The nature of hazardous wastes is large and diverse.\nHazardous wastes can be found in the form of solids, liquids, and contained\ngases. <\/p>\n\n\n\n<p>Also, they can be the by-products of\nproduction processes, obsolete materials, or discarded unutilized commercial\nproducts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Transportation_of_Hazardous_Waste_or_Other_substances\"><\/span>Transportation of Hazardous Waste or Other substances-<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Transportation of Hazardous waste means\nmovement of hazardous waste by air, rail, water or road for treatment, storage,\nand disposal purpose. Spill risk is significantly higher during loading,\ntransportation, &amp; unloading. That is one of the prominent reasons why\nHazardous Waste is generally highly regulated. <\/p>\n\n\n\n<p>Hazardous Waste transportation\nregulations cover the transportation of Hazardous Waste outside of an\ninstallation. Every transporter or operator carrying the dangerous waste shall\nconsider the following points-<\/p>\n\n\n\n<ul><li>Every\ntransport carrying hazardous goods shall show a distinct mark of the class\nlabel appropriate to the hazardous waste.<\/li><li>Every\npackage containing hazardous waste shall display distinct class labels\nappropriate to the type of hazardous waste.<\/li><li>If\npackages contain goods that denote more than one hazard, such packages shall\ndisplay distinct labels to indicate the hazards.<\/li><li>Every\nconveyance carrying goods of hazardous nature shall be fitted with a tachograph\nand a spark arrester.<\/li><\/ul>\n\n\n\n<p>On-site Transportation of Hazardous waste\ntypically involves smaller amounts of materials over shorter distances. Also,\nit poses significant risks from the frequency of the activity and the lack of\nproper regulation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Responsibilities_for_Occupier_for_Transportation_of_hazardous_and_other_waste\"><\/span>Responsibilities for Occupier for Transportation of hazardous and other\nwaste<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The occupier in relation to any premises\nmeans an individual who has control over the affairs of the premises. Also, he\nis the person who is overall responsible for handling the hazardous waste and\nshall ensure that the waste handled should not create any imbalance in the\nenvironment. He should also be required to safeguard that the persons working\non the site with hazardous waste should be trained and equipped to ensure their\nsafe working. The four main factors of hazardous waste transportation are <\/p>\n\n\n\n<ul><li>Authorization <\/li><li>Packaging <\/li><li>Labeling <\/li><li>Transportation<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Authorization<\/h3>\n\n\n\n<p>It is required from the SPCB \/pollution\ncontrol committee for everyone engaged in waste management. It includes-<\/p>\n\n\n\n<ul><li>processing,\n<\/li><li>treatment,\n<\/li><li>package,\n<\/li><li>transportation,\n<\/li><li>collection,\n<\/li><li>conversion,\nsale and use of hazardous waste.<\/li><\/ul>\n\n\n\n<p>To obtain such authorization from\nSPCB\/PCC, the concerned individual should apply in form 1 of the rules. The\nhazardous waste shall collect, stored, or reprocessed only in the authorized\nfacility by the SPCB\/PCC.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Packaging<\/h3>\n\n\n\n<p>The next factor is that the container\nthat handles the hazardous waste should combat the handling &amp; retain\nintegrity for a mini. of six months container requirements for hazardous\npackaging waste enclosed in Annexure 1. The container should be packed\nappropriately and sealed during transportation to prevent the spillage of\nwaste.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Labeling<\/h3>\n\n\n\n<p>For handling and transportation of\nhazardous substances, two types of labelling are required-<\/p>\n\n\n\n<ul><li>Labeling\nof individual transport containers.<\/li><li>Labeling\nof transport vehicles. <\/li><\/ul>\n\n\n\n<p>Labeling should be marked clearly on the\ncontainer with particulars of contents of the waste. Labeling of the container\nshall be provided with a general label as per Form 12 of the Rules. Labeling\nmust be unchangeable, waterproof, and firm to the container and labeled with\nthe words &#8220;HAZARDOUS WASTE&#8221; in Vernacular language, Hindi \/ English.\nApart from labeling, Emergency contact phone numbers shall be prominently\ndisplayed. