The said rules\nunderpin various compliances and norms to ensure safe and apt handling of\nbatteries throughout the supply chain.<\/p>\n\n\n\n<p>According to Batteries (Management and\nHandling) Rules, 2001, the battery means a lead-acid battery that generates\nelectricity and contains lead metal. Meanwhile, &#8216;registered recycler&#8217; is the one who is registered under\nMoEFCC for reprocessing utilized lead-acid batteries and their components.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Lead_Acid_Batteries_and_Safety_Concerns\"><\/span>Lead Acid Batteries and Safety Concerns<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Lead-acid batteries entail lead, lead\noxide, sulphuric acid, and lead sulphate. The negative electrode comprises\nmetallic lead, containing a minor amount of calcium, antimony, and tin. The\npositive electrodes consist of lead oxides in several compositions. <\/p>\n\n\n\n<p>According to international health and\nenvironmental norms, lead and lead oxides are tagged as hazardous heavy metal\nmaterials. The electrolyte refers to a concentrated solution of sulphuric acid,\nand it may cause serious harm to human skin. <\/p>\n\n\n\n<p>Under an ideal operating scenario, no\nchemical components can escape the battery enclosure. Rigorous handling and\ntreatment, however, may pose a risk of exposure. Under the production of such\nbatteries and during the recycling of utilized batteries, special attention is\nrequired for averting chemical exposure to the production staff. This is one\nreason for the existence of Batteries (Management and Handling) Rules, 2001, as\nit seeks to promote safe and apt management of lead-acid batteries. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Responsibilities_of_Recyclers_under_Batteries_Management_and_Handling_Rules_2001\"><\/span>Responsibilities of Recyclers under Batteries (Management and Handling)\nRules, 2001<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Each recycler shall;<\/p>\n\n\n\n<ul><li>Apply\nfor registration to the concerned ministry or an agency designated by it if not\napplied already by furnishing details in the prescribed application form.<\/li><li>Ensure\nstrict compliances of norms of registration; however, those already registered\nwith the competent ministry or designated agency for reprocessing utilized\nbatteries would be bound by the norms of such registration.<\/li><li>Submit\nannual return in form VII to the respective state board<\/li><li>Make\navailable all records related to the receipt of utilized batteries, quantities,\nsources, and metal yield to be furnished to the SPCB for inspection.<\/li><li>Mark\n&#8220;Recycled&#8221; on lead retrieved via reprocessing; and<\/li><li>Create\npublic awareness via publications, advertisements, posters or others relating\nto the following<\/li><\/ul>\n\n\n\n<p>(a) hazards of lead; &amp;<\/p>\n\n\n\n<p>(b) Duties of consumers to return utilize\nbatteries only to the authorized dealers or deliver at the designated\ncollection units.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_relating_to_the_registrationrenewal_of_registration_of_recyclers\"><\/span>Procedure relating to the registration\/renewal of registration of recyclers<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>(1) Every recycler of utilized lead-acid\nbatteries shall file an application in the prescribed form along with\nbelow-mentioned documents with the Joint Secretary, Ministry of Environment and\nForests or any other designated agency for grant of registration or renewal;<\/p>\n\n\n\n<p>(a) A copy of the legitimate consents\nissued by the respective SPCB. <\/p>\n\n\n\n<p>(b) A copy of <a href=\"https:\/\/corpbiz.io\/hazardous-waste-management-authorization\"><strong>authorization issued under Hazardous Wastes<\/strong><\/a> (Management and Handling) Rules, 1989<\/p>\n\n\n\n<p>(c) A copy of registration certification\nwith DIC i.e. District Industries Centre;<\/p>\n\n\n\n<p>(d) A copy of the document evidencing the\ninstalled capacity of the unit granted by either District Industries Centre\/\nSPCB<\/p>\n\n\n\n<p>(2) The Joint Secretary, MoEF or any\ndesignated official shall pay a visit to the applicant&#8217;s facility to make some\ncompliance check relating to equipment available, disposal unit, or technical\ncapabilities,<\/p>\n\n\n\n<p>(3) The Joint Secretary, MoEF or any\ndesignated official shall decide on an application for registration within the\nduration of ninety days from the date on which the application was received.<\/p>\n\n\n\n<p>(4) The registration conferred shall be\nin effect for two years from the issuance date or from the renewal date unless\nsuspended or cancelled earlier;<\/p>\n\n\n\n<p>(5) An renewal application shall be filed\nin Form VI at least six months prior to its expiration. The Joint Secretary,\nMoEF or any designated official shall renew the registration granted under\nsub-rule (4) of this rule, post scrutinizing each case on merit;<\/p>\n\n\n\n<p>(6) The Joint Secretary, MoEF or any\ndesignated official may, after providing reasonable opportunity of being heard\nto the applicant, refuse to accord registration;<\/p>\n\n\n\n<p>(7) The <strong>Joint Secretary<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Joint_secretary_to_the_Government_of_India\"><strong>[1]<\/strong><\/a><\/sup>, MoEF or any designated official may cancel or suspend a registration granted under governing rules if in his\/her opinion, the recycler has failed to adhere to any norms of registration or with any guidelines of the Act post rendering him an opportunity to share the reasons therefor;<\/p>\n\n\n\n<p>(8) It shall be liability of the State\nBoards to keep the tap on the compliance of norms prescribed which granting\nregistration, and<\/p>\n\n\n\n<p>(9) An appeal shall lie against any\njudgement of cancellation or suspension passed by the said authority. The\nappeal shall be in writing and attested with an order copy appealed against and\nshall be provided within thirty 30 days of the judgment&#8217;s passing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Using batteries in households is relatively uncommon today. It serves various purposes and acts as an alternative power source. Batteries have some severe environmental and health-related hazards, and therefore they are required to be produced and handled aptly.
