Transboundary Movement) Rules, 2016<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Hazardous waste refers to any waste which\nbecause of characteristics<strong> such as chemical, physical, biological,\nflammable, reactive, toxic, or corrosive poses danger to human life or\nenvironment, whether solely or in touch with other wastes, and shall include:<\/strong><\/p>\n\n\n\n<p>(i) waste cited under column (3) of\nSchedule I;<\/p>\n\n\n\n<p>(ii) waste having equivalent to or more\nthan the concentration threshold cited for the constituents in class A and B of\nSchedule II or any of the characteristics as cited in class C of Schedule II;\n&amp;<\/p>\n\n\n\n<p>(iii) wastes cited in Part A of Schedule\nIII with respect to export or import of such wastes or the wastes not cited in\nPart A but manifest hazardous traits cited in Part C of Schedule III;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Role_of_Hazardous_Waste_Management_in_Waste_Control\"><\/span>Role\nof Hazardous Waste Management in Waste Control <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Hazardous waste can pose a substantial risk to humans and the environment. Such wastes can exist in various forms, including solids, liquids, gases, and sludges, and they are originated mainly via chemical production and other industrial undertakings. <\/p>\n\n\n\n<p>They may cause considerable damage during\ninadequate storage, treatment, transportation, or disposal activities. Improper\nstorage or disposal of such waste frequently contaminates groundwater supplies.\n<\/p>\n\n\n\n<p>Residents near waste disposal sites can\nget severely affected by such wastes. In a bid to fix this frontline issue and\nto mitigate future harm from such wastes, the Indian Government, in association\nwith MoFEEO, closely probe the practice of hazardous-waste management.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Authorisation_for_Entities_Dealing_with_Hazardous_Waste\"><\/span>Authorisation\nfor Entities Dealing with Hazardous Waste<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Every occupier of the operational unit\ninvolved with the handling, accumulation, storage, packaging, transportation,\ntreatment, recycling, processing, recovery, pre-processing, co-processing,\nsale, transfer or disposal of the waste hazardous in nature shall be required\nto register with a competent state authority and avail required authorisation. <\/p>\n\n\n\n<p><strong>The concerned authority has every right\nto revoke the <\/strong>authorisation<strong>\nin case of non-compliance. The defaulter, in such cases, will get the <\/strong>reasonable\nopportunity of being heard before the authority. <\/p>\n\n\n\n<p><strong>Upon suspension of the <\/strong>authorisation, the concerned state\nauthority may confer guidelines to the individual whose authorisation has been\ncancelled or suspended for the management of the hazardous and other wastes,\nand such occupier shall adhere to such guidelines.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Liabilities_of_the_Occupier_for_Hazardous_Waste_Management\"><\/span>Liabilities\nof the Occupier for Hazardous Waste Management<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>(1) For the management of hazardous wastes, an occupier of the facility shall comply with the given steps, viz:<\/p>\n\n\n\n<ul><li>Prevention<\/li><li>Abatement<\/li><li>Reuse<\/li><li>Recycling<\/li><li>Recovery<\/li><li>Utilization\nincluding co-processing;<\/li><li>Apt\ndisposal<\/li><\/ul>\n\n\n\n<p>(2) The occupier of the facility shall be accountable for apt and eco-friendly <a href=\"https:\/\/corpbiz.io\/hazardous-waste-management-authorization\"><strong>management of hazardous waste<\/strong><\/a><\/p>\n\n\n\n<p>(3) The hazardous waste generated via the\noccupier&#8217;s facility shall be sent or sold to certified actual users or shall be\ndisposed of in a certified disposal unit.<\/p>\n\n\n\n<p>(4) The hazardous waste shall be\ntransported to an authorised disposal facility pursuant to the norms of\ngoverning rules.<\/p>\n\n\n\n<p>(5) The occupier who aims to get his\nhazardous waste treated and disposed of via operator of storage, treatment, and\ndisposal unit shall render the operator such specific detail for the safe\nstorage and disposal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Provisions_Regarding_the_Storage_of_Hazardous_Wastes\"><\/span>Provisions\nRegarding the Storage of Hazardous Wastes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The occupiers of production units may\nstore the hazardous and other wastes for the duration not surpassing 90 days\nand shall administer the record pertaining to the sale, transfer, recycling,\nstorage, recovery, co-processing, pre-processing, and use of said wastes and\nmakes such records accessible for inspection.<\/p>\n\n\n\n<p>Provided that the concerned state\nauthority many extend the aforesaid timeline in following cases, viz;<\/p>\n\n\n\n<p>(i) Small generators (up to 10 T\/Annum)\nup to 180 days of their yearly capacity;<\/p>\n\n\n\n<p>(ii) Actual users and disposal unit\noperators up to 180 days of their yearly capacity<\/p>\n\n\n\n<p>(iii) Occupiers who lack access to storage,\ntreatment, disposal unit in the respective State or<\/p>\n\n\n\n<p>(iv) The wastes which require being\nstored for development of a process for its recovery, recycling,\npre-processing, co-processing or utilisation;<\/p>\n\n\n\n<p>(v) in any other event, on viable grounds\nup 180 days.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Responsibilities_of_State_Government_for_apt_Management_of_Hazardous_Wastes\"><\/span>Responsibilities\nof State Government for apt Management of Hazardous Wastes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>(1) Department of Industry located in the State or any other government department authorised in this context by the State Government, to ensure allocation or earmarking of the industrial plot for recycling, pre-processing, and other utilisation of hazardous wastes in the prevailing and hazardous estate, part and industrial clusters;<\/p>\n\n\n\n<p>(2) Department of Labour located in the\nState or any other government department authorised in this context shall- (a)\nensure acknowledgement and registration of workforce engaged with recycling,\npre-processing, &amp; other utilisation. <\/p>\n\n\n\n<p>(b) aid formation of groups of such\nworkers to ensure the establishment of such facilities<\/p>\n\n\n\n<p>c) undertake skill development\ninitiatives for the workers<\/p>\n\n\n\n<p>(d) undertake yearly probing and ensure\nthe health and safety of workers<\/p>\n\n\n\n<p>(3) Every State Government may draft an integrated plan for apt implementation of these norms and furnish an annual report of the MoFFCC, i.e. <strong>Ministry of Environment<\/strong><sup><a href=\"https:\/\/moef.gov.in\/en\/\"><strong>[1]<\/strong><\/a><\/sup>, Forest and Climate Change<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Hazardous wastes pose considerable risk to the environment and human life, and for this reason, it seeks proper disposal and treatment.