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Transportation_of_Hazardous_Waste\"><\/span>Transportation of Hazardous Waste<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>&nbsp;The following essential factor is the\nTransportation of Hazardous Waste. It is not only the responsibility of the\nwaste generator to manage the transportation process. It also includes the\nco-processor, which utilizes the waste, and the transporter, transporting the\ntrash from the generator to the co-processor. The waste generator should ensure\nthat wastes are packaged suitably for safe handling, storage, and transport. <\/p>\n\n\n\n<p>The transportation shall be in accordance with the provisions of the <a href=\"https:\/\/corpbiz.io\/hazardous-waste-management-authorization\"><strong>Hazardous Waste <\/strong><\/a>(Management, Handling and Transboundary Movement) Rules, 2008, and the rules made by the Central Government under the Motor Vehicle Act, 1988 and other guidelines issued from time to time. <\/p>\n\n\n\n<p>In the transportation of hazardous waste\nthrough a State other than the State of origin or destination, the occupier\nshould inform the concerned SPCB before handing over the hazardous waste to the\ntransporter. <\/p>\n\n\n\n<p>Also, the occupier shall provide the\ntransporter with relevant disclosures in Form 11 (i.e. Transport Emergency\n(TREM) Card) of the Hazardous Waste (Management, Handling and Transboundary\nMovement) Rules, 2008, regarding the hazardous nature of the wastes &amp;\nmeasures to be followed in case of an emergency. Also, the occupier should\nensure that the waste is packed and sealed in a manner suitable for handling\nand transportation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Responsibilities_of_the_Transporter\"><\/span>Responsibilities of the Transporter<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The transporter of Hazardous waste shall\nensure that-<\/p>\n\n\n\n<p>The vehicle used for transportation shall be in accordance with the provisions under the <strong>Motor Vehicle Act, 1988<\/strong><sup><a href=\"https:\/\/en.wikipedia.org\/wiki\/Motor_Vehicles_Act,_1988\"><strong>[1]<\/strong><\/a><\/sup>, and rules made thereunder.<\/p>\n\n\n\n<ol><li>He should also require obtaining\nrequisite authorization from SPCB\/PCC to transport hazardous waste. <\/li><li>Transporter shall have the requisite\ncopies of the certificate for transportation of hazardous waste. <\/li><li>The transporter should have legitimate\n&#8220;Pollution under Control Certificate&#8221; (PUCC) during the\ntransportation of hazardous waste and shall be displayed appropriately. <\/li><li>To facilitate easy identification, the\nvehicle shall be painted preferably in blue with a white strip of 15 &#8211; 30 cm\nwidth running centrally all over the vehicle. <\/li><li>The vehicle should be outfitted with a\nmechanical handling device as may be required for safe handling &amp;\ntransportation of the wastes. <\/li><li>The words &#8220;HAZARDOUS WASTE&#8221;\nshall be manifested on all sides of the Vehicle in Vernacular Language, Hindi,\nand English.<\/li><li>The name of the facility occupier or the\ntransporter shall be displayed as the case may be. <\/li><li>The vehicle shall be outfitted with\nroll-on \/roll-off covers if the individual containers do not possess the same. <\/li><li>Carrying passengers is strictly\nprohibited, and those associated with the waste hauliers shall be permitted\nonly in the cabin. <\/li><li>Transporter shall carry requisite\ndocuments of the manifest for the wastes during transportation as required\nunder Rule 21 of the HW (M, H &amp; TBM) Rules. <\/li><li>The\ntrucks shall be dedicated to the transportation of hazardous wastes, and they\nshall not be used for any other purpose. <\/li><li>Each Vehicle shall carry a first-aid kit, spill control equipment and fire extinguisher. <\/li><li>Hazardous Waste transport vehicles shall run only at speed specified under the Motor Vehicle Act to avoid any eventuality during the transportation of hazardous waste.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Accident_reporting_and_follow-up\"><\/span>Accident reporting and follow-up <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Where an accident occurs at a hazardous\nwaste site or during transportation of the hazardous waste, the occupier of the\nfacility, as the case may be, shall report immediately to the State Pollution\nControl Board about the accident in Form14. <\/p>\n\n\n\n<p>Liabilities of the person involved in the\ntransportation of hazardous waste. The occupier, importer, transporter, and\noperator of the facility shall be liable for all damages caused to the\nenvironment or third party due to improper handling of the hazardous wastes or\ndisposal of the hazardous wastes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>In a nutshell, Hazardous waste generated at a respective site majorly requires transport to an approved treatment, storage, or disposal facility.
