application is complete, then the\n     applicant will be granted a Registration Certificate by the Director or\n     Controller.<\/li><li>For any alteration in the Registration\n     Certificate, the applicant has to provide details of change along with a\n     fee of Rs.100\/- to the Director or Controller of Legal Metrology.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Key points to\nremember while applying for registration<\/strong><\/h3>\n\n\n\n<table class=\"table table-bordered\"><tbody><tr><td>\n  &nbsp;\n  <\/td><td>\n  <strong>Online Fee<\/strong>\n  <\/td><\/tr><tr><td>\n  Manufacturer\n  <\/td><td>\n  Rs. 500\/-\n  <\/td><\/tr><tr><td>\n  Dealer\n  <\/td><td>\n  Rs. 100\/-\n  <\/td><\/tr><tr><td>\n  Packer\n  <\/td><td>\n  Rs. 500\/-\n  <\/td><\/tr><tr><td>\n  Importer\n  <\/td><td>\n  Rs. 500\/-\n  <\/td><\/tr><tr><td>\n  Repairer\n  <\/td><td>\n  Rs. 100\/-\n  <\/td><\/tr><\/tbody><\/table>\n\n\n\n<ul><li>Entire documentation needs to be\n     self-attested by the applicant.&nbsp;<\/li><li>All the documents should be in pdf format\n     with a size up to 2 MB.<\/li><li>The photographs should be in passport size\n     and jpg format only.<\/li><li>If the application is not filed within the\n     90days of commencement of the packaging procedure, then a late fee of Rs.\n     5000\/-.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Mandatory Documents\nto be uploaded<\/strong><\/h3>\n\n\n\n<ul><li>The License of trade\/manufacture\/factory,      etc., issued by MCD\/NMDC\/DDA, etc. If such a License is not available,      then an undertaking as an affidavit is required stating that the place is      not sealed by MCD nor located in non-conforming areas.<\/li><li>Residential Address proof<\/li><li>GST\/Sales Tax Registration<\/li><li>Passport size photograph<\/li><li>Memorandum of Association of Company, and if Partnership Firm then partnership deed.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Approval\nprocedure&nbsp;&nbsp;<\/strong><\/h3>\n\n\n\n<p>After submitting the application with the required fee, the <a href=\"https:\/\/corpbiz.io\/legal-metrology-act-registration\"><strong>Legal Metrology<\/strong><\/a> Officer visits and inspects the place. If the place is found as per the guidelines, he will ask the competent authority to grant registration through the authorized Zonal Officer.\u00a0<\/p>\n\n\n\n<p>After the grant\nof registration, an automatic e-mail and SMS is sent to the applicant on the\nregistered mobile number, and the applicant can download it or take a printout\nof it. The competent authority digitally signs the Registration Certificate.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Registration of\nshorter address&nbsp;&nbsp;<\/h3>\n\n\n\n<p>Any\nmanufacturer, importer, or packer can apply for registration with a shorter\nversion of his address along with the complete address. If the Director or the\nController is satisfied that the shorter address is enough to identify such a\nmanufacturer, importer, or packer, he shall grant the Registration\nCertificate.&nbsp;<\/p>\n\n\n\n<p>If the shorter address is registered, then it is lawful for the<strong> manufacturer<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Manufacturing\"><strong>[1]<\/strong><\/a><\/sup>, importer, or packer to mention the shorter address on the label of each commodity.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Conclusion<\/strong><\/h2>\n\n\n\n<p>Rule 27 of Legal Metrology  (Packaged Commodities) Rule,2011 gives the procedure for the registration of manufacturers, importers, and packers. They should apply to the Director or Controller for the Registration Certificate with all the required documents along with the requisite fee.
